I was about to file I140 using premium processing,but my attorney says we can not do that until we are allowed to do so. I assume it has something to do with things that are going on with USCIS.

That's right. PP of 140 is suspended for three months. I guess that the USCIS was expecting a flood of labor substitutions and 140s due to the facts that dates were made current. Anyway, you can still file 140 regular and that should be fine.
