I-485 RFE was about the following things. Documents requested from Company: 1. PERM filed through company A, Company A merged with Company B, Company B filed I-485, USCIS wanted to get the assett purchase or company merger on legal documents from Company B. Company B already took care of this and sent the response back to the lawyer. Documents requested from me: 2. Birth Certificate's translation didn't had my mother's name. They wanted to see original + other documents that are helpful. 3. I belong to 4 alumni associations, 2 are from US and 2 are from Pakistan. They wanted to see the nature and some documents from those alumni associations. Guys, don't even put that in your 485 forms that you belong to any professional orgranizations. 4. Copies of all pages of expired passports. 5. Recent MS-degree transcripts 6. Recent EAD card copy 7. 2007 Income tax returns, W2, and first and last paystubs from Company A and Company B in 2007 and 2008. My lawyer has submitted the RFE response on 05/06/2008. In Pakistan, the government can issue a family certificate and I got that and included in the RFE. Alumni Association RFE Part 3(c) of the I-485 application asks if you have any affiliation with professional or political organizations. I am a member of IEEE, Pakistan Engineerig Council, 2 alumni associations from my colleges in Pakistan and two from US. Its good that you have prepared yourself for the birth certificate RFE :) Best of luck and collect as many other documents as possible. ======================================= The exact wording on the RFE regarding birth certificate is the following and it seems like a generic boilerplate for all birth certificate RFEs: ======================================= RFE States: 2. You either failed to submit any evidence to establish your name at birth, your date of birth, or your birth parents' names; or the evidence you submit is unacceptable because it is a copy of: a) an English language translation absent a copy of the foreign document from which the translation was made; b) a "short form" birth certificate which fails to name you, and/or both of your parents; c) a consular or embassy letter, attesting to your birth; d) an incomplete, or illegible birth certificate and/or adoption decree; e) an affidavit, or copies of affidavits, and/or one or more original affidavits without a government issued statement of non-availability. Note: Neither your birth certificate nor copies of pages that you submit from your passport name your biological mother. Please submit a complete, legible copy of your birth certificate, registered with civil authorities. Alternatively, you may submit a Government issued statement of non-availability AND copies of one or more of the following documents: a) a Government issued identity document, such as your passport's biographic page and the page that names your parent(s). b) a Hospital and/or religious record of your birth which names you and your birth parent(s). c) a School record that names you and your birth parent(s). Secondary evidence should also be accompanied by at least two ORIGINAL affidavits made by persons who can make credible testimony concerning your birth and parentage. Persons whose testimony is considered to be credible are relatives who were residing in the place of your birth at the time of your birth. Their affidavits must name you and specify your date and place of birth, name both of your birth parents, name the affiant and specify their date of birth, specify the affiant's relationship to you and/or your parent(s), specify the affiant's place of residence at the time of your birth, and include the affiant's current address. If any document is a foreign language, then you must also submit an English language translation. ========================== Hope it helps Did you get yours???

My lawyer has not received the RFE yet. I will update you once I'll get it. Last RFE was about a missing signature on the medical form. Looks like the second RFE would be something to do with medical. Either re-sign it or redo the whole medical (my guess). Let's see. Rana, did u recieve the RFE on ur wife's case?

I got the RFE on my wife's I-485. It was regarding her birth certificate. Apparently, she had no last name on her birth certificate. Her parents and uncle prepared affidavits along with any documents that we could gather that shows her name and her parents name and we are going to send it to USCIS once I collect all documents. In the meanwhile, her EAD and Advance Parole renewals got approved and were filed two weeks ago. Both documents are valid only for 1 more year. A few threads were talking about EAD renewals for 2 years. Thanks for asking and I'll keep you posted :) Rana,

Yes, I did apply for I-485 for my spouse and she got 1st RFE in March (signature missing on medical report). After 60 days, I called USCIS to inquire and they issued another RFE on her birth certificate (last name missing). I have responded back to the RFE last week and since then, there has been a soft LUD almost every second day on her case. Once I am approved, she'll get approved too some day. I did renewed her EAD and AP and I got those in 15 days. Thankyou very much for your response.

What documents you submitted for RFE on birth certrificate. As I can see from ur posts that you submitted affidavits and family link certificate but did you submit secondary school certificate too? For my spouse's second I-485 RFE on birth certificate, I submitted the following documents: 1. Affidavits from her father, mother and uncle signed by them + notary public including their names, date of births & ID card numbers 2. Attested and translated copies of their ID cards + notarized 3. Notarized copies of all her educational credentials that shows her name + her father's name Thanks I appreciate your response.

I need your help please,advice me how to proceed. MY attorney mailed my response to RFE on my I-485 case. ,sent on 7/15by FEDX recvd on 7/21 and signed by someone there but till today no updates on my case.I read ur case details and noticed that you resubmitted the response.Please guide me: 1.Do you think I should wait for few more days? If the FedEx receipt shows that the documents were received and signed by someone, that should be enough and you can just wait and usually it takes time. With my case, I had no patience, so I bugged the heck out of my lawyer by saying that the documents must have been misplaced, so she needs to send the duplicate and after talking to one of the VPs of my company, I was able to convince my lawyer to resend the documents and I saw an LUD the very next day. It really made me sleep good at night. If you are like me and dont like to wait and can't sleep tight, do this: 1. Take an infopass appointment and take all the copies of your documents and write "Duplicate" on each page and sign & date it yourself. Speak to an IIO (Immigration Information Officer) and hand those documents to him/her personally. But, don't tell your lawyer about the infopass appointment. Because, when I told my lawyer that I need to make an infopass appointment, she said that in that case she won't represent me as a lawyer, there was some legal agreements b/w our company and law firm. But, I did go for info pass one time (not to submit my documents, but just to go and see if my name check has been cleared after I got my GC) 2. The second option is to force your lawyer to re-submit the "Duplicate" and attach the FedEx receipt along with your documents. If you have already made your mind to resend the documents, there is no point to wait. FYI: I had made copies of all documents of affidavits and had them notarized before I sent. I got RFE on my wife's AOS, mine is already approved. I requested from family members in Pak. and received the certificate from NADRA which is completely in English but additionally it lists the names in Urdu next to their English version, did you run into any issue because of that? I'm assuming that I don't need to translate it just because of the names being in Urdu in addition to being in English? Hi harapata,
sorry to reply late. I was out of town. Mine is approved too and got RFE for my spouse for birth certificate. It has her first name only. I used affidavits from her parents and family members and included her college and university degrees and certificates that has her parent's name. Now, if you got the NADRA certificate, its good that it has both Urdu and English names. You really don't need to translate it, but just for some extra buttering, have it attested. Best of luck
