Hi, you can apply for Interim EAD if you have got a job offer. You need to go to local CIS office and describe you case to them. Have you received any mail requesting additional evidence from USCIS ? If you have not got any response from USCIS within 90 days from the date of you application and you have got any job offer, then u can get Interim EAD. Please let me know if u need more details about it.

Hi, my I-797 was posted but i never recived it.I didnt receive the biometrics appnt also.For that i have called the NSc cust.ser and logged request.I have not recieved them till dt. On mar 3rd i received a letter asking me to send support documents.I have send all the documents(except I-797). After the specified 90 days, i took an infopass apointment to get an interim Ead.The officer told me that my Case is denied as i have not submitted i-797.I told the off that i havent recd thedoc.The off suggested me to contact VSC . i wrote a letter to VSC and it has been more than 20 days.Please send me details about the interim EAD.

to add to that, the status of my case still shows that they have recd proof docs and is pending.

Hi, in my case i received my I-797 (acknoledgement for my application) in mid december. However, I did not get any response from USCIS till 26th March. Since 90 days were over from the date I filed my application, I visited local CIS at SFO in the first week of March to apply for interim EAD. But I was told that interim EAD is not issued anymore. I then waited for some more days and I could not find anything happening with my case. I then faxed a request letter to expedite my process to California service center with all the supporting documents like job offer letter, my I-797 etc. On 26th March USCIS sent a letter for requesting additional evidence. I sent all the required document to them and they received it on 23rd April. I checked the USCIS site yesterday and I found a useful document which tells that USCIS still issues interim EAD but the process of issuing it has changed. You can find that document at http://www.uscis.gov/files/pressrelease/ElimI688B_081806R.pdf OR just search "Interim EAD" on the USCIS site. I have now shifted to WA and visited local USCIS office today to check if anything can be done to get the interim EAD as given in the document and it worked. Immigration officer considered my case for interim EAD when I showed him my offer letter. Let me know if u need anything.
