My lawyer said today that labor can be filed without a hard copy. The law does not specify that hard copy is a absolute requirement. The online application is now stamped as 'certified'. This is enough proof and they can easily verify it with the labor department.

i believe even if we see online "certified" by 4 pm aug 17, then we can file 140+485 online b4 5pm, and the rest all [medical, lc, birth cert etc] will follow in ups.
dint verify with anyone if the TIME OF DEATH is 4 pm or 11pm on aug 17, coz ideally, u cud file online at 1130 pm on aug 17. donno tho...

I searched on the above post by myself, 485 is not available for efile. 140 is. so i guess the TIME OF DEATH is aug 17, 3- 4 PM.
if you see 'certified' online' efile ur 140, attach a print out of online receipt of 140 filing to filled up 485 and FedEx/UPS same day. ** Should be entered into the courier system on that day **.; as per FAQ2 issued by USCIS.

Please dont FAX our messages; As if they think these also spam then they will not check any FAxes and all will be in dust bin.

all, i have soem observation so far :
1. Whoever is getting approved have made very few posts or none in the system.
2. No one was approved just because enquiry was sent. it had coincided with the dates being processed.
3. employer enquiries are not a big helpimng factor ( i have employer send 3 email,fax ,i sent a fax like employer).. but not a bad idea..( SHould be luck for the lucky draw)
The most disheartening are to follow:
1. whoever has made many communications to DOL ( including me ) were not very successful in getting any approvals ... just think about this (but for rakib ,rutgell) ..
2. i have marked my case details with DOL twice so far ..once i waas communicated back saying ask employer to contact ..2 nd time no response...
on some stats:
with the current speed of 47 approvals a week we can see only until May 10 for max until Aug 17th... so we will have to get more work done from ATlanta for them to complete until June ...
so i am having a mixed feeling on whether the issue will be resolved and all have a happy face at the end of day AUG 17th ...
WE CAN REJOICE NOW SEEING THIS RESULT BUT STILL MILES TO GO BEFORE WE CAN ALL SLEEP PEACFULLY...

Thanks Tunkband. I posted that message you referred above. Does that mean that i must have Labor approved to get another three years extention or it can be done without approved labor. My first labor was pending for over 5 years and i was getting extenstions based on that. Which was finally denied. Now, i have filed this one five months ago. I believe i cannot get extension based on this one, unless it is approved. This is what my lawyer told me. Please correct my if i am wrong. Thanks.

FOR EMPLOYMENT-BASED IMMIGRANT VISAS - GOOD NEWS!
By Jan M. Pederson Washington, D.C., Aug. 2, 2007: Government sources have advised us that we can expect more good news when the new pool of visa numbers is released for the fiscal year which begins on October 1, 2007. The priority date information listed is to be taken as educated predictions, not carved in stone. Expect the following:
1. Worldwide, other than India and China, EB1, EB2, EB4 and EB5 immigrant visa categories will be current as of October 1, 2007. It may be necessary to retrogress them later in 2007 or 2008.
2. EB1 for India and China will likely be current in October, 2007.
3. EB2 for India and China will likely have a cut-off date in October 2007 close to the cut-off dates for January 2007, which were: India - January 8, 2003; China -April 22, 2005.
4. EB3 cut-off dates for October 2007 also will likely have a cut-off date close to the cut-off dates for January 2007, which were: Worldwide (other than India and China) -August 1, 2002; India -May 8, 2001; China - April 22, 2005.
Please note that these are predictions subject to change depending on the number of cases approved by USCIS during the next two months. Other “Visa Gate” Factoids: 1. During fiscal year 2007 (October 1, 2006 through July 2007) USCIS processed over 18,000 EB3 cases for persons born in India and of that number, 8,000 were processed during June 2007 and 7,000 were processed during July 2007. This represents five years worth of allocated visa numbers. The annual limit for India is 2,800 per year in the EB3 category. 2. When the Visa Bulletin indicates that visas numbers are unavailable for an employment based category and country, H-1B applicants who have reached the six year limit in H-1B status may obtain three-year extensions under AC 21. This means if the Visa Bulletin reflects "U", the per-country limit has been reached. 3. The unofficial reports are that the Texas Service Center received approximately 40,000 I-485 applications during the first day or two in July and the Nebraska Service Center received approximately 35,000 I-485 applications during the same period of time. 4. During the first eight months of fiscal year 2007 (October 2006 through May 2007) USCIS requested 66,600 EB visa numbers. During June and July 2007 USCIS requested 66,800 numbers. We will provide you with updates as they become available and Jan Pederson will provide a Web seminar to discuss “Visa Gate” and related issues later this month.

My case is pending since Dec 2006. When my attorney asked DOL for the status, they told that since I am the 1st applicant from my company applying for labor certification, DOL needs to do the "central check" of the company. Does anybody aware what is this "central check", how long it may take? Thanks

I want to share this with you. My employer sent inquires in the last week starting monday for 4 consecutive days to both : Plc.Atlanta@dol.gov and PLC.help@dol.gov. He sent the emails from our company email domain account hopping to being readed an not being considered as spam. Also ,this emails were set as high priority and delivered and read confirmation . At this time He only received one delivery confirmation for the four emails sent, but it said " The email you sent to this recipient has been deliverd , and deleted without been readed , the curious thing about this is that this replay was not from plc.atlanta nor Plc.help.It had another name of a person something like name.ETA@dol.gov . I supose this is the person having my case and samebody from PLC help or PLC.Atlanta forwarded. This response makes me think that because this blasts of emails sent in the last weeks they are considering all the emails as spam and are deleting the emails without reading them.
My priority day is 06-21-2007 , and my employer was requesting only confirmation if the received the response the Company sent to the notification of audit . They wanted to be sure they received it and not give an excuse for denieing the Case for the 30 days of limit. But you see they deleted the email without knowing what were requesting.
Maybe It is what is happening with the employers or Lawyers trying to send remainders to the DOL telling them about the case are over 90 days in their hand.
At this point I think as I read before in this trend , maybe is a better Idea is only send Faxes or letters by mail, express or certified.

Finally - A happy posting. Today my Lawyer mailed that my LC was approved.
My employers email and fax(letterhead) last wed might have really helped. I agree with ernest comments on the emails revolt. Even my employer had similar feeling abt all his earlier email inquires sent. So please keep your email's simple and faxes on letter heads might make a difference. Will post here once the hard copy comes thru. Also highlighting (bold underline) your number of waiting days If above 90 is recommended.

Yes, probably you are right...but again I am not sure of it because a couple of my colleagues at my previous work place were in the same situation last year and I think they did not have their labor approvals in hand at that time... Just double-check with your lawyer again. Don't give up dude and wish you good luck...
