Hi el90,

You are very close to your I-140 approval. As they moved the processing date to Aug 2006 and you are just 2 more weeks to go for 140 approval. Please update us, did you get any LUD on your case?

Thanks. ND is what you should be working against. Mailed the apps on 6th Sep overnight. Rcvd on 7th Sep. Notice issued on 7th Sep. My LINs were 062 and 070. Yours should be round the corner.

I appreciate your concern, but frequent "Is it done yet?" comment on every available EB1C trackers does not help anyone. No hard feelings, but I am tracking same EB1C cases that you are and it fills up my inbox w/o any effective use.

Trust ppl to update their tracker in timely fashion.

More evidence requested about managerial capacity with indian subsidiery. % of maangerial duties, # of reports, hire/fire authority etc.

Lawyer/HR did expect a tough RFE because of my H1B visa status.

I got similar RFE for my I-140, its one page with about requests for India and USA Org Charts with immediate supervisor and subordinates duties, % managerial duties, Date of Promotion, earlier USCIS petitions and more surprisingly W2's of subordinates. Now, who in the hell will share their W2's with their manager? Totally privacy intrusion, I would say.

Looks like, its the reason USCIS want to deny the application. They only gave 30 calendar days from date of RFE to reply of RFE.

Any one, Any ideas how we can counter this kind of RFE?

Looks like we are sailing in same boat in rough waters!!

Same RFE. have to respond within 30 days.

Are you also on H1B?

Well, I am bit more optimistic. My RFE is ad verbatim to what my colleague rcvd 3 mths ago. He has his GC now.

So take heart.

Hi el9o/Just Green,

I agreed with both of you. I do have H1b visa and my company has filed in Eb1c and my 140 got approved without an RFE on 08/15/07. You can see that mine and justgreen notice dates are same. So, visa is not a factor at all so don't worry about your visa status either H1b/L1a visa, it doesn't matter at all. They need more details and evidence to qualify for Eb1c. See, since all of our eb1c cases are getting RFE I am also expecting and RFE on my 485. Not sure at this time, god only knows. Be cool and try to send the details what they have asked for. I am sure that, we should get our GC before early next year. Good luck.

My RFE reply date was 16Sep07 (similar to your RFE reply date), yet no updates from NSC.

Hope to get some update before 16Nov07...

Looking back i think EB1 is abs fast track. We all got delayed b'coz premium proc was on for other categories from sept'06 until june '07. Once that hurdle was clear, it was a breeze ..

Congrats, el9o. I sent my second RFE on 10/09 and got two LUDs after that but no updates at all. Do you have any idea what's going on. I think I am struck in name check but not sure....really confused.

Thankfully, my 485 came almost back-2-back with 140 so, i'd think processing was already complete awaiting 140 approval.
