Here is the USCIS answers to the questions about when you can file if you labor cert is approved before July 31 or after August 1st. Look at questions/answers to 10 & 11. Look slike it all depens of the priority date.

What a f***ed up employer? File i140 asap, make sure you get the EAC/ WAC #, take a USCIS print out, attach and file/send 485 yourself before aug 17.
Technically, whoever is paying leagal fees (typically you), the attorney is "supposed to be" representing the client ; "employer" not the beneficiary. There are 485 document check lists available in various forums.

no it means it's ok even if approval is bet 1 and 16 aug. The approval has to come in too before aug 16... I guess my question as always is can an email/screen shot of approval be used or just the hard copy is acceptable?

This means we are good if we got approved on or before Aug 10th and the hard copy has reached in the mail in about 5 days, means on or before Aug 16th.

also as someone else said...it's application received by them by/on aug 17...not postmarked....so this is going to be close in sense of hard copy of LC and when we get that..that's why i want to know if an approval number/screen shot approval is acceptable...

Priority date is the date when the labour has filed with DOL /when the I-140 has filed in case of National Interest Waiver.

You need the hard copy of Lc. The LC has to be signed by different people before it goes to USCIS.....

USCIS has clarified today that whomsoever has the priority of july and approved by aug 17 can apply for 485
(provided the certifcation is recived). It gives us more hope for those waiting for labor certfication from atlanta

It seems like about 700 thousand(more than 4 times the visa nubers issued every year which are 140 thousand) people applying for 485 in this current window. And the H1 fee is going to be increased to $4 thousand to $7 thousand.

Although different attorneys have different opinions regarding this issue, before we receive any further notice from USCIS, we suggest you take a cautious stance and make sure your I-140 application will be received by USCIS before August 1.
It says that I-140 applications must be filed before August 1.
Not sure if this is true. Can anyone confirm this what your attorney's think about it???

Please go by what the USCIS said in it's FAQ release yesterday. They categorically stated that as long as your PERM is approved in Aug with a priority date of July or before, and your I-140 is concurrently filed, you can send it your package by Aug 17th. For the entire FAQ, go to the link below.

From Greg Siskind'd blog (based on above USCIS released FAQ)
1. Those with priority dates after August 1st are not going to be able to file under the July Visa Bulletin if they try and file between August 1st and August 16th. Those with labor certifications certified AFTER August 1st will be able to file, however, since the priority date was established earlier.
So yes even if your LC is approved in Aug, you can file as long as applications are received by USCIS. It seems though you do need hard copy of LC approval with your application i-140/485. Just need PD of on/before July 31
As for I-140 it can be filed along with i-485 (as was mentioned above by another poster) in Aug (by 17 it has to be received by uscis), only thing is new fee of 475 applies (plz confirm new fee) for i-140. the fee for EAD/AP will be old fees up until aug 17.

I understand that if I-140 is pending then we can follow Q19.
My main question was, Do we need to file I-140 before July 31st.

As per USCIS faq
Q8: What is the correct fee for concurrently filed I-140s filed between July 30 and August 17?
A8. The new fee applies to Forms I-140, whether or not concurrently filed with an employment-based
adjustment application, that are filed on or after July 30, 2007. That fee is $475.
so concurrent filing of i-140/485 is possible bet july 30 and aug 17...just new fee...I read the link you gave and I think that zhang is very confused himself. clearly you can file i140 after july 31.
even if a i-140 is not filed concurrently (as per above question) it is ok bet jul 30 and aug 17 but new few applies. I just think that most people would want to file it concurrently as they want to submit their i-485 and doing it separately is more confusing etc.

i am only going by USCIS Faq.... reading it it doesn't say "i-140 submitted after july 31 is not accepted". It says that i-140 submitted (either on it's own or concurrently with 485 will mean a new fee of 475).
I only base this on uscis
i think there is a lot of confusion even on lawyer's part....
that is why i am basing what i say based on my understandng of uscis.

Friends, The Atlanta started processing the March applications on 06/29 and still its in March ... so looks like it takes close to a month to process a month worth of applications ...infact its not finished yet and still seeing only march applocations ...Not sure when they will proceed in taking more months ... if at this rate things dont look good even we get 1 month more ...
as we thought its not speeded up ..its just processing normally may be slower even... lets all try and push the center more and see what we get ..we can deal with the details of filing 140 & 485 once we have something concrete in our hands... to tell you guys ..once we cross this stage ,all will fall in-place .. ... lets keep the hopes and try and push more ....

i asked my lawyer a million times. He won't give the password. I even asked them at least to give to our office manager so she can check, they won't.. it drives me crazy.. i am not even sure if they applied??

This is ridiculous and cruel. because we have been waiting so long.. but in Chicago they are approving with in just 2 weeks. Sorry. I am not feeling sad about their approvals. But why this imparity? What to do. I just simplly crossed my hands with peak level of increasing frustration every day.
We should some how make them to understand our pain. Atlanta sucks..
