Topic: Whats wrong with ATL PERM Center
Just heard from HR who received a courtesy copy of the certified ETA, approved and will move on to the next forum, filing I-140 and I-485.

Tomorrow is the last day. After tomorrow, even if we are approved, let's say Monday, we won't have the approval notice before the end of July, meaning we can't file 140 in July, meaning it's over.

no... it is no true... we can file before aug 17... keep doing ... USCIS waist 16 days in July... So they extend the application to Aug 17... It is for both 140 and 485... because we need time to prepare the application... right? I think that we can file 140 before Aug 17...

If our labour approved before aug 17th, we can file I-140 and I-485 together before aug 17th,
we need to expedite and moved forward . We meet to request altanta officier to approve atleast before aug 10th

I spoke with my attorney, He says that our labor must be approved before July 31st for us to be eligible to apply before August 17th. We have 6 working days. Please send the flowers,emails and fax to them and convey the message that they need to expedite perm applications.
Lets try our best and leave the rest to god.

I am a new member here. I applied for LC on 11th of JUNE ( just two days before 'C') in ATL. In 3rd week of JUNE my employer received a call from DOL. I was told that it was a normal enquiry. They just asked my employer whether they(my comp.) sponser me and blah blah.. after that till now no update. My attorney not even responds my phone/email.
Is the DOL enquiry a comman process?

Yes that is normal. In some cases DOL will call the employer and confirms and in some other cases employer will receives a sponsorship email with 4 questions.

It is bit confusing on what is our drop dead date. Do we need labor approval prior to July 31st or have time till Aug 17th.
This is to me is million dollar question for most of us now.....

conflicting answers regarding approvals bet 1 and 17 aug. some here say has to be a pd before 31 jul with approval bfore 31 july, which i thought. checked with my lawyer...my pd 5/28 and if oked between 1 and 17 aug, i can still file...
god so many if/whats etc....god only help me even if i could apply, so much to do....so many questions...and to make it even more interesting, i've been out of country/traveling... also in part due to immigation stuff itself...

I spoke with my attorney yesterday, He says that our perm needs to be certified before July 31st in order to be eligible.
If our Perm certifies after August 1st then we are not eligible.
I guess its logical as the July Bulletin is for july and they are giving additional days in August for the guys who got their petitions approved during last weeks of July to apply.
I am also hearing conflicting views on this point.
Lets see if anyone gives a firm statement on this.

Anyway we still have 6 working days. Lets hope everyhting goes fine.

I know you want it badly, everybody does, but what you said is simply NOT true.
If you don't file 140 before the end of July, that means you were not eligible to file 485 in July, that means you can't file 485 under the original visa bulletin board publication anyway, and means, we are screwed.
As for the filing of 485 before Aug 17th, that's only for those who had their 140 submitted before end of July.
I want it as bad as you do, but, let's face it, it's over for us now.

it makes sense to me too that PD and approval both need to be before 31 july (just that my lawyer told me aproval can be before 17 aug...but i'm not so sure).
I wonder since the govt left confusion if this is an area that will be debated in future....like people/agencies will try and push govt to accept applications approved bet 1 and 17 aug...in that case it makes sense to just 'do it' in case govt decides to accept..god knows..it's all damn confusing.
question....my lawyer says i would need tax return of mine from last year...does that mean w-2 ?? is that the one employers send to you so you file...or the actual tax return (which i didn't print as dumb as that is..i had used turbotax to apply and when i go back to print it, i run into a few problems it seems....crap luck)
anyone else getting medical just in case and when you call to make medical appt do you get 2 appts or just one....one to go get blood done, 2nd to go discuss or whatever...any suggestions.
not sure why i am bothering cause i don't see this happening for me...

And since there is a confusion , and not all lawyers are saying the same , i am sure USICS can also just reject anything.... so there is a biggger & better possibility that no application will be rejected ..infact with what they have advertised they cannot reject any labor's whose priority dates(Application Dates) fall before Jul 31st...
But now lets us all Send out faxes.... we will do the rest of talking later ... i know we are all confused on dates ..but the time we have we can not spend on worrying ...we will do something today morning adn start this conversation during end of day ...
LETS ALL PROCEED AHEAD with our actions ... Think about any eventualities during the time it maters...

You can always get your complete returns transcripts from IRS for free. Visit IRS and search or google previous years tax documents. You can order them online or on phone for free, although there are some private agencies who do the work for us charging some fee. But not sure if you need all the transcripts i guess W-2 should be good.

It is not at all true that we need to have labor before July-31st.
If you are applying for I-140 and I-485 after July-31st, you need to pay more fees as new fee guidelines are effective after July-31st.
Please do not believe these rumors.
Even if your attorney is saying, then he must be playing around.

Let us concentrate on getting our labor approval for now. We'll reserve the debate on the dates for a later time. That seems to be a gray area for everyone.

gray areas are not necessarily bad and can be debated....so for now focus on getting approval for PERM

Read this from the DOL Department :
The DOL processes applications for Alien Employment Certification (ETA Form 9089). The date the labor certification application is filed is known as the filing date and is used by USCIS and the Department of State as the priority date. After the labor certification application is approved by the DOL, it should be submitted to the USCIS service center with an I-140, Immigrant Petition for Alien Worker. You may access the State Department Visa Bulletin to learn which priority dates are currently being processed.
I think this is considered the priority day for USCIS.

In a press release on 07/17/2007, the USCIS has announced that it would accept the applications for Adjustment of Status (I 485) only till August 17, 2007, after which a heavy retrogression for several years is anticipated.
This is a narrow window for thousands of legal, tax paying immigrants who are counting on you for their PERM approvals and hence holding on to their hope of filing their I 485 before August 17, 2007.
I hereby request you to kindly expedite the process and help us keep our hopes and aspirations alive.

There is no approval from Chicago or Atlanta. I think they have stopped approving. This is all political game and our e-mails or flowers are not going to work. ImmigrationVoice and Murthy are not worried about DOL. They have big fish to worry about.
Lets still keep on trying.

i agree with mobile24. i believe the 2 approvals from yesterday were approvals from previous days. They are playing the same game as they were before July2 nd. they are trying to help out the USCIS to lower their load. dont waste your time and money.

Friends - This is my conclusion on our problem. We are wasting money and time with our e-mails and flowers. I don't think DOL employees are doing it on purpose of slowing down the approval process. They get the orders from top (where we or immigrationVoice or Murhty have no control). If a senator takes this issue seriously then something can be done. You and me are to small a fish in this biggggggg pond.
Try the same effort on our senators. Lets try to send flowers to them, E-mail them and call them.
What do you all think on this approach.

Q-2 (07/19/2007): I filed PERM labor certification application on July 2, 2007. We have yet to receive the approval of this application. Will I be able to submit I-485 application if I receive the labor certification application in the first week of August 2007?
A-2: In reversing the decision to reject I-485 applications which are received on or after July 2, 2007, the USCIS has extended the filing period until August 17, 2007. However, the August VB shows that visa numbers will be "unavailable" in August 2007. It thus appears that the USCIS is extending the filing deadline for the I-485 applications which were eligible to file in July under the original July VB but is failed to file it July 2007 for a number of reasons. The USCIS appears to extend the filing date until August 17 for these types of applications. However, in your case, you would not be eligible to file I-485 application in July 2007 since you did not have the certified labor certification application before August 1, 2007, you may not be eligible to file I-485 application between August 1 and August 17, 2007. However, if you receive the labor certification application before the end of July, you should be able to file your I-485 application in August between 1st and 17th. The AILA is currently collecting tricky questions from the members and intends to obtain answers from the USCIS. This can be one of those questions. Remember, though, that the USCIS announcement is not authorized to change the August 2007 VB and will not be able to accept any I-485 application like yours after August 1, 2007 in my opinion.

We thought of sending flowers to DOL and only 15 or 16 pledged...and except 3/4, no one updated on the flowers if they reached or not..we tried faxing yesterday and hardly 5 or 6 came forward...
Unless otherwise there is a coordinated effort and commitment from EVERYONE who are reading this forum, we cannot make a difference...

If you can think of Atlanta ..it was always only 2 approvals daily never increased and the fact that they approved more on same day was some kind of coincidence may be ... they are on the same speed and usually fridays they never do any work... if we see from past weeks ..only thursdays were good for numbers ...(ALL MY COMMENST RAE THROUGH OBSERVING THE TRACKITT SITE)
They cannot work under any instruction to slow down..infact an instruction to slow down cannot be given to any system by any authority..thats not a legal thing... so lets not worry about that ..we will keep our efforts and some ears will listen and speed up ....
