Hi,

I want to know, Can I drive my own car from the US to Canada for completing my PR formalties.
I am a non US citizen , who is working in the US on H1B visa.

Hello:

i hold a non expired h1b and staying legally in US. I am planning to drive to Toronto for 3 days for vacation. Do i need to get a canadian travel visa?

If you are not a US citizen or Canadian PR, I assume, you need to have Canadian Travel VISA.

Hi Poppy,

Nothing till now.

If you are going for good to Canada , then there may be formalities to be completed , as you will be importing a car from the US.

However ,I assume that, if you are intending to get back to the US after initial formalities and if you have valid status in the US , there should be No issues.
If you are not planning immly , you can wait for me. I will be going to Canada by this month in end in my car.

If you have heard of any news like that, plz to let me know.

Hi Sam...I really appreciate your reply. I have not heard anything like that but have seen people discussing on forums about this thing. Some try to suggest that take a rental car.....not sure. I am planning to land around July 20th just to complete those formalities and will be coming back to US as I am working here on H1B. I am really looking forward to your experience. By the way...as you are also on H1B, is your 485 filed?

Hi Poppy,

I went for PR landing procedures in my own car, and came back into the US and back home today.

I was asked for the address in Canada for receiving the PR card.
The list of item ,currently carrying into the Canada
The list of item , which are follow.

If you taking your car, have the Registration certificate (and the title, if you are moving out of the US for good).
Also, the required funds as Cashiers check or any required form.

The whole process took around 2 hours at Windsor , ON.

Note : Apply for your SIN# from any of the service center at the location where ever you are staying..

Hi Sam...I was anxiously waiting for your landing experience. Thanks for posting it. I will be going around July 15 but will be returning to US within 6 days. I have a couple of questions:

1. Did they ask you to start the import process for your car or anything like that? So, in your view, is it alright to drive one's own car with registration certificate without problem?

2. Were you asked if you are moving in permanently at this time or will move in later on?

3. Can US Bank Statements suffice as Proof of funds?

4. Any problem coming back to US? Were you issued new I-94's?

Hi Poppy,

Here it is..
1. I informed them that, this is initial visit and all the things mentioned in the form(b4a form) along with the car, which I am traveling currently will be imoorted, during my second visit. They have mentioned that , that , I need to bring my TITLE of the car also.
I didnt have any problem, driving my car in Canada. Take the registration and Canadian car insurance(I took it via GEICO at no extra cost)

2. Yes, You can inform them that you will be there for few weeks or months and going back to the US and returning back to Canada.

3. No, Statement of proof will not suffice. I took a Cashiers check on my name . They took the information based on the USD to Canadial US conversion value.

4. No problem while entering back to the US. I showed the same I-94 which I had earlier and the valid petition.

I am not sure of the diff between B4 and B4a, I took, B4a and there were no questions on that.
I assume, you can also take B4a.

Either one should have valid visa stamped or one can use AVR if he has a visa stamped that is expired (due to the passage of time) and valid I797/I94. One cannot use AVR if there is no Visa Stamp in the passport.

Hi Jasvinder,

I do NOT have valid VISA now, my visa has expired, however I have valid PETITION, hence was able to enter into US without any challenges.

For re validation process, below mentioned are the criteria

1. You should have not traveled outside Canada during your visit to Canada
2. Your travel should not be over 30 days
3. You should have not applied and got rejected for VISA stamping from US consulate at Canada
4. You should not belong to Syria, Iran, Cuba and Sudan.

Search for - 22 CFR 4 1.1 12 and 8 CFR 214.1 to know more about revalidation process.

I came to US on F1(student Visa) Completed my BS degree. My Student visa expired sometime in 2007. Than i got my H1B Approved and currently working on H1B visa. I never left US since i got my H1B approval. I dont have H1B visa stamped on my Passport. (only Old Expired Student Visa) My Old i-94 expired and USCIS issued new one with my H1B Petition. Will i be able to re-enter into US after short visit to toronto under automatic Visa Re-validation?

Yes, you can. According to the following paragraph of the AVR Rule. The link has been posted by Sam above.

(ii) In cases where the original nonimmigrant classification of an alien has been changed by USCIS to another nonimmigrant classification, the validity of an expired or unexpired nonimmigrant visa may be considered to be automatically extended to the date of application for readmission, and the visa may be converted as necessary to that changed classification.

I have approved PR (Alberta Nominee). I stay in Indiana. I want to complete PR formalities - I am on H1B , my I 140 is filed. I came on student visa here -that visa stamp is there. But no H1B stamp. My H1B is valid till 2011 and original I 94 is valid till Jan 2010.

How do I go about it. Which port of entry should I take. Like should I drive till Montana for Alberta. Do the US authorities take your I 94 or Canada official take your I 94.
Is there any chance of getting into any kind of issue while coming back. Reason is that my entire family is here. I don't want to get into issues in Canada or risk going back to India.

Or do you think while landing I should get Visa also stamped.

Title is ownership of property - like title to house, title to car, title to other inanimate things (properties), etc.
U pay tax for owning that property.

Registration is licence to use some one else's property - i.e. registration of car - so u can use public roads, etc.

Title is what is given by your dealer to you - when u buy the car - and is duly registered at the Secy of State office. You pay one time title transfer fees.

Registration is again done by SOS annually - and you pay registration or licence fees based on your age of vehicle, type pf vehicle, etc.

Hope it clears your doubts.

It may be possible. Ask the person who has the lien i.e. the bank or the financial institution. It would be their call - I suppose.

Canada also has the requirement that title should be clear of encumberances.

Or look in the loan document, it should clearly list out the conditions..........Hope this helps.
