Oh nice, another FB1 here. Can I ask you when you filed an affidavit of support? I've read somewhere that national benefits center sends it out approximately 9 months before the priority date becomes current along with an agent form. Was that the case for you?
What other documents did you have to include with your adjustment of status application? Anything from your home country, like police clearance certificates?

I filed I-864 at the same time with my I-485. My case is a bit different, since my I-130 was filed in 2000 when my dad was a permanent resident. After he became USC this year, I, consequently, became eligible to file for AOS. Therefore, I just sent out the whole slew of paperwork at the same time (I-485, I-131, I-864, I-693, I-765). As for the police clearance certificate, I don't think that it is required for AOS. However, as far as I know, police certificates are required if you apply through your consulate in your home country.

Hi jn, thank you for a quick response. My mother also filed for me when she was a permanent resident and became a citizen this year but my priority date is still not current (Nov 2002) even under FB1. I wonder how long it takes to get the actual card...

It seems the cut-off date on visa bulletin goes forward one month every month, so your visa number, probably, will be available in 9 months (the current cut-off date for Jan 2008 is Feb 2002). As for how long it would take, I don't think that anybody can give you the exact time frame, since it varies from case to case. Considering factors such as name check, processing delay, some cases may drag on for several years. Anyhow, good luck to us both! :)

Hi I have one more question for you: Was your approved I130/file ever transferred to national visa center? My file was transferred to NVC after approval and now I am finding out that some people who plan to adjust have their file stay with USCIS. Do you know if every I130 application gets transferred to NVC and what was your situation since you filed AOS?

Hi Mermaid,
As far as I know, if you had already legally resided in the US at the time you submitted I-130, USCIS will not forward your case to the NVC once it is approved (unless you specifically stated in your application that you would want to go for consular processing). So, to answer your question, my files were never transferred to NVC - they, in fact, stayed at Vermont Service Center where the original I-130 had been filed. When I applied for AOS, I just sent all documents to the Chicago lockbox and Chicago then routed each applications to appropriate departments.

Hi there, I see after 6 months your application is still not approved. Do you know if are now eligible to get GC anyway since you were pending for more than 180 days? Have you gone to your district office to find out if you are stuck in namecheck?

Can you please share when exactly you got EAD and AP? Was it 2 months after receipt of I485?

I don't know if you've following, but FB1 only moved one month in the past 6 months. This is just so sad....

The 180 day rule is actually applicable for name check pending. For my case, although I don't really know the status of my name check, the case probably will take a bit longer, since I live in Northern Virginia which is under Washington DC local district office. Currently, they only process case up to April 15, 2007. When I called them, all they said was just that the local office hadn't scheduled the interview for me yet due to its backlogs. I applied in november 2007, so I guess I still have to wait approximately another 6 months or so.
As for EAD and AP, I did received them after three months.
BTW, what is your local district office?

I am also FB-1 and will apply for AOS on October 1 when my date is current. Congrats on getting your card!! Can I ask what the interview was like and the questions that were asked and if petitioner had to come and what petitioner was asked. I am just getting ready I think that 6-9 months is the norm for FB-1 applicants to get interview and green card. I can't wait to apply!! Would love to hear about your experience and when you had your interview and how you found out that your name check cleared. Thanks JN!!! and congrats again!

Hi Teacup,
It was quite pleasant actually. The officer mainly just doublechecked all the information I had submitted. She only asked the most current tax return of the co-sponsor. The whole interview took about 30 mins. Most of the questions were just for verifying and confirming my eligibility - my relationship with the co-sponsor, whether I came to the US legally, whether I had committed any crime or been arrested for whatever reason anywhere, etc. I had prepared most of the necessary paperwork that I could obtain and that could establish my eligibility. However, as mentioned above, the officer only asked for the most current tax return of my co-sponsor and her W-2.
As for the petitioner, he or she doesn't have to be at the interview if it's not a marriage-based case, but I would think it's best if you can take him or her with you.
For the name check, I only found out when I asked the officer at the interview.... It took a little bit longer than usual since I have a very common last name.
I received my GC only a week after the interview.

Hi teacup,
My interview was scheduled on Sept 6. I applied in November 2007, so it took around 9 month'ish. According to the proccessing time line, DC local district office is the slowest in comparison to other district offices.

Yes, I got the notice around a month before the interview date, so it should be in August.

I wanted to update you and let you know that i have my AOS interview next month! Did your IO want to see your birth cert? petitioner's birth cert? petitioner's US passport? or was it only petitioner's tax documents?
Do you also know if the IO had your original I-130 application with him as well?

Congratulations! I'm happy for you. Yes, you should have your birth certificate, the petitioner's birth certificate, the petitioner's US passport and/or certificate of naturalization, the most current tax documents available. When you are there, present each document only when asked. As far as I know, the IO only have I-485.

Did the IO ask to see all of these from you (i.e. birth certificates of you and petitioner)?

My petitioner doesn't have a birth certificate and my birth cert is in petitioner's maiden name. Did you have the same issue? My I-130 was approved though.

The IO would want to establish eligibility through the relationship between you and the petittioner. You should have all documents that can prove that relationship. I had all two docs with me at the interview. If possible, go to the interview with your petitioner (although it's only required in marriage-based cases.)
