Atlast I was told by my employer that my case is showing certified when he checked online. Just waiting for the paper to show us same message. Good luck to all of you guys as it seems they are processing March files now.

Wow!! Finally someone feels our pain. The first one that needs to be included in this complaint letter is the DOL - Atlanta Service Center, who has treated us differently than our counterparts in other Region, impacting thousands of lifes and businesses. Due to their delays and unexpected reassignment of personnel to take care of H2 visas, we totally missed the boat. AILFA should include them also on their lawsuit.

Those waiting for US Passports are on National news complaining for the several weeks that they need to wait for their documents. They can not even imagine how it feels to wait for years!!

Let's stand together in this battle and continue to put some pressure to the Atlanta Center.

The 1-485 Filing boat that is now unavailable. We could've filed if Atlanta approved PERMs within the 45 to 90 day range.

USCIS regected all the I-485 and revised the VB. Atleast you didn't waste your $$

Let me try to explain. Nenina is not from India or China. His/her PD is always current until July. If he/she had got the PERM in June or before June, he/she could alreay have filed I-485. Make sense to me.

but she will be current at oct again, just a few months delay. come on, if you are not from india or china, do you really want to compare your few months' delay to our years of delay?

I think Atlanta is processing files based on country of origin. It seems there are hardly any India and China cases being processed. Why are they processing other countries like Romania, Trinidad, Poland etc? It seems they are after Indians and Chinese......

I don't believ they're going by country of origin since out of the 6 approved in July, 4 are from India/China.

Hey Guys,

Thought I will share with you all something that I noticed. If you go to tabular data and sort the list "Approval/Denial Date: Desc.", just from the 1st page it shows something:

1. 7 Approvals in the first 5 days of Jul are all from March (scattered dates, tho)
2. 20+ Approvals from 6.22 - 6.30 are from Feb (only a couple not from Feb)
3. 10+ approvals from 6.13 - 6.22 are all scattered ( most from before Feb tho)

Looks like ATL did pick up after they kept all of us on hold to processs H2Bs ( as they say).

So,

1. if they cleared scattered cases after the news on Jun 13; kind of cleaning up.

2. picked up and kind of finished Feb cases in next 1 week (coz we do see a substantial number),

3. are giving March approvals in the lat 5 days:

Now, the date when we start seeing april, we will be able to tell how soon they finish 1 month worth of apps. If its one week, then we should start seeing more april by the middle of next week and May should follow the week next.

I know these are not all ATL cases, of course, and then there are some who will say "I am Feb, where is mine?";

But then don't all analysis all over the world work off of samples anyway?

Thank you testitit for clarifying my comments. We all have different situations, waiting times, country of origin, etc.

The whole point of my message guys is that all of us under the same problem of having a PERM approval delayed, should stick together and continue to pressure the Atlanta Center for the service that we deserve. Let's support each other in this effort, we all deserve it.

Why not send it to Atlanta PERM office. Above mentioned is for USCIS. Guys lets start "Gandhigiri" for Atlanta PERM center. How about having July 12th as flower day for Atlanta center. We still need to do more work. Approval rate is not that high and we don't know when this people will reassigned to other task......

You have got to be kidding me here. Do you know which forum this is? Do you know we were all unable to send 140 & 485? Do you know if all those applications got in in July, we from the Atlanta PERM center would have to wait a much longer time? And you ask us to do what? I say the USCIS did a great job in this case by denying those applicants.

My dear "waiting2007", this kinda things will not earn us anything but more pain. Let DOL do what they are doing coz our telling or forcing them will not change anything. So just keep your fingers crossed and keep praying to Almighty for our quick approvals of labor. See the way u guys are forcing them and irritating them, very soon you guys will start seeing lots of RFEs and Denials. So if USCIS has given us a chance to board the BUS we were dying to board why to mess up things now. So be patient and hope for the best. Save money for the day when you again see things as "Current". Dont misunderstand me or dont get angry, I m also one of the sufferers and is waiting for almost more than 120 days for my labor....:-(

Anyways all the best to you all and keep praying....

there is 3 approvals for today .march and the end of february application. it's a good sign they start opening march applications. but at the same time I feel like you guys getting tired .I don't see too much replys lately .no new plans . no calls .no e- mails to atlanta center .are you guys giving up ? please don't we need to help each other to do someting for our goods.

Do you guys really believe that emailing them changes anything !? or even calling them for that matter.
I think these guys operate the way they did for so many years and I just don't think that begging them to work faster is gonna work, even if it's our right ! as clients who paid a considerable amount of money for a set of papers to be reviewed.
I think the Atlanta trend is near the 100 days or so, it might get slightly better but it's unrealistic to expect it to become like chicago.

Excuse me? USCIS did a great job? I can't believe what I'm reading. Go tell this to a person who waited in backlog for LC for 5 or 6 years and thought he finally saw the light when the dates became current. How can you be so inconsiderate? I'm sure that if it would happen to you, you would be mad, and this after waiting for a few months for PERM. We've waited for my husband's LC for 3 years and a half, and now, after 3 months of waiting in the 485 line, no more visas available. I've been unemployed for 5 years, looking at my college degree and counting the years passing by. Why aren't we all looking around us and understand that if we only see our own interest, we'll never get too far in this process, no matter the stage we're at.

Hey "deca" this is nothing selfish or so....U and ur husband were waiting for ur labor for 3 years....thats true and I understand thats painful. But think our situation we paid hell lot more for our labor than u guys did earlier and our fellow friends filing from CHICAGO gets their approvals in 2 weeks whereas we are waiting for more than 6 months....which is not what PERM states. So if USCIS has stopped the 485 approvals during the July 07 bulletin it has benefitted us because otherwise we would have waited till stone age to get our 485s filed. So if that makes us selfish so be it. C dude at one point in life u need to be a bit selfish, coz everywhere over here is selfish. Do u think people here will come back to see whats going on with ur application once they get their approvals they had been waiting for so long? No my dear friend none are going to come back to help U for that.

Friends - I don't think fighting among ourselves is going to help. Lets use of time and energy is pushing Atlanta DOL to approve our cases fast. Lets stay united. Lets fight one problem at a time.

Guys,

I am following approvals everyday. I do believe that they are done with Feb and are proceeding nicely within Mar ( no order in dates tho).

We also do know that they are not following FIFO, but there are only a few now from Feb who have not received a decision yet. I think if they keep moving this way (I pray that they do), they will soon finish Mar and of course followed by Apr, May etc. Also, the avg time has come down from 108 days to 96 days in the last 20 days.

For people who have PD in Feb, should aggresively ask their lawyers/ employers to initiate a formal query. I asked my lawyer and she went crazy when she heard "... a benefiatiary of an LC is making inquiry reagrding his/her case with DOL". She said a benefitiary should never ever call/ write to DOL. The lawyer/ employer can and should; after 90 days.

I am not a chicken, but guys, be careful when you do that.

You all recall our fax/email/phone surge, where several of us sent multiple correspondences to DOL ETA.
I faxed a letter to ELAINE CHAO mid May, and had only my name and signed as PERM Applicant. I wanted to share with you.

Surprisingly, yesterday I received a letter from DOL, which was addressed to me, and had my home address, employer name, which was not on the fax I sent. When I first saw the letter, I thought that it is either the approved LC or a rejection letter, but the letter was about acknowledging my concerns, and that my application was received and is being processed.

I suggested in my fax that implementing a SINGLE national queue that gets processed by both centers will give fair handling to all applicants nationwide regardless of their geographic location. The letter was sent to address the FAIR, and it assured that the process is fair. I was not concerned about the fairness within a center, but instead the suggestion was giving applications nationwide the same treatment.


I wonder if I need to inform my employer/attorney about this, and if it could affect the processing of the application.

I will be waitin' and will surely find out.

What did you pay? There's no filing fee for PERM and by law, the employer is obligated to pay for attorney fees:

BTY, average approval takes 124 days at Alt now.

Lately, we have seen that ATL PERM center seems to be processing applications, but at a very slow pace. At this rate it will be few months before they complete all the backlogs. We have emailed/faxed/called to get them started. Does anyone think that we too need to send some flowers to the ATL PERM center to thank them first for having started the processing and then request them to pick up pace and start processing our applications faster? Or does anyone of them have any other ideas to motivate them to get going? Please post your ideas, suggestions and anything we could do to speeden this up.

My suggestion would be to request for a 'national queue' for applicants allover the country. Then they can be routed to chicago/atlanta depending on the workload or personnel available in a particular location. That would ensure some fairness in the process, so that everyone gets an equal waiting time.

flowers to ATL it is. If some one can get the details about the person to whom the flowers should be addressed, I think we can pick a date so that all flowers can be delivered on the same day.

I don't think we have enought people to make an impact with flowers. Flowers to USCIS was organized by immigrationvoice and thousands participated. I don't think we have that kind of a crowd.

I think it doesn't have to be a novel idea and the message does not need to be harsh or discouraging. Just a 'gentle' reminder that so many law obiding,tax paying members of the society are hoping that Atlanta NSC will expedite the processing and compete with 'chicago' NSC.
Even if it's not hundreds of people sending flowers, just 10-15 should suffice to convey a message.

What say?

Team........I don't think its going to matter even if 10,000 people join hands and stand infront of Atlanta DOL. I am sure they are working as hard as they can. I am positive that they are not delaying the approval on purpose. lets keep hope and lets wait......
