I write to you in hopes that you will not only hear, but understand, the CRITICAL nature of our concern regarding processing times at OFLC, DOL-Atlanta. We simply ask that you
1. Complete processing of pending PERM applications for applications with priority dates before July 31st, 2007, based on ‘Federal Register / Vol. 69, No. 247 / Monday, December 27, 2004 / Rules and Regulations’ published at http://www.foreignlaborcert.doleta.gov/pdf/PERM_Final_Rule_12-27-04_FR.pdf
2. WE STRONGLY URGE that, DOL request USCIS to allow acceptance of Adjustment of Status petitions from beneficiaries of FLC with PD on/ before June 30, 2007 EVEN AFTER their deadline of Aug 17, 2007, if, today, managers of OFLC, Atlanta foresee that they will not be able to grant such benefits to beneficiaries of FLC applications with PD on/before July 31st, 2007
We request Dr. William Carlson to consider our plea and propose the following:
1. As per your guidelines and more importantly "Regulation", "Any and all applications WILL automatically receive a computer generated "Certification" within 45-60 days, unless selected for audit".
2. Due to recent changes in USCIS policies, which evidently is the next step for ALL FLC beneficiaries, it has become very vital that DOL follows laws and regulations laid out in the Federal Register more strictly than ever.
3. As OFLC, DOL-Atlanta has been busy doing other work, thousands of permanent FLC beneficiaries will not be able to file Adjustment of Status applications timely and will be victims of "high retrogression".
4. Moreover, as a PERM center is chosen just as a matter of where the petitioner operates, beneficiaries from other than DOL- Atlanta PERM center (Chicago) have been able to take advantage of this positive change in USCIS policies, which is ABSOLUTELY UNFAIR.
5. Therefore, we appeal to the lawmakers that this parity not be accepted and I on behalf of all beneficiaries of FLC applications at DOL-Atlanta propose the following:
i) As per the law, OFLC, DOL - Atlanta WILL make their best efforts to approve ALL FLC applications with PD on/before June 30, 2007 by Aug 17, so that more legal and tax-paying workers of this country who seek immigration benefits may do so.
ii) Given the fact that, had OFLC, DOL-Atlanta worked on their normal pace and followed the Federal Regulations, there would have been a great possibility that all correctly filed FLC applications with PD before July 31st, 2007 WOULD HAVE BEEN approved by Aug 17, 2007, enabling their beneficiaries to proceed and file necessary petitions with the USCIS.
I hope you understand that it is critical and that while for Atlanta center it may just be a few extra hours of work, it means YEARS of living in uncertainty for those who will not be able to benefit from this opportunity presented by USCIS.
We urge Dr. William Carlson, that you keep what you promised, and complete processing of ALL pending FLC applications with priority date on/before July 31st, 2007.

For me it seems theres a pretty possibility that I-485 applications will be accepted till Aug 31st if not atleast a week after the dead line means till Aug 24. Its imminent!!!!!!!!

I think if Murphy or ALIA can ask USCIS to accept 485 based on PD or file date no matter when it is approved that will be great.
Say, A's LC was filed in 2006, but it is not approved until 09/20/2007,
B's LC was filed in April 2007, and is approved on 07/01/2007.
Then B is able to file I-485 while A is not.
It is not A's problem that his LC takes long time, it is DOL's.
Gorvenment should consider this.
For fairness I would think USCIS should accept A's I-485 even in Octomer, 2007.
This is probably too ideal to be realistic.
It is just my thought. But it won't hurt to mention it to Murphy or ALIA, etc.

Potential Adjustment Applicants Stranded Abroad

We further appreciate the USCIS's ongoing efforts to set policies and procedures to ameliorate the damage caused by their actions in July. In that regard, there is a remaining, unresolved issue creating undue hardship because of the USCIS's actions in connection with the July Visa Bulletin. It concerns individuals and families who had made plans to travel abroad for the summer in June 2007. After mid June, these I-485 eligible individuals and families canceled their plans when the July Visa Bulletin was issued on June 12, 2007. Many of these individuals re-booked their tickets after the July 2nd announcement, and traveled abroad before July 17th. Some of these individuals are now stuck abroad, unable to return in time, due to their need for visa appointments at the consulates for H-1/H-4 or L-1/L-2 or other work visas. They must await visa appointments at the U.S. consulates, where the summer rush of visa applicants limits appointment availability. These individuals are unable to obtain their nonimmigrant visas abroad in time to return and meet the August 17th deadline for filing their I-485 applications.

Potential Options for this Affected Group

One option to address this problem would be to instruct the CBP to grant parole generously to these individuals or families, so that they can enter the U.S. without the nonimmigrant visa and promptly file their I-485s. This decision would have to be communicated properly, so that airlines would know to allow these individuals to board and CBP inspectors at airports must be thoroughly trained on this matter. Another option is for the USCIS filing date to be extended by just two weeks, until Friday, August 31, 2007, for at least this limited group of individuals who are stuck abroad because they relied on the July 2, 2007 USCIS decision.

If you are not going to jump on me - As someone who actively participated in the E-Mail campaign for the past few days, let me suggest something
I think we have bombarded with enough emails taking our plight. Now, do u think DOL or DOLETA would still be reading our mails and not marked them as SPAM so it directly goes to their junk folder. Imagine, if you were to receive hundreds of emails, first day you would open and read, second day when you receive hundreds you are going to mark them as SPAM and never open it...I bet thats what is happening with DOL also. There is no doubt our email campaign was a GREAT SUCCESS...looking at the approvals on last friday we did send a message.....Since last week, email campaign did loose some steam - Now, we need look for more effective means of getting our message. I'm going to be doing three things
1) Send FAX to DOL washington. Attn: Madam Secretary and Attn: Dr. Carlson
2) Send FAX to DOLETA in Atlanta
3) Send registered mail to washington
I'm sure they would atleast take time to read atleast couple of faxes and letters and this way we can get our message more effectively.
If you all agree with me, pls do fax and mail out the letter. Its just that what we are doing should yield some results. But if you guys still beleive email campaign will work, pls continue doing so.

Looks like ATL has gone back to their older ways of 2 or 3 a day ... so everybody is loosing hope ..we wil see a good speed from them only on Aug 31st when they want to clear all Apr and save their face ...They will sleep all month long and wake up and process all at one ... from Jul 27 its evident that they can process faster ..but why they d'nt want to that way ..GOD ONLY KNOWS..
