But is it legal to suit ATL on this slow processing issue. A lawyer can better help us if at all any body of us can contact a lawyer.

ATLANTA has a mandate to clear PERM cases as per a schedule, say 90 days (though PERM states 45-60 days approval, except audit cases).A wildfire news of a potential lawsuit through news media could do the trick. Considering we are all desperate, it is worth a try. If you guys have access to getting this potential class action law suit news in print, like the AILA lawsuit that was proposed after the July Visa Fiasco, we might get some response from DOL. The bottom line is Chicago & Atlanta report to the same authority, the DOL and any inconsistency in processing time that is not within reasonable limits (say a few days average difference in processing time) is unacceptable. It’s their screw up and we should not pay the price for it. ANY ONE DISAGREE

vdlrao, OFLC - DOL is the responsible agency and Atl ctr falls under thier jurisdiction . . . .

I don't know about you but their SLOW process is ruining my career, i am stuck in the same job at the same low salary becuase if i change jobs, i will have to re-file . . . . the suffering is endless. We not only pay income tax, but also social security tax that you cannot claim once you retire unless you are a perm resident . . . there is also medicare tax or something


But is it legal to suit ATL on this slow processing issue. A lawyer can better help us if at all any body of us can contact a lawyer.

i suggest everyone email to ohlaw@immigration-law.com regarding what is printed on their web page "plea to DOL" and ask if they are actually in touch with DOL or just printing stuff. maybe oh-law will help bring out this issue soon if everyone emails.

Pl. also add my ID to the list.

I would like to suggest that we seek advice from an attorney (Mr. Berd, Mr. Oh, Ms. Murthy or someone else) AND wait to see what Atl Ctr does by end of 8/4/07. We may need a legal definition of "Group" - for e.g., how may people at minimum are needed to form a "Class"

Pl. ddo not contact the media yet. Let's wait until Friday, Aug 4th to see what or how may PERM cases are approved by Atl Ctr . . . . We also need to discuss w/ an attorney/s many of whom may all be busy filing the AOS for the lucky folks who got their labor certified in time . . . .

I'm always glad to help constituents who are encountering difficulties with federal agencies. My offices can act as a liaison between the citizens of Georgia and the federal government.

If you are having a problem with a federal office, in nearly all cases, it will be necessary for me to have from you a written and signed request for help which will enable a federal agency to relinquish information to me from your file. This is due to the Privacy Act of 1974. The purpose of the Privacy Act is to protect individual rights of citizens by prohibiting the release of personal information about them to unauthorized parties.

The written request should be addressed to Senator Chambliss and should state that you give permission for him to look into your concern. Your request can be made in the form of a letter or by completing a casework authorization form. The letter should contain your full name; mailing address; telephone number(s); Social Security number, file number or case number; signature of the person involved; and finally, all pertinent details of the case. It should be specific as to the exact nature of your request and the desired outcome. Also, please include copies of any pertinent documentation.

It is important to know that neither I, nor my staff, can approve a claim or appeal, or compel any agency to act in your favor. Those types of decisions by law are made by the federal agency involved based on the facts of the case. However, I am glad to obtain answers to your questions, to make the appropriate officials aware of your concerns, and to cut through "red tape" you might be experiencing.

Folks , i am with you on this ... But waht i heard is that there is no mandate from ATL to clear of the cases in 90 days ..if it was there and anybody has got that mentioned in black & white ..pls bring it forward and we have a strong case to go ahead ... but for that we need to consult somebody before we get the campaign ... any thoughts ...

I agree with pcshankar. We need to establish that DOL is obligated under current law to complete processing applications within 90 days. Without that the case won't hold water. Then again, I'm not an attorney.

Guys The Number of the days is not important, The DOL is processing applications in a manner which is discriminating applicants based on their place of Employment. Justice is note done by DOL in Processing applications

When Chicago can process cases in 7 - 20 days how can Atlanta take 130~ days? It is hard to believe that cases in East Coast are more complex than the ones in the West coast.

I have been emailing, phoning DOL & Atl Ctr every day without success since the original July bulletin was released on June 13,2007.

The labor Department comes under this committe and also contact the Committe Chairmen Edwards M. Kennedy and Ranking Member Michael Enzi
and we can all cordinate calls to all their office at same time (One call after other, which might Impact a little bit)
If we agree to this we can decide a time slot and make calls

Until we get media's notice, nobody will care of us. Just like july 2's situation.
I have sent emails to everyone, called, but no response.
I think they are aware very well, but they just dont do anything, they dont feel any presure as long as they are not exposed to media.
What we should do? I am so sad.

To tell the truth, we have been emailing, calling, writing for such a long time already. If they haven't speed up a little bit like in the past few weeks, I really don't see how anything could help us get on this bus.
In the long run, it might helps, but I give up this time.

Is it possible that we do the law suit? We want require the following:

1. ask DOL to approve all cases before July 31 in time.
2. let USCIS to extend the enough time for the cases in law suit.

We can't file our 485 because Atlanta don't approve our cases... We should fight ... and let every body know our pain....

starting at 3:00 EST today, Please call this number and complaint about Discrimination Done by DOL
Please start making call at 3:00 EST
If you get Busy tone, TRY TRY TRY TRY and make as many call as you can and ask help from your friends or family to make calls , i am trying to call with 10-15 people, Please do that

3) Send emails to or call DOL and related agencies

4) Send emails to or call local/national media

These are the following options we have : i might have missed out some , pls add them

After the fact that we are denied: Law Suit
==========================
Requires the following actions :
a ) Verify whether we can do it with a attorney.
b) Get support from as many possible from insisde and outside (law firms).

Now at this Stage:
=============================
a) Bring media attention to the issue by publising this.
b) make all people aware of the issue in Atlanta to speed up.
c) messaging all the concerned at ATlanta DOL.
d) get some external help for us in representing us to ATLANTA like some AILA folks ....

If there are any more , pls mention we can start working on it ... its better to put all our efforts together and target one area were we have good success rate instead of just all going different directions.
