I am so glad that more and more perm applicants joint for some action. It is time. It is so easy. Just call, fax or mail them. Each time I just mention two point:1. Perm program is intenede to reduce labor certificationtime. now such a serious backlog happened in Atlanta. 2. Two center processing performance are so different. Chicago center can process a case in a couple weeks, while atlanta need two month, even more. We pay and file the same case but unfairly treated.

Dear Sir/Madam,

I want to bring to attention one issue that has never been looked into or addressed. This is related to labor certification process at the Atlanta PERM Processing Center. While lot of attention has been paid towards illegal immigration, no news channel or program has investigated the pains and frustration people have to go through while trying for employment based immigration. Currently there are 1000's of PERM applications pending at Atlanta PERM Processing Center, some dating as far as early part of 2006. There are people waiting for their labor applications (First stage towards attaining permanent residence) to be approved for more than a year.
Department of Labor (DOL) established PERM National Processing Centers for faster approval of labor applications last year but that seems to make the matters worse. While the Chicago Processing center seems to be processing applications in a timebound manner, the Atlanta center has followed its predecessor BEC's in processing applications. PERM Centers were established to process applications in 90 days, but there are 1000's of cases that have been pending for more than 6 months now. There is no visibility into the process, it is slow and makes life tough people who are here on an H1 or other work visas.

As a legal, tax-paying and productive members of society, many careers are stalled by this seemingly never ending unfair wait in the American legal immigration system and is very discouraging and possibly detrimental to the interest of the American global economy in the 21st century.

The DOS having released their monthly visa bulletin recently with all dates being current. It would make it absolutely necessary for us to be able to use this one time opportunity to submit the next stages of our immigration process. DOS has very clearly stated that they will retrogress the dates in the forthcoming visa bulletins.In this situation, it makes it even more necessary for us to be able to submit our applications. But we are all stuck in this black hole called the Atlanta PERM Processing Center.

I this regard, I would be very grateful if this issue can be addressed quickly. I would appreciate if you can request the Atlanta PERM processing center to start processing our labor applications in a timebound manner and also dedicate additional personnel to clear the backlogs. This would be of immense help to legal, tax-paying and law abiding members like us. Atleast then we will not be caught in a never ending cycle of waiting and uncertainty for us & our family members. Your prompt action would be much appreciated.

I hardly see any approvals from Atlanta processing center as I was looking into different forums. There was a message in May saying that staff has been reallocated for PERM approvals after they were diverted to H2B cases and they would expedite the process. Still no progress. I have emailed and faxed them. We guys filed from Atlanta are treated in a different way compared to other centers.

We need to voice our concerns more loudly. I have seen so far we are limited to a small circle, the forum, DOL. As we are currently the weakest point, there is no way we can fight DOL directly as we are under their control. I would suggest to jump out of the box and contact some big news medias. Illegals immigrant issue is the center of the storm. How about us, the law abiding people are being treated unfairly. If possible we need to to purchase a big ads space on Washington post or other major news papers to lay out our hardships, to visualize our concern to another higher level. It is a kind of game of getting attention. It is high time for us to do something to play the game well so that we get more attention. Think about it, when Atlanta PERM Processing Center is on the headline page or conspicuous positions, it will take it very seriously! Just my two cents.

My understanding is DOL needs to respond within 90days for PERM applications. That was the intention when they started this process.
Also, can everyone of you contact your attorney's and have them contact AILA to plead our case with Atlanta PERM center? We as clients cannot directly contact AILA. Since our attorny's are members of this association, they can try and help us out. So we need to put some effort to convince our attornies to contact AILA and have them pursue our case. Please contact your attorny immediately

PLEASE PLEASE PLEASE DO THAT. I am not based in ATL so can't make it, I am far off so will have to take day off. People in or near ATL should definitely do that.

Other than that I have been trying desperately to get something back. Talked to Melaney Baker again and she asked me to call the same number where now they transferred me to Ms. Catherine Harris who was not around and I left a message for her.

To email the Atlanta center, they cannot give us any information as to why this is happening, they dun have any information either so the best thing is to email the atlanta center.....

At this point we need an attorney to represent us (all of us in this forum). Anyone that believes thier attorney is an activist and 100% committed to their practice, please speak up. Most of them are not too helpful. He/she can be our voice at AILA. The Center will only listen to Attorneys or Employers unfortunately. We can even start collecting signatures via e-mail to support that attorney.

Those in Atlanta, PLEASE, PLEASE go out there in front of the center to get some attention (hopefully news) and solve this problem. Most of us have waisted enough years waiting and we still have more to come.... :( It is so painful to try to do things the right way and remain legal.

I will ask my lawyer to contact aila.org even though she is slow to reply my email all the time.
I will try to contact aila.org, too.
I faxed, emailed, called to atlanta center, no use.
called DOL key persons, left VM, emailed to Senators, nothing improved.

PLEASE GUYS IN ATLANTA, go in front of PERM office !

I got a call back from this number (404) 893-0101 today. A lady working for DOL called me from that number and told me that she is replying for my voice message I left 2 days ago. She said me that they've started processing PERM applications. She didn't give any other informations like when my applications will be processed and which month's application is currently beeing processed. Let us hope we'll get our LC soon.

This is the latest update I got from my lawyer:

Processing Times & Inquiries

Normal processing times:

90 days to receive communication from DOL (approval, audit, denial)

120 days to receive a decision after employer submits response to an audit
The DOL does not yet have designated "normal processing time" for their response to a submitted motion to reconsider. They are continuing to process through their pending queue of motions.

Inquiry process if case is past normal processing times:

If a case exceeds a designated normal processing time, the employer/attorney can submit an inquiry to plc.chicago@dol.gov or plc.atlanta@dol.gov. The DOL requests that the email contain a specific reference in the subject line, e.g. "case # - case beyond 90 day normal process" or "case # - audit response sent over 120 days ago".

If after a reasonable period you get no response or are having continued problems, you should call appropriate Processing Center Atlanta (404-893-0101) or Chicago (312-886-8000) and provide specific case information and describe the issue over the phone so that the PERM Center Director can follow up.

I think protesting outside the Atlanta office is the only way. This is so unfair that Chicago is processing applications in matter of days and Atlanta is all but dead. Guys there is no point writing emails and sending faxes. We should be physically present outside the Atlanta office and protest. This way atleast some news organization might notice it and air it. I am in. People who are in Atlanta please organize this. I am ready to take few days off and join in. This GC current dates is a very big oppurtunity for us. We should not loose it.

Its very easy to sit and write statements like this online. When someone organizes a protest outside the Atlanta office, not a soul will show up. It will be a pathetic failure. I would really like to know how many people will really show up for such a protest. We people just talk and talk and write on forums, but when it comes to action not a soul will put his hand/leg forward. If more than 100 people can volunteer and come to Atlanta, I am willing to help you guys out and join you in the protest. There is no point in just 10 or 15 people showing up and meeting the Atlanta PERM officials. Our protest has to show up in numbers, more the numbers better representation we will have. Please do not reply back that I do not live in Atlanta and cannot make it. If you really care for your labor application, you should be willing to sacrifice few days of your life for it. And please don't expect few handful people to make the sacrifice and represent hundreds of people. Its not going to happen.
Anyone interested in protest at the Atlanta PERM center, please post your name & email address on this thread. if we can get atleast 100 members volunteering to come to atlanta for couple of days, then we can arrange for something. I am putting my name and email first for others to join me. Lets see how many really care and are willing to join this effort to help themselves.

It's impossible to get 100 people to go to the march. Actually 20 person is enough for a protest. I am in PA, and I really can't get there, but I do encourage those people who live in GA, AL, FL and SC should go. For those people who can't go, please do some kind of donation to support them. Please setup a paypal account and I will donate it first. Those donation should cover those protest cost, if possible, some reimbursement of gas for those traveling from other states.

My attorney inquired from the Atlanta Processing Center on 06/18 and received a reply on 06/19 indicating that the petition is still being processed.

can we re-consider all dirctions that we go with:
1)E-mail,Fax,phone to atlanta processing center & DOL (did not work but we should keep trying )
2)if every go to senator visit in the area where he/she reside and give him all documntaions supproting our cases (just print the dratf letter posted in this site), at least if 20% of the senators make phone calls to DOL & and Atlanta perm center we made something.
3)file a case with immigartion contact "AILA – American Immigration Lawyers Association" they can help . here is the site for AILA www.aila.or
4)protest in fron of atlanta office *** most importent even if takes me to fly to Atl , will do

In terms of dealing with USCIS or centers, the only predictable thing is their unpredicatable fashion. Many cases have already been dragged for more than 6 monthes. What can you say about this?

I asked my attorney to inquire about my case and this is what he replied me:

They are working on cases filed in January and February from the Atlanta Office. They are backlogged due to working on H-2B applications for the last few months. I got an announcement yesterday that they are going back to Perm cases now so it should start to go faster. Many people are upset but nothing you can do. A few of my cases from April and May have been approved recently but I have many from February still pending.
