Topic: Whats wrong with ATL PERM Center
i have no access to fax as am traveling abroad.
been emailing every day
called renata's number, left message
checked with ftd.com and they had to check with their florist (i tried to check status online but couldn't get anything), and told flowers delivered yesterday.
|
I completly support Mobile2007's thought. We should focus more on contacting our congress-person. And lets just not focus short term - i.e to get your PERM approved before Aug 17th. We need to work together to fix this process once and for all. The process should be such that we don't have to wait anymore for these dates - make this always CURRENT. So lets focus on the LONG TERM solution to this issue. Contact ur senetors and congressperson.

One Question is always in my mind : If anybody can answer?
Since now USICS have opened the gate for everybody and but for only those stuck in ATLANTA & BEC all would make it through into the system. (SOME 5000 in ATLANTA & 10000 in BEC).
Assuming this why USICS wants to close the gate so early with a Time frame ... who else in the world would even be applying once all the 200,000 applications have been done ... i agree they want to check it and make it regukarised with date contriols ... so may be there is a chance when they open again they will have to make it current only for all to apply and cannot retrogress any dates backwards....
so we all have a fair chance by the next time (which can be in October 2007 ) if we could not get through this time (but i dont want this to happen though)...
|
Well forget Atlanta, Why Chicago is not having any approvals. Don't tell me that people are not updating. Everyone was updating till 7/16 but after that they stopped. Thats hard to beleive.
I am not saying to stop trying but what I am saying is use this same approach towards our senators.
|
any approvals today???????????
|
If what we speculate is true abt the slow down , then only CHICAGO can be requested for slowing down. ATLANTA witha backlog and deserving applicanst waiting for more than 90 days cannot be halted .... assuming all of their peer mates from chicago have gone through...
to think on the + side ..is there a discussion between the 2 offices to see Atlanta match up with the applications in Chicago during this time frame ..and may be just becoz that we dont see any approvals for this short period ... JUST GUESSING THIS SHOULD COME TRUE and see all of us approved till JUNE both places ..what a day that would be for all of us ...
|
Where di you hear this....
|
As of June 1st there were around 204,280 PERM applications filed (Chicago + Atlanta)
Out of these 187,481 were completed.
So how many of these remaining are stuck in ATL ? and how many more were filed in JUNE and JULY to ATL?
(One big reason for Atlanta's load is due the east coast states. Most of the consulting firms are based in east.. where as Chicago gets low load due to the applications from mid-west and west coast.)

|
I am just keeping my hopes alive seeing some CALM from both the centers ... this could be a corordinated effort...
|
No approvals here soesn't necessarily mean no approvals at all. Remember, we probably form a very little % of applicants. Majority of the applicants who've been receiving approvals may not be members of this website. Don't loose hope. We'll get there.
PS: I know of few ppl who got theri approvals in last couple of days.

I hope so.... Not losing Hope

this is the reponse from my lawyer -
"You will be eligible to file I140 and I485 together if your labor gets approved by 08/16/09."
|
From Greg Siskind's blog
under FAQ 5
_____________________________________________________________________________________________________
I have heard that if my priority date is not established until after July 31st, I am not eligible to adjust under the July Visa Bulletin even if I file before August 16th.
This is one of the more confusing aspects of the USCIS announcement. On its face, it would seem that anyone can file an employment-based adjustment application up until August 16th. However, a closer analysis it may very well be the case that only people with priority dates established earlier than August 1st can file adjustments between August 1st and August 16th . For example, one who wishes to file EB-1 might be ineligible to file later than July 31st because the priority date would not be established prior to August. ON THE OTHER HAND, SOMEONE WHOSE LABOR CERTIFICATION IS APPROVED AFTER AUGUST 1ST MIGHT STILL BE ELIGIBLE BECAUSE THE PRIORITY DATE WOULD HAVE BEEN EARLIER THAN AUGUST.
We expect further guidance from USCIS on this confusing subject.

let's not loose hope and keep going...

I have a question. In any of the forms do we have to mention when our LC was approved?
|
We are required to attach the labor certification with the 140. But, we can still take a risk and apply using online approval screenshot, if we don't get paper approval by the deadline.
Let's push Atlanta forward...Hope something works out :)
|
I understand that you have to attach your approved LC but we don't have to mention that our LC was approved on such and such date.
|
An approved LC would obviously have the date of approval on it :) No way of escape ...
|
I am planning to send a case status enquiry to ATlanta as a fax instead of email to avoid ATLANTA asking me to talk thru my employer ... did anybody have got any reponse for any of the FAX messages sent to Atlanta asking your case status... if so how do they send the response ...my fax number is in office is not my private number to receive any responses ...
Pls let me know . if anybody been thru
|
guy's send your inquiry to the bellow email address.they will reply you.
plc.atlanta@dol.gov
|
I got the following reply when i sent to plc.atlanta@dol.gov
-----------------------------------------------------------------
Thank you for your e-mail to the Atlanta National Processing Center concerning your case filed under the PERM program.
Our office can only respond to inquiries from the employer's contact person or attorney/agent listed on the submitted 9089 form.
Atlanta Help Desk #11
|
I sent the following message to the email ID plc.atlanta@dol.gov , I will post the responce as soon as I receive.
Thank you very much for working on PERM applications in full swing.
In a press release on 07/17/2007, the USCIS has announced that it would accept the applications for Adjustment of Status (I 485) only till August 17, 2007, after which a heavy retrogression for several years is anticipated.
This is a narrow window for thousands of legal, tax paying immigrants who are counting on you for their PERM approvals and hence holding on to their hope of filing their I 485 before August 17, 2007.
I hereby request you to kindly expedite the process and help us keep our hopes and aspirations alive.
Thank you for your time and consideration
Yours sincerely

Guys even if we get the approval in this month , is it true that we need the original certified approved copy for filing AOS , if that's the case....... the mail would eat lot of time too....
Can you apply without hard copy of labor approval ???
|
I am not from India so i hope in OCT bulletin our PD will again change to Current
|
How can you say that ypur PD will be current in October even if you are not from India? There is no guarentee.
|
Because Every country has Pre assigned Quota. In our category it was already current so we don't expect backlog. I am not sure but i wish EB2 should be current again in our category. Everything was ok but i don't know why USCIS played this game.
|
So Guys,
You can see more GCs in skilled category soon! So hope we are clear on whom to support!
P.S I know you all know that even we apply our 485 now under this current we have to wait until our PD becomes current to get the GC. So if the number of GCs increased then the root of the problem will be solved!!

Thank you for your eMail. We are very aware of the problem with the labor certifications pending at the Atlanta PERM Processing Center. You are correct that we are seeing processing times that are in the range of four to five months. We do understand the problem this is creating for people who will not be able to take advantage of the July Visa Bulletin.
We have made some initial efforts with respect to this issue. The American Immigration Lawyers Association is also trying to address this issue. We will continue working in this area but it is unlikely that it will be resolved in time for the July Visa Bulletin.
Immigration law is purely federal in nature. No state in the U.S. is allowed to pass any legislation in connection with immigration matters under the doctrine of preemption. The Murthy Law Firm can conveniently and efficiently represent clients on U.S. immigration matters located anywhere within or outside the U.S.

Below is the reply got from Ombudsman
--------------------------------------
Thank you for your e-mail to the office of the Citizenship and Immigration Services Ombudsman (CISOMB). I appreciate your recommendations and suggestions on how to improve the administrative practices of the United States Citizenship and Immigration Services (USCIS).
Under the Homeland Security Act of 2002, it is my office’s statutory mission to assist USCIS customers, to identify problem areas in the immigration process, and to propose changes to the administrative practices of USCIS. I believe that process change recommendations from individuals like you are the best source for identifying systemic problems in the immigration benefits process. My office will consider your suggestions as we develop recommendations to improve USCIS’ practices and procedures.
In this particular instance, however, CISOMB does not yet have any jurisdiction for the reason that no matter is presently pending before USCIS. Until the labor certification is issued and comes before USCIS as part of an immigration benefits application, you must seek your remedy with DOL. That said, we recognize the interconnectedness of the employment-based application process and are always interested in hearing about logjams in the system that affect overall processing. It is not, however, within our authority to intervene with any agency other than USCIS.
Once again, thank you for taking the time to contact my office, and for giving me the opportunity to serve you. I look forward to the day when I can report that the work of this office has been accomplished because our vision of a world-class immigration benefits system has been achieved. Your contribution takes us a step closer to reaching this goal.
We hope this information helps you determine how to proceed.

Thanks for your email. I am sorry that one of us could not reply to it right away.
Yes, we are aware of the problems at Atlanta Perm office. There is a huge discrepancy with the processing times between Chicago and Atlanta. It has been reported that there are internal operatinal challenges in that office and the the office is working on a fix to get it rectified as per what I have read of different forums.
You might be aware of the BEC centers and how many people have been stuck there ( I am one of those) some ranging in between 3 to 7 years waiting for the labor. It is very unfortunate for the BEC applicants as well because of the Aug 17th timing. Just imagine how badly they are being affected by the recent developments. We are not taking of 1 or 2 individuals but about 20,000 of them waiting for more than 5 years on an average and they would probably fall behind in getting interim benefits.
IV has tried to get amendments done or probled adminstrative fixes bases on current regulations for green card processing. The issues withn dept of labor are clearly internal challenges with resourses and staffing.
We are being told that BEC backlog will be cleared by 30 sept and Atlanta should improve as well. It is unfortunate that because of the 17th August time line, many of the cases would not qualify to go to the next step. IV does not have any plans at this time to address the backlog issues. We are trying to accomplish some of the points which is affecting EVERYONE. We will bring the issue of backlogs in the right forums and with lawmakers as the opportunity presents.
Hope I was able to give you some information. Please feel free to call me at 626 226 8088 or email any of us for further information.

What if my labor certification is approved after August 1st but before August 17th?
Again, there is no firm guidance here, but we hope such cases will be accepted as there is no statement that applications must have the necessary documents in the month of July. We will try and update this FAQ if we learn otherwise.
