Topic: Fragomen Audit? Any New Info?
My case was audit due to Fragomen. They told me 2 weeks ago that the audit has been released. Have not heard anything more. Any more info from anyone?

The release made me happy, because it said that all PERM apps will be processed by dates meaning that Audit apps pending for almost a year will be approved first before any new non-audit apps get approved.
But that does not seem to be the case, because those slow people are still processing recent non-audit cases along with audit cases at snail's pace. May be my interpretation of that release was wrong. Did anybody misinterpreted like I did?

I think there is a catch in what DOL announced...when DOL announced that it will release all the cases that are in audit ( and I mean Fragomen cases ! ) that only applies to Fragomen cases that went in to audit which Fragomen called as special audit... So only the cases which went in to special audit ( i believe any application filed after June 2008 ) will be released and return to it's normal processing queue. If an application is audited let's say July2007, then I don't think that was a special audit case and would still remain in normal audit queue...Please understand I'm not being mean here...but just trying to explain the fact the way I understood it..

will just pray that everything will be allright...we don't hear anything yet after that announcement. hopefully dol will expedite everything...=)

Well, my case was filed in July 07, has been in audit since Aug 07. Then, when DOL announced Fragomen special audit, we received a second audit in May/June 2008.
Now if DOL releases all Fragomen cases from special audit, my second audit will be removed. But first audit is still there. Even for the first audit, I see that July 2007 cases are being adjudicated (15 month theory).
Not sure when will this torture end for me :-(

My case was filed by Fragomen on June 20th last year. I got slammed by two audits and have not heard anything ever since.

Even mine is filed by Fragomen in last year september, then after got audited 2 times. Dont know when this torture gonna end...so far no Fragomen cas approved since DOL has announce that it will release all special audit cases.
If any body's case status has been changed from audit to process?

Pessimist in me says that nothing is being done. DOL's 17th Sept announcement didn't mention Fragomen and neither has Fragomen made any press release mentioning cancellation of special audits. We haven't had any approvals for Fragomen cases (at least by looking at trackitt which I agree is not exhaustive) nor have we heard anything about lawsuit.
But then who am I and why does my opinion matter :-D

How did you know your audit was released? We applied in Feb 2008 and got audited in april.Its been 6 months now and haven't heard a word.

As per my knowledge - So far nobody's case(Fragomen Law Firm audited cases) has been release or approved...
So far fragomen didn't do any press reale about releasing the cases from special audit.

There is no status like "IN AUDIT"...even though it is in audit it will show "IN PROCESS"

Spoke to my HR and there are nothing moving at DOL for any client of audited applications.
Dont know what DOL is doing....we might wait more time than expected bec...of Market, audits, Fragomen etc...

I see lot of panic in Fragomen clients as no single Fragomen client got approval/denial for their audited case....I think DOL is not doing anything for those cases and waiting for court's decision on the law suit filed by Fragomen against them. What do you guys say?

I think, if DOL did not want to start the processing of Fragomen cases, they would not have released an update on their website. Considering they have released the update, they must be starting to process those cases.

May be we got confused with that release note and it is not for the Fragomen cases but for the cases which were audited in bulk in Oct/Nov 2007 as you can see those cases are getting approvals.

That's what I thought as well. Sept 17th announcement does not say Fragomen anywhere but it refers to Aug 29th declaration which is related to on going Fragomen issue. Also Fragomen has not put any update on its website. Many other websites are reporting that Fragomen/DOL issue might have been resolved by Sept 17th announcement. Total confusion, Total mess..toying around with legal immigrant's lives

when i asked fragomen representive..they said they are not aware of any updates after sept 17, 2008
the only way we can know is by having HR ask fragomen..keep asking because it is fragomen's duty to
say something

Even my HR is asking Fragome about the status of my application, they are giving standard answer that the case is under process and all the special audited cases are released from audit queue...then after nothing new (this is what my HR got it)
so far not even single fragomen case is approved.....some of them are with April, May, June, July PD's....If the DOL releases all the special audited cases to normal, they should have approve or deny at least one case...that didnt happened so far...
As we all know that they will process as per the Filed date....
so sad to think about it.....

i am more pissed off at fragomen...i think it would have been honest if they could
say something out...its almost been a month and nothing from fragomen..

I am writing an email to Fragomen and setting up meeting with my manager and them. If they agree to meet, I am going to ask some really strong questions to them...2 years since LC process was started, 15 months since LC was filed and still no update..simply WTF

My Fragomen Lawyer sent me a note regarding my PERM. Its exactly showing below --

We have received some news from the DOL in connection with pending audits. The DOL has advised that they will be releasing applications from audit (i.e. adjudicating the applications) unless there is an issue that they feel requires further in-depth review. Previously, the DOL was keeping 100% of the filed cases in audit. This is good news and we should hear from the DOL as to which applications will be released within the next few months. We will continue to monitor your application and update you as soon as we hear from the DOL.
Please let me know if you have any questions or concerns throughout the immigration process.

September 17, 2008 The Department has been presented with evidence indicating that prior to its recent audits, many immigration attorneys believed that the Department's rule regarding consideration of U.S. workers did not apply to them unless they represented not only the employer seeking the labor certification, but also the alien for whom the certification was being sought. That interpretation is incorrect, as the Department's recently issued PERM program clarifying guidance makes clear. Nevertheless, the Department will apply the requirements of the consideration rule as interpreted by its recent guidance only to labor certification applications the recruitment for which was begun after August 29, 2008, the date on which the Department's final guidance was issued. All pending audits triggered exclusively by consideration rule concerns are therefore being released and will be processed in accordance with their original filing date.

I got this mail on 09/29/2008. She just sent this email right after our conversation over phone.
Just another addition, my Fragomen lawyer said... it may take Spring 2009 to get any news about the special audited cases. She was giving the reason of election... new government body... may be admin change.... etc etc..... But please keep asking your Fragomen lawyer.
N.B. She told me this info over our phone conversation but its not in the mail, what she sent me.

at least you all still can check with fragomen....in my case, my company change to another law firm after the PERM filing by Fragomen.....the info they provided are minimally little....just ask me to wait.....
if there is any actions that anyone wants to take....I will be willing to take part together.

So far nothing is official from Fragomen...no press release when DOL announced that they are auditing all Fragomen applications and then after when DOL announced that they are releasing all special audited application to regular queue..
I have no idea what Fragomen is doing...so far they filed a law suit, other than this they did nothing...Fragomen is hopeless firm in my view....even though they are at their verst, more big clients are with them...this is unfortunate....I will not recomond Fragomen to any body even Fragomen willing to file for free (offcource they will not do it for free)...they are Suc***s....not responsible...what you want to say about them.....no words...as *****.....
God only can save us....

when a patient goes to the doctor ..they need to know if they are sick or how they are doing..

this way when some other immigrants like us apply for Green card ...they would choose a firm that would

This morning, I talked with my Fragomen Lawyer and got some information. Thought to update you all.
- I asked about the DOL notice, not referring to Fragomen's name on the notice. She (my lawyer) said, DOL never release any straight forward notice. But that notice is basically for Fragomen's case and some (1or 2) other Law firm, whom they audited for the same reason.
- I also asked, as DOL is releasing the notice about PERM Audit release why Fragomen didnt make any press release for this incident. She said, Fragomen doesnt want to confuse people with general news release. They contact the client personally to provide update about their cases (Fragomen called me on Sept 29 and provided me update about the scenario).
- Then I asked about the Lawsuit update. She said, the DOL notice is actually reflected of the negotiation from the lawsuit.
- I asked about, why we are not seeing any Fragomen cases approved/denied or any update since May 2008 (I asked about May, because my case was submitted on May and I started keep tracking from May). She said, while DOL go with the special audit they audited all the Fragomen cases. The way it looks simple to release the cases but not so simple to DOL in reality. Because, DOL has asked for audit for all thousands cases and Fragomen sent audit reply to them. Now according to the mutual agreement (between DOL and Fragomen), all these cases should go to the normal flow as per PD. There are some administrative and legislation adjustment needed from DOL's side because they never did this type of thing before. And the audit responses should be destroyed or keep for further audit (if any cases really go for normal audit) is another concern. DOL has made an approximate time frame commitment to Fragomen of 60 days for all these adjustments.
At the end, she said they are really pushing hard to resolve this issue and trying their best. Whenever they got any update about individual case, they will let us know.

Excellent sharif24. You hit the nail with those questions. It means we will have to wait till around Nov 17th before we see any action.
One thing which is weird on Fragomen's part is that they have received so much of bad press. Now if DOL is indeed releasing cases, they should put a news out there so that all that bad press since June can be negated.

As per --DOL has made an approximate time frame commitment to Fragomen of 60 days for all these adjustments --> we should see at least some approvals down the line may be next 2-3 weeks....
it's really big pain for having Fragomen as the Law firm....

I asked about it to my lawyer but she didnt say anything about withdrawing the lawsuit. She only mentioned about 17th Sept's notice.

If they are negotiating outside the court then DOL is not gonna release audited cases until Fragmon withdraw the suit....that's why DOL is releasing other lawyer's audited cases but not Fragmon as both parties stuck on this law suit. It is kind of deadlock..
