Don't know what the RFE is about, just got an email from USCIS regarding the RFE. Is it normal that I485 is being processed even before I140 is approved?

I think it's a good thing at least you know they are touching your case. Hopefully they'll recieve your response for the rfe and then they approve your case. Good luck

Details of RFE:

Immigration is asking for proof that I registered in the National Security Entry-Exit Registration System (NSEERS) as well as a good clear copy of all pages in the passport with any stamps/notations on it and a copy of the I-94 card, front and back.

Did you need to provide anything else other than copies of stamped passport showing NSEERS entry-exit? I wonder how come USCIS doesn't have records for NSEERS. Did you travel a lot under NSEERS?

Well as a matter of fact, I have never gone out of US since I came in :) so no travelling at all. So not sure why they didn't have any records for NSEERS. I didn't see the RFE letter myself by my lawyer told me that all USCIS wanted was the proof of NSEERS and photocopies of all pages in my passport.

USCIS received the response today and the status says that I should expect a result in 60 days. Not sure how valid that time estimation will be!

Hi safdar77, when you received the RFE related to the NSEERS issue, was it posted under your I-131 form? My friend just got an RFE yesterday under his I-131 and is in the same situation as your where he never left the US after the first NSEERS registration.

Additionally, congrats on your I-140 approval. Did you apply for an EAD?

Hi Internizzi,

I did not apply for either EAD or AP. The RFE was on I-485. We have mailed the NSEERS proof as well as all the pages from all of my passports including old visas as they required "all" pages from all passports.

Do you know if there is a way to find out if the name and background checks have been done?

Lets see how it goes now.

Aap ka case insah Allah Jaldi final ho jai ga.
TX has the best track record for updated processing.
Regarding Pakistan origin and background check, agar \"Lakkarr\" lagi to koi LUD nahin ho ga, agar nahin lagi to 3-6 months main ho jana chahiyay.

I know of Pakistanis who have actually filed lawsuit alleging DHS of negligence, once their case were late for one year beyond the published processing time for that center.

My other friend has same situation but has not filed a suit yet. He got a letter from USCIS stating that his name check is not clear yet and he should wait \"6 more months\" before contacting the USCIS for update !!

Mine case is very similar to yours............no LUD after approval of I-140. I am also from Pak.........took an info pass last week and was told that my namecahek is still pending............Prayers and hope for teh best.

I am actually also considering taking an infopass to figure out where does my case stand but I was not sure if they would tell me about name check and stuff but looking at ur post it seems like they do tell you the status.

So I might take the infopass. I am also hoping to get through this process soon inshAllah. Lets hope for the best and May Allah bless us all :)

How long does it take at the infopass appointment. Did you go to the Atlanta office?

It appears all Pakistan applications are PARKED somewhere.
No updates....I called and I was told it is taking 4-6 months for even the EAD !!
I think everything is deadlocked since they filled their H1B quota of about 60000 applicants in one day...somebody has to work on those.

I am going for an infopass tomorrow. Do they tell right away if the case has been stuck because of name check? I just dont want to drive all they way up there to find out the same info as I already have on the case status page :)

Everyone I talked to recommended going for infopass regardless.
My EAD application is more than 90 days old without any updates.
I have an appt for May 18 in Philadelphia.

Yes I am just hoping to hear that name check has been cleared. Its so strange that people who applied months after me are getting the approvals and I haven't had an LUD in over 3 months.

Lets see what happens tomorrow. I will keep you posted.

BTW...when I made an appointment I selected "speak to immigration officer" and not "question about my case". Does it make a difference?

Hello and AOA

First of all I want to wish you all good luck. I am in the same boat as you all are.

Filed my case concurrently in Nebraska center in June 2006. Got EAD and AP all done by August 2006. Got I-140 approval in December 2006. Last update on I-485 was on Jan 2, 2007. Since then its dead stop. No RFE, no updates.
Did a service center request thru customer service 800 number. Got a response back saying "awaiting assignment to an officer". I have asked multiple people what does that mean? Am I done with back ground check, etc etc. No one can give me clear answer.

I have infopass appointment on Friday. I have heard immigration officers at infopass are useless, they don’t know any thing and they don’t give any kind of clear answer. But in any case I will still go and ask the same question. What does it mean "awaiting assignment to an officer". What is happening with my case.
Lets hope for the best.

Yesterday I counted all the Pakistani on trackit, who are in EB2 category. I was able to find 20 Pakistani. 18 cases are still pending. Only two Pakistani have received 485 approval. One from Texas and one from Nebraska. According to trackit, i am the oldest one waiting since June 2006, almost 11 months.

Sorry to hear that.

I went for Infopass a couple of weeks ago, the officer just told me that they've recd everything from FBI and the case is in pre-adjudicating stage. I am not sure if the name check is cleared or not.

Did you specifically ask the officer about the name check?

Yes, I did ask specifically about the name check and the officer said that its pending. I am not sure now how long will it take to get that approved.

I know its not great that your file is stuck in Name check but its good at least you found that out where you file is stuck.
Previously I had heard from other people that they went for Infopass and the appointment was useless. Immigration officers were not giving any information out.
I am going for infopass tomorrow. Lets hope for the best. I hope my immigration officers is also as nice as yours and he / she provides me some details if not all the details.

Please help me understand better what you are asking for. I am a bit confused.
As I understand, if you are in EB2 category. There is no retrogression for Pakistan. That means any time your back ground check / name check is done and your files gets to an USCIS officer desk. He / She can adjudicate / approve your case then and there. This is how I understand the process
May be I am wrong?
Even though we are in EB2 and there is no retrogression for Pakistan and file is at USCIS offices desk. Does the USCIS officer needs a visa number to adjudicate / approve our applications?
When do visas become open? October of every year? How many Visas are there for EB2 Pakistan category?

Your fear is correct. Any thing can happen any day. That’s the fear we all live with every day. You are not done until you are done (GC in hand). We as applicants can't do anything.
I am just so sad and mad that this GC process has become art work and luck, where as in reality it should be science (very predictable and calculate able)
Let’s just hope for the best. Your chances of GC before me are brighter because Texas has a better track record then Nebraska.

InfoPass appt 5/18/2007. I was told that the both my I-765 and 485 process has been placed on HOLD, although name check is done . Advised to contact Nebraska. Wish me Goodluck with that !!
Does it help to write the senator?
Should I expect an RFE ?? No RFE whatsoever so far.

Did they tell you why was being placed on hold. Yes I think contacting a senator would sure help if your application is being held for no reason.

On the bright side, atleast your name check is cleared. Good to know a Pakistani is cleared :)

Any updates?

Need ur help. I have rec'd response Letter from USCIS regarding my status inquiry. It says "Your I-140 is on hold for a visa from State Dept. (??)...That has delayed your 485/765. Contact State Department visa line.

I am surprised.... My I-140 is already approved by PP in 3 days of submission !!...I've approval notice. Morover, I am from Pakistan, which is not a retrogression category country.

Do You understand what that means ??

Are you on J-visa? I have heard that in some cases they require State department Visa waiver or something like that. I may be completely wrong but this is all i can think of.

I got an LUD on a Sunday on my already approved I 40 6 months after the approval. Does anyone have a clue why did this happen?
