Dear Dr. Carlson,
I write to you in hopes that you will not only hear, but understand, the CRITICAL nature of our concern regarding processing times at OFLC, DOL-Atlanta. We simply ask that you complete processing of pending PERM applications for applications with pririty dates before Jun 30, 2007, so that we can make the deadline set by USCIS.
We request Dr. William Carlson to consider our plea and propose the following:
1. As per your guidelines and more importantly "Regulation", "Any and all applications WILL automatically receive a computer generated "Certification" unless selected for audit".
2. Due to recent changes in USCIS policies, which evidently is the next step for ALL FLC beneficiaries, it has become very vital that DOL follows laws and regulations laid out in the Federal Register more strictly than ever.
3. As OFLC, DOL-Atlanta has been busy doing other work, thousands of premanent FLC beneficiaries will not be able to file Adjustment of Status applications timely and will be victims of "high retrogression".
4. Moreover, as a PERM center is chosen just as a matter of where the petitioner operates, beneficiaries from other than DOL- Atlanta PERM center (Chicago) have been able to take advantage of this positive change in USCIS policies, which is ABSOLUTELY UNFAIR.
5. Therefore, we appeal to the lawmakers that this parity not be accepted and I on behalf of all beneficiaries of FLC applications at DOL-Atlanta propose the following:
i) As per the law, OFLC, DOL - Atlanta WILL make their best efforts to approve ALL FLC applications with PD on/before June 30, 2007 by Aug 17, so that more legal and tax-paying workers of this country who seek immigration benefits may do so.
ii) Given the fact that, had OFLC, DOL-Atlanta worked on their normal pace and followed the Federal Regulations, there would have been a great possibility that all correctly filed FLC applications with PD before June 30, 2007 WOULD HAVE BEEN approved by Aug 17, 2007, enabling their beneficiaries to proceed and file necessary petitions with the USCIS.
WE STRONGLY URGE that, inspite your best efforts, if, today, managers of OFLC, Atlanta foresee that they will not be able to grant such benefits to beneficiaries of FLC applications with PD on/before June 30, 2007, that they request USCIS to allow acceptance of Adjustment of Status petitions from beneficiaries of FLC with PD on/ before June 30, 2007 EVEN AFTER their deadline of Aug 17, 2007.

Though I got my approval,I will do every possible thing to mail the address list you have given,to see that every person over here got approved over here.Do not loose hope.Tommorrow you will see lots of approvals,the reason I feel is, now CIS can charge the new fees and all PERMs will be approved.All these days,though I am not interacting with you guys,I am sending mails from 20 mail ids 4/5 times at different times like 9am,12pm,3pm,6pm,10pm.I promise you to continue the same and I will update you once I got my hard copy.
Please donot mistaken that I am done and ran from this group if donot see any posts from me,because I have to balance my work also.

6 Approvals for today 07/31. It seems they pick up with our email campaign. But this processing speed is not enough.
So if we intense our efforts, then DOL may allot some of the newly hiring emplyees (about 1500 employees) to this PERM application processing center at Atlanta so that all of us can catch up the current I-485 bus.

The draft letter posted by gbmsz on page 23 is great. Pl. add my ID to this campaign. There are a few key points in the letter you may want to edit before mailing –
5. "Therefore, we appeal to the lawmakers that this parity not be accepted" - it should be "this DISPARITY not be accepted"
5 i. As per the law, OFLC, DOL - Atlanta make their best efforts to approve all FLC application with PD on/before June 18, 2007 by Aug 17 – Shouldn’t this read “Applications with PD on/before JULY 31, 2007? Also, I think they should certify before Aug 15, 2007. Getting the LC approval on Aug 17 at 4 pm is not going to help file AOS – the attorneys are not going to co-operate . . . besides, DOS expects to RECEIVE the applications no later than Aug 17, 2007. Ideally, all pending Labors should be certified no later than Aug 10, 2007 giving attorneys sufficient time to coorectly file the AOS
5.ii Again, Date should be July 31, 2007?

I agree getting LC on aug 17 at 4 is not going to help. that is why i am thinking people should go to the other thread too on reaching out to USCiS and see if it will allow filing I485 without actual hard copy perm approval...people need to be in on that campaign too...
