|
one added just now... 17 to go
|
Question: If we get certified on Aug 11th (on-line status changed to 'certified'), we will not get the paper notice until Aug 18rd or later. In such case, can we e-file 140 and concurrent file 485 on Aug 16th, and then send the supporting document on Aug 23rd?
That's the only way I can think of to save us a few more days waiting for the paper notice. Do you guys have other ideas? Thanks.

Thank you for your e-mail to the Atlanta National Processing Center concerning your case filed under the PERM program.
Our office can only respond to inquiries from the employer's contact person or attorney/agent listed on the submitted 9089 form.
Applications are processed in the order they are received. Once the Analyst reaches your case in their queue, based on the principles of FIFO (first in first out) it will be reviewed and official correspondence will be issued.
However, because each application is unique, processing times may vary depending on the specific circumstances of the case.
The policy of the U.S. DOL/ETA National Office prohibits the expediting of applications.

Dear Sir / Madam,
This is regarding the labor certification process at the Atlanta PERM Processing Center.
The DOL is not seem to be processing applications in a timebound manner.
Most applications are older than 90 days and are still pending without being processed.
We can understand the above mentioned facts as we are part of a forum of Atlanta Perm Applicants.
and pls find below the contrast details of the 2 processing centers in handling our applications.
Atlanta Perm tracker : http://www.trackitt.com/usa-immigration-trackers/atlanta-perm-tracker/
Chicago Perm Tracker : http://www.trackitt.com/usa-immigration-trackers/chicago-perm-tracker/
Chicago vs. Atlanta
Chicago Mean (Days) 12.7, number of observattions 111
Atlanta Mean (Days) 103.2, number of observattions 66
Above analysis based on a sample of cases filed to Chicago and Atlanta centers (from trackitt.com) since March 2007
Pls make it fair enough for all applicants and resolve this issue as early as possible.
As a legal, tax-paying and productive members of society, many careers are stalled by this seemingly never ending unfair wait in the American legal immigration system
and is very discouraging and possibly detrimental to the interest of the American global economy in the 21st century.
Also Just wanted to bring this posting in the web site to your attention: http://www.immigration-law.com
The same message from the web site has been copied here for a quick reference:
==================================================================
07/24/2007: USCIS Generous Interpretation of Priority Date Based July 2007 EB-485 Filing Eligibility and Our Urge for OFLC's Certification of PERM Applications Before 08/17/2007
The USCIS FAQ indicates that those who filed a PERM application in July 2007 establishing his/her priority date and and will receive cerification of these PERM applications will be eligible to file a concurrent I-140/EB-485 application on or before August 17, 2007. The current DOS and USCIS actions following the July 2007 VB fiasco is giving a life-time opportunity for these filers to file EB-485 applications such that during the forthcoming long backlogs in adjudication of their applications, they could at least work and travel internationally using EAD and Advance Parole, and when they should be laid off, they could still complete the green card process inasmuch as they would find a similar job after 180 days of filing of the EB-485 applications. We thus urge the leaders of the Office of Foreign Labor Certification, particularly Dr. William Carlson, Chief of the National Program of U.S. Department of Labor, to acclerate the July PERM applications such that they are certified at least within the first two weeks of August 2007. We also urge the AILA to work with the OFLC to seek such cooperation from the agency. As affected by the surge of H-2B applications, we understand that Atlanta National Processing Center has been experiencing some delays in the processing of PERM applications and we strongly urge the Atlanta Center leaders to consider the current exigent circumstances and to accelerate the July 2007 cases adjudication within the next two weeks. Those who should desperately seek such help will include:
Those who have already filed and are waiting for the certification at this time.
Those who will file the PERM application on or before July 31, 2007 in the next one week. Those employers who will complete the required recruitment process by July 31, 2007 should make it sure that the PERM applications be filed online "on or before" July 31, 2007 so that once the PERM application is certified in the first two weeks of August, they submit the concurrent I-140 and EB-485 applications "swfitly" not missing the deadline of August 17, 2007. These aliens may also want to prepare for such potential opportunity and start collection of required supporting documentation in preparation for the situation. This will be particularly true for EB-3 filers as they are the ones who will suffer the most from the upcoming severe visa retrogression in coming years.
We thank in advance for Dr. Carlson's special attention to this request on behalf of the U.S. employers and the foreign workers.
=======================================================================
we would be very grateful if this issue can be addressed quickly.
Thanking you in advance,
Best Regards,

Guys, I got this reply from OLMS.
The issues that you raise do not appear to be covered by any law administered by this Agency, the U.S. Department of Labor's Office of Labor-Management Standards (OLMS). OLMS administers the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), which governs labor organizations comprised of private sector or U.S. Postal employees, and section 7120 of Title VII of the Civil Service Reform Act (CSRA), which deals with the standards of conduct for Federal sector unions. The LMRDA regulates internal union affairs such as the election of union officers and the reporting and disclosure of union financial matters. Regulations implementing section 7120 establish standards of conduct similar to provisions of the LMRDA. Additional information regarding the laws administered by this Office can be found at http://www.dol.gov/esa/olms_org.htm.
You may want to call the following Department of Labor toll-free referral line for additional guidance regarding your concerns: 1-866-4-USA-DOL.
This response is for information purposes only and does not constitute an official communication of the U.S. Department of Labor.

I DID TOO. I think its ok. Dr. Carlson did pick up the matter it looks like.
We should start sending THANK YOU NOTES to "the whole address book" by the end of the day.
btw, just blasted again.
|
Guys,
PLEASE DONT SEND THE THANK YOU LETTER!!!!!!!!!!! ATLEAST FOR A WEEK OR TWO, PLEASE DONT EVEN THINK OF THAT.
PLEASEEEEEEE!!!!!!!!!!!!!!!!!!!!!!
|
do you guys have any idea...... does the employer receive approval email from DOL or just check the status online????
|
I even feel like Vdlroa , Thank you notes is little too early... the reason being
1. Not suer they consolidated all approvals for the end of week and provided that on that day and may be we wont see the same trend the entire week as that da y.
2. Unless they continue the same speed for another 2 + weeks we wont see all the back logs eliminated ... They have just started ... we can do that close to end of week (after seeing the trand)..
All thought sare welcome
|
Guys
Please Starting sending Thank you note by the end of the day , they have started processing applications and now its our turn to send them Thanks
|
Guys,
Hope every body here knows that people who ever applying to chicago center getting approvals less than a week. How about atlanta then. Here people waiting for months. So when the atlanta does the same AS CHICAGO or atleast if it keeps up the same speed as friday or faster than that, yes then we defenitely send the thank yopu letter. But we have to wait and see the trend atleast a week BEFORE DOING THAT. So its better to send the thank you letter next friday, if atlanta keeps up the same speed.
So PLEASE DONT SEND THE THANK YOU LETTER NOW ITSELF AND MAKE THEM GET SLOW AGAIN. I AM PRETTY SURE THAT THEY WILL RETROGRESS THE PROCESSING SPEED, THE MOMENT YOU SEND THE THANK YOU LETTER.

Hi ipkus (2) - In case if you don't know, you could put "Watch" on perm-tracker, to get email on status-change of selected Cases nearer to you.
|
16 more to go. Hope we see atleast 5 in the next 1 hour.
|
3 Approvals so far today!!!!!
|
Did you guys observed,
Only EB2 APPROVALS. No EB3 Approvals.
Mine is EB3. Though I have masters, my employer applied on EB3, Bloody suckers.
Hopefully thy will process EB3's also.....
|
Hi,
I spoke to my friend over the weekend.
He says that their company got 20 approvals last week, mostly applied on June with Atlanta Processing center.
I guess its not FIFO.
|
I dont think they descriminate on the basis of the catagory. You don't worry. Now a days most of the people applied in EB2 only that is the reason why you see more EB2 approvals.
|
I aggree with GCWaiting2007.
|
I think our compaign worked. Atlanta ctr is progressing very well. Hope to see more approvals today
|
Only three approval right now... Do you think that we need another emails war today???
