Hi, I am working in US on H1-B, thinking about applying for Canadian immigration using Alberta Immigrant Nominee Program (AINP). Do I need to go for IELTS first before applying for it, or it is waived for H1-B workers.

You do not need to qualify for IELTS in this category - the only thing you should have is a nomination certificate from Alberta - hope this helps ??

No IELTS required, no need of 67 points to qualify, only needs to be in USA on valid H1b with 1 yr experience and currently on job.

just PNP nomination letter from Alberta then CIC will issue PR visa after medical and security clearance.

I have a question regarding AINP program. What if a person on H1 applies for this program, gets nominiation certified and applies for PR program thru CIC and while his application is pending, the person gets his Green Card (US).
Is he still eligible to apply under AINP program even though his status in US has now changed to Permanent Resident?

Yes, If you got nominated before getting GC because your status was H1B at the time of AINP nomination.

Anyway.. find some authentic sources as this is just an opinion which make sense.

Did you check your query with these guys : Pnp.Office@gov.ab.ca or immigration.info@gov.ab.ca. Or you can get more credible information from any Program Officer - Alberta Immigrant Nominee Program, Tel: (780) 644-4566 Fax: (780) 427-6560.

where did you submit ? the normal timeline was 3months, and I heard that they are receiving lot of applications. Cross you fingures and wait, if you have already past of this this 3moths contact them by phone or mail. they are nice and reply you back on your status.

Hi thinkingcanada,

You dont need to hire any canadian attorney for AINP just for filing your case. If your record is all clear then you can do it on your own. You can go through some of my other posts and you can get to know the steps and procedure.

That's true. You don't need a Lawyer to apply. Every thing goes smooth if you follow the rules they stated. I did it my self and now only waiting for RPR.

Job Search, Housing, Familiarity with Alberta. i wonder if these are trick questions.

Thanks for your quick responses friends.

ONe more question .After looking at the link which u have send it to me. It is mentioned that .Candidates are now required to mail a complete application package - including the AINP and Citizenship and Immigration Canada (CIC) forms listed below - to the following address

Till now i was thinking that.I just need to send the AINP APPLICATION FIRST once it is approved. I have to apply for CIC.

So which one is true.Whether i have to send both the applications (AINP AND CIC)at once. or one after another.

The one that you see on that website is true. Since Jan 1, 2009 the process has changed. Follow whatever is mentioned on that site.

The basic procedure is still the same, you get nomination from Alberta Immigrant Nomination Program and then send the original forms and fee to CIC(depending on where AINP sends your nomination certificate)

Hey guys, I am new here and I posted this question somewhere else and cannot seem to find it to see if there were any responses to the question. So I will repost it here.

Hello all, I have a question concerning applying for PR under the H1-B route (AINP). I initially submitted an application under that stream...AINP H1-B. Subsequent to submitting my application, my employer transferred me to our Calgary branch of the Company. Therefore, I am now here in Calgary on a TWP. I informed my immigration specialist (AB immigration specilist) of the change and she informed me that I just needed to submit some additional paperwork that my employer had to sign, and that I would not lose my spot in the queue. My questions are:

1) Does it mean that my application is now being changed from the AINP H1-B stream to something else?

2) Will this new route take a longer time to process (i.e receive the nomination letter from the government of AB as well as processing of my PR)

3) If I do receive a positive nomination from the government, can I still apply for an open work permit if I am not comfortable with my current job? I know that under the H1-B stream, once you receive a positive nomination, you can apply for an open wp. I am just wondering if that is the case for any application under the AINP.

Hello, I am glad to find this discussion board for AINP. Following is my understanding and some questions so far, can anyone see if I am incorrect any of the following?

1. It takes about 4~6 months to be nominated. And then the nominee shall send Permant Residency applications to CIC, followed by physical exams and police background check.

2. This nomination process doesn't require an interview. In any process until PR, are there interviews? Did anyone receive any contacts from Alterta Immigration office for verication of documents submitted?

3. Until the applicant is nominated, he/she has to work for the H1-B sponsor. Days like this, who knows who will survive and who will not. What if the applicant gets laid off before the nomination? Would the Alberta Immigration know about this? Do they require proof of employment at the time of decision making?

2. Once an applicant is nominated in Alberta how long does he/she have to live in Alberta before moving to another province? Is there a mandatory period for this program?

3. Can one apply for Alberta PNP and Federal Skilled Worker simultaneously?

Hello Goose,

1) You can do either as long as its very clearly readable in BLACK ink preferably.

2) There is no mandatory condition to live in Alberta however it seems ethical to do so. You will be granted PR of Canada once your application is all approved from CIC Canada. You will be free to work in any province after your PR approval.

3) Yes. But there will be separate processing fee for each application. You will be asked your choice once any one of these applications is towards its completion. In each of your application you will need to specify of the other application (FSQ or AINP)

It wont affect your application. By that time(Sep) you will positively get your PR almost approved...but why would you want to apply for PR as well as change to F1 here in USA?

2. Describe your plans for initial settlement in Alberta.

In my humble opinion these are generalised questions and I guess that the answers should be written in the words of the AINP Consulars. So if you had gotten a chance to view this webinar, you should be able to write effective answers for those questions.

I am in my 6th year of my H1B and my 6th yr expires next month. I have applied for extension for 7th year as my labor is pending since 1.3yr.
I want to apply for AINP under H1B category. It says that valid H1B visa is required at the time of final decision by AINP officer. What If i apply now and my h1b expires next month and at the final decision time my H1b is still under pending,
will I be eligible for AINP under H1b under these situations. Please reply as soon as possible as i have less time

Hi Perlcsufferer;
I thougt that in H1b stream you had only to probe you had the h1b status for at least 1 year,but when I applied to PNP they asked me for my visa in the passport and my I94 or any document shows my H1B status. By the way if you get nominated and when you apply to CIC Buffalo they also ask for your legal status in the USA. I don't think you will have any problem unless your H1B extension gets denied.

Keep in mind that PNP nomination takes between 2 and 4 months. In my experience since I started contact with PNP office until I got nominated it past 5 Months.

HI,
I came to US on F1 VISA. After finishing MS .I have changed my status to H1b visa and working from past 1 year.My passport still has the f1 visa stamp. Because i did not travelled out of the country from the time my h1 status started.

My question is .I know i am eligilbe to apply through ANIP.But does the AINP asks me to get my passport stamped with H1B visa Or the i 797 form will do.

Sukhminder - I do not think the BC or Manitoba PNP allows you to apply unless you have a job offer from a company there, correct? I too am on H1-B for the last 3 years, and looking at the AINP option now.

I wish BC was that easy! :)

There are various categories under which a person can apply for PNP, and not all of them require job offer in my humble opinion.There are 6 different assessment streams under Manitoba Skilled Worker PNP.e.g.

BC PNP Skilled Worker
British Columbia Skilled Worker PNP has basically two main categories: Skilled Worker/Strategic Occupations and International Students.

But yes its only Alberta who came up for H1B rescue..:)

Yeah, I checked those out....nothing that lets you conveniently apply without an offer letter or "close connection" with the province already. BC requires a job offer and does not offer a strategic initiative for open applicants.

I think at this time AINP is the best bet - I just hope they don't decide to scrap that program before I have a chance to apply! :(

When I applied to PNP H1B stream the first thing they asked me to send was evidence of my H1B status. In the letter they sent to me it was stated that I had send copies either I94 or I797A or copy of visa in Passport and copies of the pages with the stamp of the the last arrival to the USA.

I am putting together the application to Alberta under AINP since I will be in US on H1B visa starting March, 09. I actually worked in US before as an electrical engineer until May, 08 (the 6th year of my H1B). I then went back to Malaysia. Since my PERM has been pending for more than 1 year, I am able to get the H1 Extension, starting March, 09. In this case, would I be qualified for AINP since I used to work in US for more than 1 year? I also saw that the AINP require the reference letters from all my employers. Could anybody please help me with the reference letter format since I have no idea what has to be in the letter? Please advise if I also need to get the reference letter from my US employer that will start in March, 09. Also, I saw that CIC requires the State Clearance for all the places we stay more than 6 months. Please advise if this State Clearance needs to be Fingerprint Base or Name Base. Also, I wonder if I can send the application to Alberta first upon arriving US in March. 09 and send my first paystub to Alberta later on (probably March 15, 09 or March 31, 09 paystubs). Anybody please help. Thank you very much.
