My case is quite complicated. I was due for extension on 1 July 2008. I applied through a consultant on 24 May 2008. He filed in the wrong fee. The Home Office acknowledged the receipt of the fee as being correct and assigned a reference number. After 8 weeks, i.e., 2 weeks after the expiry of my leave, the Home Office returned the documents saying that the fee was incorrect and that I should apply again. The consultant received the documents and never told me that the application has been returned but only that the Home Office is asking for more fees. He returned the same application form (instead of making a fresh application) to the Home Office with the correct fees. This time, the Home Office returned the application directly to me saying that the forms had changed in between and the forms that the consultant had filed were no longer valid.

I fired the consultant and filed an out of time application to the Home Office requesting their discretion (on their advice). Also I have had to quit my job (again on their advice). I shall be grateful for any comments on the situation.

Hi,
As per my understanding, your application should go through fine even if you have not used the FLR Tier1 (HSMP) form used for judicial review cases. If you fall under the judicial review and have applied for an extension using the Tier 1 (General) further leave form, you application will still be assessed under the highly skilled migrant criteria that were in place before 7th Nov 2006.
Although from what i have observed, the processing time for applicants who have used the Tier 1 (General) FLR form is more compared to people who have used the judicial review FLR(HSMP) form. I think you should hear from the home office in about 6-7 weeks time.All the best!!

Dear All,

I finally got my passport with Tier-1 visa today. My time lines are,

applied - 22 Aug
received at HO - 26 Aug
ref dated - 26 Aug
case assigned to case worker - 23 Sept,
approval letter dated - 23 Sept,
visas issued - 23 Sept
documents posted by HO - 10 Oct
documents received - 13 Oct.

Number of dependants - 4

As I am a pre-Nov 2006 HSMP participant, my case was decided on the JR judgement even though I applied on a Tier - 1 form, fulfilled all the requirements and had 120 points. But I am happy for this to end successfully which ever way.

I dont know why did it take the HO so long to post the visas.

I am grateful to every one here for their kind support and guidance through out.
