Topic: PERM Application Processing Update as of 07/15/2008

The following are the reports from the OFLC in the DOL Stakeholders Meeting of 07/15/2008.

The current processing times are as follows:

Clean cases: PD of April 2008 and soon to advance to May 2008. Approximately 70% of all cases are decided within 60 days to 90 days, but 120 days are considered the cut-off date.

Cases in audit: PD of March 2007. They are processed in the order of priority date, and all audit cases are worked in priroty date order. People should be patient once case is audited.

Cases of supervised recruitment: There are 50 cases. These cases are handled by the national office in DC and not NPC until the end of 2008. No processing time information is available.

OFLC has been recruiting contractor service bids. It is expected that the NPC staff will include two-thirds by contractors and one-third by government employees.

Thanks for this information.

Atlanta center shoud shame to talk about "patient". There is a big backlog in Fall and Winter 2007. I begin to worry if 15 month will become 24 month in the future. Did you guys notice that they didn't even talk about cut-off date for those audit cases? They are reluctant to give commitment.

What do we do?

We can bet it will. They should give those whose PERM were audited automatic I-140 premium processing. Oh well we can dream on but they don't give a d*mn, have never and will never.

Thanks This info is useful.

At least they acknowledge that there are some people (less fortunate ) like us still stuck in audit.

By the way any guess on COUNT of all such cases from March 2007 till date ?

It looks like there are three queues for Audit cases.

1. Fragomen
2. appealed cases after denial
3. others.

For those of us who are in "others" queue, it seems like DOL starts process the
cases with PD of May.

If your PD is earlier and you are "others" category,
you should ask you lawyer to contact DOL for inquery.

If your lawyer don't response to you (my previous company's lawyer never did),
then you can contact your congressman or senator.

As of 7/15 the PD for audit cases was March 2007 if it is May 2007 for now, their pace is about 2 month/month. So for me that my PD is Nov. 2007, I should be hopeful to get a response around end of this november.

There is an American Immigration Lawyers Association (AILA) meeting on 25 August in Chicago. One of the items on the agenda is an update from the DOL on processing times on audits etc. I will request my lawyer to enquire about waiting times etc. It would be helpful if more people from this board asked their lawyers to raise that question at the meeting as well. More interested lawyers raises the likliehood of the issue being addressed at the meeting.

Anyway the latest news from my lawyer is 15 months from the date of the original filing. Hopefully this will be accelerated somewhat in the near future.

Unfortunately, it doesn't appear to be a correct information. My PD is January 2007 and the application haven't been processed yet. I talked to my lawyer about that recently and he said that they aren't actually processing the dates they said they are.

My Attorney is suggesting me to refile. He thinks refilling might be quicker than getting approved with the current audit situation at this time. Also he fears that my case might be denied due to a small mistake that he made. Ask your Attorney on that option, if you care.

I would try to push lawer because, they anounced, that they work with audits according PD now, and current PD is March 2007, your are way over this border in my mind, I saw somewhere DOL link or email to let them now if your documents are earler then current PD

Technically you are right. But my Attorney said, if it takes long then they allow it and he has tried that for a few clients all got approved with out an audit.

Do you have to do the whole nine yards to reapply? What i mean is all that advertisement thing, etc.. or you can reapply based on your original case?

Everything from scratch. Infact my job titile has been changed. From Senior Software Engineer to Senior Software
Engineer, Project Lead which justifies my refilling.

Does anyone have any feedback from their lawyer in respect of the American Immigration Lawyers Association (AILA) meeting held yesterday, 25 August, in Chicago? Is there any change to the current 15+ month wait for audits? My lawyer is not responding to my questions about the meeting.
