i emailed case inquiry at the plc.atlanta@dol.gov addy yesterday and no response yet. do people usually get response quickly???

did you email or your employer/lawyer....maybe they won't even send me a response of "your lawyer/employer needs to contact, not you". i sent email in a.m. yesterday...
god bless you i hope u r right about case approval. my lawyer won't get things started/ready until perm approved...so i can't afford to wait till last min and believe he has eveyrthing ready..plus my employer is god help me...so slow..took me years to get my perm set up

Our office can only respond to inquiries from the employer's contact person or attorney/agent listed on the submitted 9089 form. The policy of the U.S. DOL/ETA National Office prohibits the expediting of applications.

I would like to draw your attention towards disparity between Atlanta and Chicago PERM Center in processing PERM application.
My facts are based on data collected from a website where potential immigrants’ voluntary provide information to track their status during the various stages of immigration process. This is not an official data and might have some margin of error but still it shows huge differentiation in working of both of these centers.

With the Visa bulletin becoming current again, this disparity is hurting millions of us living on the East Cost. Applicants living on the West Cost are getting approved in 3-4 days and getting a chance to move ahead in the immigration process, while we, at the East cost, still have to wait over 90 days to get our PERM approved. Huge difference in approval timing between these two centers is creating an environment of unequal opportunities, which founding father of this nation never tolerated.
I, therefore urge you to please look into this matter and seek truth behind this disparity. Why Atlanta is processing application at a slower rate? Is there a possibility that Atlanta can share work with Chicago so that a uniform turnaround time would be maintained over whole nation?
We hope that you will fight for us with the same zeal and enthusiasm as you showed during July visa bulletin fiasco. We need your help, we trust you and waiting for the good news.

This is really unfair and annoyed. ATL and Chicago center are doing same thing but with different pace. Chicago folks are lucky they even processing labor in july and getting approvals n proceeding towards I-485 and we people don't even know when we will be getting approved letter. Its really riducolus and ATL center should understand our feelings.

I think people are busy doing the I140 and 485 filings, and not updating the case status. I wish that is happening and the there are more approvals than what we see here.

i don't even have a way of checking my status till at least next tues now as the woman at lawyer's office is on vacation...my employer...welll enough said.....

But we are always here, i haven't seen any approval of regular users who come here and write their feelings and i don't think they will forget to update their status

As of this Friday, my case would be pending for 150 days - that's 5 months, hope I get an approval atleast next week. But still have to get a hard copy in the mail, no idea how long that takes. My employer sent an enquiry last Thursday and just got a reply which was the standard "correspondence would be forthcoming" email.

ANAND, looks to me its very strane ..i am watching ur case too. pls confirm with ur employer / lawyer is ur case really pending ..sometimes they dont tell u the real story ... if u have access to the system or if u can see them directly to believe it ...i would suggest u that ... for me ..most of the cases from ur period is answered and if they still are there , then would have got a query for some reason and ur employer mat not be saying anything to u ..chect tht out and make sure its really pending and u can stay relaxed a litttle bit ... JUST a Thought ...

Anand - You need to check it out man. 148 days seems to be a lot. Ask your lawyer, Whats going on. Tell them to find it out. You are paying them so don't worry about you asking thme so many questions...

My case is pending for 150 days also. I infact visited my lawyer personally and checked the status online. It says "In Process". My lawyer suggested, making an enquiry may result in AUDIT which will take longer. So all we can do is just wait and have faith in GOD. Good Luck all.

Shankar, we just received a reply for an enquiry that my HR friend sent from my company, I have pasted the email below. I know for a fact that the case is still in process. Plus the lawyer is a good friend of mine (although I don't have access to the online PERM account :-) )

ppx2007, that's really old news from back in May. The personnel have since been reassigned back to working on PERM but for some reason, it's still slowwwwwwwwwwwwwww

how long does it usually take for email response from atlanta help desk if you yourself (not lawyer/employer) email them. Please share how long it's taken for you....
I'm worried as from what i'm reading usually you get response immediately or in short time. I emailed yesterday a.m. and got response today, almost 24 hrs later. I'm worried that I angered someone there or something and they are going to do something to my case.
Also has anyone gotten response from any other atlanta help desk but #11...
darn i wish i could check my case status today/tomorrow but now i have to agonize till tues till woman working on my case at lawyer's (busy/big firm so everyone does diff things..think i already annoyed lawyer by asking too many questions through email since am away/out of country). I have to wait till Tues...at least....so far away.... my employer will not check...i always have problem with slow poke at HR at my workplace....brrrrrrrrrrrr

ps57002, my HR sent an email last Thursday and just got response this morning. But I asked her to send the same exact email on Monday, so not sure which email was replied since DOL cut out the date and time stamp on our email in their reply. If possible ask your attorney to resend the email.
Shankar, thanks for the wishes. Although, I'm eagerly waiting, I'm not worried. I prayed and have a peace about the whole thing that it would turn out alright in the end - no matter what happens.

But in the mean time, think about a back up plan too ... for the 'just in case' scenario. I am saying this especially for people whose status (H1, etc) will be in trouble if they are unable to make it .

I agree June22perm... the reason being if its not for this time , then H1 will get to expire one day with 140 aaproved & 3 years extension included .. and the next gate opening may not come after even 6 yrs + (looking at the visa numbers) ... so all will be in trouble if we miss out this chance ...
For thiose in Backlog there is a chance as when they will open the gate with a cut off of those people in mind and they will escape in ..but we have filled in only 2007 ... so another chance for us to get in may be anothre 6 + yrs ..(i dont know whether we all can have H1b's until that period with whatever extensions )... moreever the rules can change too as they have many Green cards and less h1s ... so i am thinking this is a final chance and if not , i will have to be prepared to go back when it expires ... hope its the same with all our friends ....

And now that they have suspended 140 processing indefinitely, and the fact that 140 approvals are taking between 9 to 12 months, it may be hard to get those 3 year extensions too.
All these facts make the Labor certification before Aug 15 as essential for all of us. When they open flood gates next, say around 2009-2010, the dates don't have to be 'current'...it has to be 2007, for us to sneak in :)

calculation of total people applying in this current window and available visa numbers. PLEASE DO EVERY POSSIBLE WAY TO catch this bus.

Ouch !! this thing hurts...probably it would have been much better if the whole July fiasco never occured...knowing that there is an oppurtunity out there and not being able to do anything about it sucks...added to that Chicago is faster than Atlanta...Huh ! couldn't get worse

yes ...infact when they open the gates next time , they will be pretty sure not to make the same mistake of making current and crying about visa numbers ..so they will open only to make sure all the backlog center applications go in... thatway they have accounted for all the people includeing the current folks & backlog.
so obviously what it means is
1. The gates opened for us and we could not get in for some unfortunate reasons and we will be left alone .... JUST the 5000 odd people ....
with minority on our side , its difficult to fight for and get ourselves inside the system ...
Or some miracle to open the gate and make it current again just for ATLANTA folks .... ????
Thats y its more than important to get in now .... so lets give it aa shot ..may be if we try for this 1 or 2 weeks and succeed its great , if not atleast we can never repent that we have not tried for it ...so folks just think about this and act ...

I just spoke to Foreign labor office in washington, even though the lady to whom I spoke to was not very helpful, I took a minute to explain DOS visa bulletin and how this delay in processing is hurting us. I also told abt chicago and faster processing time...not sure if my message will reach proper authorities..But, She told me they are aware...i asked her if they are working on it...she again gave me the same reply, that they are aware...I said thank you and hung up..

I already contacted immigration voice. Looks like they are not too keen to solve this issue and for some reason they are pissed off that we rejoiced on July 2nd when the fiasco happenend. Seems some Backlog ppl went and posted offensive comments there.
Anyway, I don't think we'll get much help from there. we got to help ourselves.

Folks ...now we are talking some thing good... We will def put together a case and submit and work with AILA on that or some other organization who is willing to support us ... but in the mean time ...whatever we can do can only happen after the fact that we have missed the bus this time ... until we miss the bus we will only concentrate on how to get this one going ... offcourse discussing abt this is never a bad idea ..but lets us not dilute our efforrts now with that initiate in mind.. hope all would agree on that...
also folks the more we make such communications to DOL & biggies in DOL we will have a good chance to put a case together with all details to the lawmakers for a review & a successful case. Any thoughts !!!

Firstly a Law suit would be considered ONLY IF ATL CTR DOES NOT APPROVE OUR LCs IN TIME TO FILE THE AOS.

I would think that any group of people who have been harmed can get together and with the help of a good lawyer file a class action.

Something to think about IF Atlanta Ctr DOES NOT Approve our Cases - most Chicago filers would able to file for AOS before Aug 17, however we will be deprived of, loose the opportunity to file for AOS because of the inefficiecies in the Atlanta ctr.
Personally, getting the PERM email approval any day after Aug 10, 2007 may not be helpful in meeting the USCIS deadline of Aug 17,2007

We can use the law suit to push Altanta... We can send an email to all of them including newspaper about the law suit. ... Then, they will be efficiecy ....
