Jag bor i USA sedan 6 ar tillbaka, ansokt om ett green card men fich ett avslag pga att min svenska Chalmers Master degree inte ansags jamforbar med en US master degree? Detta avslag ar tydligen mycket ovanlig och jag undrar sedan du ocksa har en masters vilka betyg och utvardering/motivering som ni skickade in? Grundskola, gymnasium betyg? Jamforelse sverige - usa utbildningssystem?

Efter LC ansokan ar bifallen, ar det viktigt att din utbildning matchar din LC. Sa aven om BS+5 racker for EB2 kan du inte anvanda detta om din LC sager MS och inte MS or BS + 5. Anyway, din MS fran Chalmers ska vara tillracklig, allt du behover ar en Degree evaluation som visar detta. Jag anvande thedegreepeople.com och fick en mycket professionel utvardering av min svenska Fil Kand, som behandlar det svenska utbildnings systemet, antagnings processen, varfor examen ar motsvarande samt kvalifikationerna for utvarderaren. Jag vet inte hur du fick din examen utvarderad tidigare, men en bra och professionel utvardering ar viktig. Om du har mer fragor kan du ringa mig pa: tre noll tre tre tva atta fem ett six atta (MT).

Posted by Europeanswede on 06 Apr 2007Tack for informationen, min LC sager MS. Mina tidigare utvarderingar var inte sa omfattande, behover nog en expert utvardering. Jag kommer att ansoka igen snart, skall bara hitta mina 20 ar gamla betyg och fa dem oversatta till engelska...

Om den ar pa Engelska kan du skicka en elektronsik kopia direkt till thedegreepeople.com sa ordnar dom en professionell utvardering som USCIS blir nojda med, om inte tror jag dom kan ordna oversattning ocksa.

1. A friend of mine got his I-140 approved with company A
2. Left company A on good terms, due to an economic downturn, now with comapny B
3. He has now filed his I-485 using his I-140 approval from company A.
4. Company A, provided an employment letter stating "job will be available upon approval of his GC, provided an appropriate position is open"
5. In your opinion will this create a red flag & generate an RFE on the validity of the job at company A? Should company A change the wording of this letter to avaoid questions?

Posted by MrVulcan on 25 Jun 2007My laymans opinion would be to remove "provided an appropriate position is open". I think that is a definite red flag. I would think that with that wording he would get a RFE about whether or not a position is available when it is time for adjudication, and if the answer is no, the 485 application would be denied. He could get an RFE anyway though. Of course if the application would be pending for 180 days or mor, he would be eligible for AC21 as far as I understand it. I think it would be good for him to talk to an experienced lawyer, preferably before he files.

1) You mentioned that you applied under the EB2 category ? what were your educational qualification and work exp like ?
2) Did you apply via a lawyer from the chicago land area? IF so could you provide contact details for the same ?
3) Did the fact that you were Swedish attribute to a quicker processing , as far as i understand that the visa numbers are more for that country ?

2) No, I used Stern, Elkind, Curray & Alterman (www.secimmigration.com) in the Denver area. There are only two PERM processing centers, Chicago and Atlanta.

The question you need to ask is does the position require a masters degree or alternatively a bachelors plus five years experience? http://www.flcdatacenter.com can give some guidance. For instance Software engineer 15-1031 requires a bachelors degree, but if the position is level 2/3 or higher, it should be fien for EB2.
The education you have is sufficient for a EB2 position as long as it is in a relavant field (Software Engineer OK, Mechanical Engineer NOK)

Posted by tallguy on 12 Dec 2008I work as an IT analyst right now(C# programming ,issue analysis and troubleshooting).I hope that within 2 years when the Company begins the GC process , I would have risen to a Senior IT analyst.
