Topic: Country quotas...?
If this board is a representative sample of the LC applications, then there is a disproportionate number of applications from certain countries...this is what's overloading the system by droves. I think each country should have a quota, not a free-for-all. Just like Bill Gates shouldn't be able to have 21,000 H-1B applications for Microsoft in a given year, countries shouldn't dominate and deplete the precious few quota numbers...Why wouldn't this make sense?
Please be objective (especially those that are overloading the system) with your arguments for or against.

As much as I respect your take on the subject, I disagree with the most of what you have posted above. I could totally see where you are coming from on this one, after reading through your profile and other comments that you posted else where on this forum.
Firstly, 'quota' system is the least popular way of alloting green cards. To me, it just sounds as if the USCIS is saying "I can't find a better way of doing things, let me go with quota". It just creates a bottle-neck for thousands of people from some countries... mate you have no Idea what these people have to go through in their lives.
I sincerely think that USCIS is to be blamed for all the mess. Because when it allots so many H1-Bs every year, it must be in a position to 'clear'/Streamline GC numbers to the same extent. Most, if not all H1-Bs will apply for GC at some point and USCIS is very much aware of it. Why does it create a 'hope' for millions of people by bringing them on H1-B when it cannot 'support' the GC line. H1-Bs are not 'Use & Throw' Visas, most want to settle here for good. 'Quota' system kills the objective. We'll take up the Bill Gates' one on the next post...:)

Man this H1B thing is for USA okay? So stop blaming Microsoft or any other American companies. American companies have every right to do whatever they want. You people dont have any work or what? Go and do some good work at ur office and stop discussing issues that you and me cannot change.

On the H-1B issue, take a step back. There are many multi-billion dollar corps in the US that need H-1B - based talent, I can understand that. However, if they each applied for 10K or 20K H-1B's what do you think would happen, do the math.
Here's my take. IF there is a GC and H-1B quota, then there perhaps should be country or company quotas (ie. 500 H-1b's per large company, etc.)...I'm actually a believer that there should be no quotas whatsoever, and that if an individual with merit and talent gets through the screens, then that individual should have the opportunity to work, live and prosper permanently in the US. Unfortunately, in the current regime, those of us who are in the under-represented geographies have to wait in a communal line that is HEAVILY dominated by one country.

I want the members that are reading this thread to understand that I'm not trying to start a fire. I am posing a legitimate discussion that many of my peers share regarding this situation. There is undeniably bias from each member, in favor of a quota for under-represented geographies, and those that are not in favor which are of course from over-represented geographies. I assume this is an open forum where we can communicate with respect and objectivity.

You cannot start a fire with this argument dude. Your argument sounds more like. I want a quota just for me.
It is up to the companies hiring the H1B to decide who is talented and who is not. H1 B visas are for overcoming the shortage of talent in US. Why should they discriminate who to give and who not to give based on the geography( it is not the matter of citizenship). Under represented countries anyways enjoy their quota in GC. I guess I would like to argue the other way and eliminate quota system for GC as well. We are in the queue for employment based H1B or GCs. over representation here means over talented dude.
I guess your argument will stand a chance in the asylum or refugee based GC queue.

I completely agree with you that any country which wants to prosper technology wise should have the capability of attracting and keeping the good intellectuals. The moment USA close the doors for Highly Skilled workers then its hard for US to mantain as the leader in innovation.

fight together for the unlimited quotas for any qualified applicant. Nothing impossible here. Citizens are same with us to this land. The only difference is that their grandparents or grand-grandparents came a little bit earlier than us. This land belongs to the world, no matter where you come from.

...so there should not be any 'quota' or limitiations on any country for GC processing. I strongly feel that USCIS should balance the H1-B and GC numbers so that there are no backlogs. If Microsoft with it's $50b annual revenue needs 21K H1Bs then MS should GET them...provided there is a long term plan for the so hired H1-Bs, like managing GC queues efficiently etc to accommodate their future demands. Plan upfront and not 'let's cross the bridge as we get there...'

GCnow, First of all let me make it clear that we are all NOT against diversity. But we have difference of opinion on where that 'diversity principle' should be applied.
We have quotas in GC lottery and Family based visas and it can be justified, of course. But why on employment based GC? An employment should be based on the individual's educational qualifications and professional talents. NOT his country of birth. Is it not?
When an employer hires you, he is not supposed to make the hiring decision based on any of the discriminating factors. Then why should that factor play a role when the employer wants to retain the employee for a longer time?

This article gives you a list of the companies that used the H1B for fiscal year 2006. Microsoft used 3117 visa numbers.
Also I believe 10 - 15 % of employees at Redmond are Canadians. The last I heard Microsoft was opening a software development centre in Vancouver,Canada.
As far your country quota theory goes - at the turn of the century America let everyone in who was willing to work hard.
If you are going to ignore contributions by Indian and Chinese community, it wouldn't be fair.
