Topic: Whats wrong with ATL PERM Center
I still feel murthy law firm is only trying to get extension for those stuck outside usa..her clients..she is in no way fighting for DOL victims...so don't count on it.
It is a lucky draw system with DOL...I think there is a bag with all the applications in it..they pick one..process it....

if if the extension is got it will be not benefit us ... but approved earlier than Aug 17 th ..so no use thinking about that ...

we are not sure weather or not the extn will help us. either it will say
1. ok people stuck outside and come back till aug31 and file AOS
OR
2. Simply aug 17 extd to aug 31 and all people here (or whrever) can file 485 till aug 31. *** this will be cool for us.
I am not very optimistic that it will fly at all tho...

but what if the condition to the extension is "those who can prove they were stuck outside usa and unable to file as result"...sorry i'm hopeless and pessimistic....with govt workings you can never know...they won't keep it "open" for more people.

you are so right about the "bag". Actually this is pretty much the way things are being handled recently... Look at comprehensive immigration reform, what happened after spending so much money and hours and hours of U.S senate... nothing... Wait for two years to come back and.... to do what?? ... to see if there is any change in existing "Mess". why cant they find any way out today. Nothing for illegals... and misery for legals, "good guys"... God bless all..

I sent emails again this morning and will keeping doing it until 17th, even though I agree that there is no big hope to shake Atlanta up. Employers are always the same. HR and lawyer both want us to get stuck long so that they can get bigger benefit out of it. Let's just hope that we can make our voice being heard by those rule makers and they would change the current crappy policies into better ones. (reply) (report this)

i don't think you should go by 'this is range they are picking' I thought same too. they had processed some may 24, 29, 30 applications..mine is may 28. i think is may 29...we are still here...god only knows what system they follow.... it's like a "lucky draw" (reply) (report this)

Dear Dr. Carlson,
I write to you in hopes that you will not only hear, but understand, the CRITICAL nature of our concern regarding processing times at OFLC, DOL-Atlanta. We simply ask that you
1. Complete processing of pending PERM applications for applications with priority dates before Jun 30, 2007, based on 'Federal Register / Vol. 69, No. 247 / Monday, December 27, 2004 / Rules and Regulations' published at http://www.foreignlaborcert.doleta.gov/pdf/PERM_Final_Rule_12-27-04_FR.pdf
2. WE STRONGLY URGE that, DOL request USCIS to allow acceptance of Adjustment of Status petitions from beneficiaries of FLC with PD on/ before June 30, 2007 EVEN AFTER their deadline of Aug 17, 2007, if, today, managers of OFLC, Atlanta foresee that they will not be able to grant such benefits to beneficiaries of FLC applications with PD on/before June 30, 2007
We request Dr. William Carlson to consider our plea and propose the following:
1. As per your guidelines and more importantly "Regulation", "Any and all applications WILL automatically receive a computer generated "Certification" within 45-60 days, unless selected for audit".
2. Due to recent changes in USCIS policies, which evidently is the next step for ALL FLC beneficiaries, it has become very vital that DOL follows laws and regulations laid out in the Federal Register more strictly than ever.
3. As OFLC, DOL-Atlanta has been busy doing other work, thousands of permanent FLC beneficiaries will not be able to file Adjustment of Status applications timely and will be victims of "high retrogression".
4. Moreover, as a PERM center is chosen just as a matter of where the petitioner operates, beneficiaries from other than DOL- Atlanta PERM center (Chicago) have been able to take advantage of this positive change in USCIS policies, which is ABSOLUTELY UNFAIR.
5. Therefore, we appeal to the lawmakers that this parity not be accepted and I on behalf of all beneficiaries of FLC applications at DOL-Atlanta propose the following:
i) As per the law, OFLC, DOL - Atlanta WILL make their best efforts to approve ALL FLC applications with PD on/before June 30, 2007 by Aug 17, so that more legal and tax-paying workers of this country who seek immigration benefits may do so.
ii) Given the fact that, had OFLC, DOL-Atlanta worked on their normal pace and followed the Federal Regulations, there would have been a great possibility that all correctly filed FLC applications with PD before June 30, 2007 WOULD HAVE BEEN approved by Aug 17, 2007, enabling their beneficiaries to proceed and file necessary petitions with the USCIS.
I hope you understand that it is critical and that while for Atlanta center it may just be a few extra hours of work, it means YEARS of living in uncertainty for those who will not be able to benefit from this opportunity presented by USCIS.
We urge Dr. William Carlson, that you keep what you promised, and complete processing of ALL pending FLC applications with priority date on/before June 30, 2007.

Guys Let make a FOIA request with DOL on what Chicago centre is doing and what atlanta is doing
No of Applications , Approved , Denied, In process average dates
and in case of Atlanta H2B cases information
No of people working on cases, etc
And then we can pass it to newpapers and other intreasted people

Atleast we know that they are giving the right reason for delaying the PERM aplications ,
Sharing that information with Congressional people, new papers and other groups we can ask that they are doing injustice to PERM applicants and some thing must be done to address it

People will take extra interest If its a FOIA based report
we also have chance that DOL might do some thing in order to cover up their injustice ( It might also work in that way)

I spoke to my employer . He told me that they got three approval
yesturday from atlanta . Start calling employers to find out our situation.
Also ask them to send the reminders to ATL.
All the labors got approved are which sent a reminder by employer.
myne is in june he is not ready to send any reminder for me.
Try ur luck through ur employer/lawyers.

My case is also same. My attorny is not ready to inquire about my case. My case was filed on june 11. They are not ready to give the case number as well.

my employer has sent 2 so far (1 fax , 1 email ) ..got a reply for email "OFFICIAL COMMUNICATION IS FORTH COMING" nothig after that ... can you pls get the message text from your employer for the enquiry ... Just to see if that can help..

Same case with me. My employer/Attorney is not ready to send reminders. They says it is too early to send reminder. Those who's cases are pending more than 90 days it is better for the employer and attorneys to send reminder e-mail.

But we don't have time. FOIA takes more time to give the information. Perm has to be approved by Aug 13th. If it doesn't then I don't care if it takes more days after aug17th. Because it really doesn't matter. There is no reason to go behind these guys to speed up the process.
They really have played a joke out of us by changing the rules.

my employer started filing labors from april 15 . He mentioned all of the are april.

so how long do they usually take to respond to the employers requests.
Mine was filed on April 11th and I asked my employer to send in a request. My lawyer was reluctant to send in any reminders anyway. He says its all trash..That wont work etc etc..to beat me down.
Anyways hoping my employer might do it for me.

Buddy we have been doing this for last 25-30 days but no progress and response. All chicago applicants are getting apporval within 7-10 days. They are applying 140/485 and we are just sending emails/faxes/flower/mail and scratching our head and balls

I know I have sent from 22 email ids for the past 3 days. But i don't think we sent fedex or priority mail.

We will try to address to different persons in ATLANTA and send them one specific letter by FED EX..each, but for this one we need to know the names of atleast 30 people...I know they will definetly read the letter rather than e-mail...it's easy to ignore a e-mail....I am sure they will atleast read the letter...lets make it more personalized by putting for information like employer, case number...so that it sounds good....any thoughts....

Sending to individual makes sense. but revealing identity doen't make sense. email doesn't have appeal anymore. anybody can send email free of cost. It is easy to name them spam and ignore. Also it doesn't spread the fire. It just stays in the individuals' JUNK email.
SPAM is not a wide spread word for fedex or priority mail. Moreover USPS or FEDEX person delivers it and they wouldn't reject it as they rejected the flowers( cox they don't know whats inside). more the fedex everybody in the atlanta office knows about it. If they have meetings they talk about it. Also I guess we register the date Aug 17th in their minds.

I am planning on sending my fedex t'row. If anybody sees a problem or suggestion please let me know by t'row morning. It will have the postal zip code from the place it originates. So more mails from the same zip doesn't help. We need many to participate so that we send from all the states. If we send t'row it reaches there by monday.
Last try guys lets do it. Show your support. I guess that will be our last effort really anything after next week is not going to help much.

I will do my part....I will send atleast 10 letters by tommorrow morning addressing to different persons in ATLANTA..........can someone get the name list of ATLANTA DOL center....I am sure if we address to the indivigual they will atleast read the contents of the letters....come on guys...this will be our last try...we tried all things...but I am sure...this is going to work and reach most of them...as most of them will read the letters

My PERM LC w/ PD 04/06/2007 was approved today. I too had been emailing DOL and others since June 15th. I had also requested my employer (a large multinational firm) and/or firms attorney to contact Atlanta Center. On Monday they FINALLY decided to follow up w/ Atl Ctr. As rakhib advised you all earlier, I also believe it does make a difference if the employer/attorney contacts Atl . . .
It is not true at all that working in a large well known firm makes the process much easier. In fact it takes much longer as you need signatures/approvals from people in many departments and levels.
I have sent my share of emails/faxes even today . . .

Congrats :) Makes me happy to see one of the team make it.
Asking my employer to contact for me is out of question...the woman in HR (in charge) already has given me enough grief, let alone do anything for me. As for lawyer, I think they may be tired of me too :( I think I've been too annoying lately, asking over and over. So no options left for me except to pray. Have no hope though... Let us know when you get the hard copy approval and good luck with next steps...

First of all, let me congratulate you on the efforts made by you in getting the July Fiasco addressed. This has certainly made a huge difference for the future of many a law-abiding individuals and their families.
However, inspite of all of your best efforts, there is still a small section of individuals who won't be able to make use of this Golden opportunity. I am referring to the individuals who filed their PERM well before the current Priority Date but had the bad fortune of having to face the lethargic delays from the Atlanta Processing Centre. I am sure that you are fully aware of the huge differences in processing times between Atlanta & Chicago Centers.
On behalf of all the "Atlanta Sufferers", I would like to take this opportunity and request you to take up this matter with the appropriate authorities so that
- All eligible PERM certifications are Certified within the next few weeks and
- Once PERM is approved, we also get the opportunity to file our I-140 & I-485 together (even beyond the 17th Aug timelines) just because the Atlanta Centre's delays prevents us from doing so right away.
I would like to thank you once again for everything that you have been doing and hope to see a positive action on the issues raised in this mail .

When requesting employer to expedite LC you shd cite substantial increase in filing fees after August 17- if they help you file now they save money. Fees for most immigration forms have doubled some even tripled! Show employer the current & new fee schedules
Employer/Attorney follow-up w/ DOL makes a difference - I know from experience because both my current & former employers are very large mulinational firms who will 'dot all I's and cross all T's', and I have 2 masters degrees from top tier US universities yet DOL took their time w/ my application . . . .

MYGC2007 - Can you pls tell us the mode of communication that your Emplyer used to do this. Just curious to see how they find a difference bet our bulk emails and employers emails. Pls update if you are aware of the info.
