Dude,
Nothing to worry. It was the similar case for me where my 4 year wait labor got denied from backlog reduction center in March and my H1B status is valid until end Sep'07. But, my attorney felt it was not the right decision to deny the labor, so he did a good job by re-appealing the labor first, by asking the certifying officer to reconsider the labor with all proofs, and if can not re consider it, he can submit to BALCA(Board of Alien Labor Certification). Once re-appealed, after some weeks, filed my H1B extension for another year on Premium process and started following up with the Certifying officer about the re consideration, and certifying officer took some time to take a decision and finally as the officer felt the decision was right, the labor was pushed to BALCA where the group of judges will look into the labor considerations, certifying officers decision and the attornye's arguments to take a final decision. As per the statistics it might take an year to get the decision from BALCA as they will be having a lot of similar kind of cases, and the labor status will be considered as pending when the case is with BALCA. This would help to get an year extension to start with.
Note here is, when the labor is pushed to BALCA, they will assign a receipt number which will still keep your labor in pending status and that number is needed to INS to approve for another year of extension, and I got my another year extension that way.
Luckily, in the mean while, I got my perm labor approved and in the pipeline for filing the next steps. My advice for you is to follow up with your attorney to act fast on reappealing your labor to get your H1B extension for another year, and in the mean while, if your perm labor is approved, you can file your I-140 and get ready for 3 years of H1B extensions in the worst scenario, if you can't meet the August 17th deadline.

My friend you will always see positive reponse from Lawyer especially Murthy. They won't try to loose you because if they tell you they can't help , you wont recommend any one to them. they are diplomatic.

Mine is 27 FEB and gave up. Lost in the game of so called LUCK!

Can someone give me the fax number of DOL Atlanta. I managed to get my case number and the employer/lawyer refused to send an inquiry. I want to send one from self quoting the case number and name...to see if that works. Even if it does, no guarantee that the lawyer will file my case on time though.

So we have come doen to last but 1 week .... i am not sure which way to go ... shall we all just keep quite or just give it a grand final last push starting today..my last resort was to send my case details in mail to all in thw world for help ... i am thinking of doing it by next week start .... but for that anybody has any plans which might help the team pls share .... i want to see something either way before Aug 17th...

I guess its now time we should think about the post AUG 17 prospects. Its over people! The Administation's failure has costed all of us DEAR. But there's always tomorrow and looking forward for the next visa date availbility.

PS: Don't read toomuch into JULY approval posted today! I guess it's someone's attempt to add spice to this thread!!

This case is from Chicago processing center. He seems to be worried about his case. Because it is pending for a very long time compared to Chicago standards.

We all should now realize and understand that it's do or die situation for us, not the employees at the Atlanta Perm. They just don't understand the significance of this golden oppurtunity! They, or the ones who are responsible for this whole lapse will and should pay the price. Only future will decide what kind of price, they endup paying!

I have been trying to reach my HR person and after many a calls I was informed that he is on vacation to India. What a time for vacation !!!!!. The lawyer is the busiest person in this whole world. He isn't responding to either phone calls or e-mails. This labor certification has actually become a "labor pain". Just like a pregnant woman, we only know the real pain and thanks to the delays at ATL centre, don't get surprised if it actually takes 9 months to get this done.

Mine still shows in process. But my lawyer told that we can try apply without the hardcopy if we get the approval by Aug 17th. That gives us 9 more working days.

I don't think it really matters much. I'd assume people living in Atlanta would have given a shot already though. I would have definitely visited the DOL , if I were in ATL.Atleast to see what the heck is taking them so long to verify a person's background...when million dollar loans get approved/rejected in less than 5 min in this country.

Definitely seems Atl had holiday today....

Anyone else have difficult employers. My worry is what if approval comes on 15th. My lawyer (really really busy) will a) not have enough time to prepare everything. they won't start before b) my employer will not do it in time (god only knows the pain they've caused so far). So for me if this happens next week, what's the point???? too late for me at least.

Today atlanta was really slow huh????

What happens after Aug 17..well I go back to work in few days. Deal with stress and more that existed pre vacation. Get severely depressed as I did earlier. Realize yet again time to go back home. I can't do this anymore :(

you raised some real good concerns ... the same case here .... no idea how i will ever get out of ths stress ... but just started to discuss wiutrh friends as when can possibly we geta chance to file it again (5yrs .. 3 yrs ..8 yrs) ... and until that period do i need to undergo all the sh... with my empl...and if ever plpan to hang on ..will i get a h1 extension all these stuff..

dont know hw to handle this mentally at this point ... not caring to speak with people ... ....... i have many questions than answers .... i have put to much faith on this labor .... buit never knew even before my labor comes good , comes the USICS will make a mess in making all current and closing the doors for ever ..dont know whom i should blame ... DOL ..USICS... or my Employer or Myself for putting myself in this mess........... i am frustrated to the core ... .
all i know is , i have to come out strongy , if i need to get back to myself again.

I'm sorry that you have it so difficult too. I totally understand. I've been at rock bottom in past few months and had glimmer of hope with this USCIS thing. unless people have been in our shoes, they don't understand at all what it is like and the emotionally draining journey this is.

Every single day more hope dies for me. I had hoped that going back to work from my vacation, at least I'd see some light at end of tunnel. I'd hoped...

I wish I had something to help make those of us in that position feel any better.

I wish that Atlanta center knew what it was like and what it meant to get this. Guess they will never get it...

and for me the extension stuff is another story. My H1B 6 yr ends in Dec...so yeah...got no 365 days or so.... No premium on I140 too....go figure...

and all it does for my personal life...yet another story.

Thanks but I have tried all that I could have to get something from the lawyer/employer but they have been pretty much unconcerned about our future ..... if these people can behave like this, I have no reason to wonder why the ATL centre won't do the same.

It is as much a fight against the ATL centre as against the crooked employer and their ever-obliging Lawyers.

My lawyer had stated atleast 2 weeks back that even if my PERM gets certified, my 140/485 will not be filed ( wonder if he is busier than even George Bush ) and on top of this, the employer is always backing the lawyer saying thst he is very busy, he is having many cases from our company and that our company is only one of the many companies that he supports. All this as if he is doing a charity .

So, why blame the ATL centre alone ? It is as much a fight against the ATL centre as against the crooked employer and their ever-obliging Lawyers.

i wish we all get the labor cleared just some days before and file with USICS and get reallly done .... hope everybody waiting here is of some kind of a desperate situation .... But will there be a way that ATLANTA understand the issues they have caused of their system failure ... or atleawst USICS by not planning enough and creating a fiasco ...

Lots of carrers are stalked by thsi infact ... it makes life very difficult to plan ...... sometimes i feel being a illegal atleast gives you a sense of comfort that people will take care of us oneday for sure ... being Legals and trying to maintain our legal presence takes a big toll on people's life ....

Just on the lighter side ...we can all trash our passport and say i am a illegal immigramnt and collect our GCs before our friends who have got a chancve to file for their 485 this time around...ahhhh ...

today lots of new entries just signing in today and say approved ... i dont beleive these entries are happening ... i know atlanta is a mess..but not sure that will be to that extent .... some of the new entries post saying approved today applied date tommorow...

i guess let's talk about the fastest/easiest way to become illegals....there's hope then... because the CIR bill should come up again in a year...by then we'd be illegal for 1 yr and well maybe we'd qualify then... j/k.

and i don't trust anyone registered/posting in past day or so.

I think different lawyers differ on the need for actual hard copy. USCIS doesn't seem to have clear guidelines. What does your lawyer say?

Have everything ready and the certification should come hopefully in few days...good luck.

My lawyer said it is definitely worth a try. They do not have clear guidelines. In my experience grey area with USCIS always works perfect. But I guess you can wait until august 17th to file your 140 and 485. you have lot of time. There is no need for you to worry.

This is why approvals are coming randomly:
People who applied in june and july and have still received their approvals belong to non-software companies like pharmacy/ doctor etc. (My friend from pharma applied in mid june from atlanta and got approved within 60 days)
Software has a huge queue and the current is feb/mar/apr.
So, good luck to non-software guys... your chances are bright to make the august 17th deadline.
