Did you guys check with the lawyers if they are willing to file without hard copy of LC? Most lawyers wont file.

My attoeney is willing to take a chance. Although they feel it is required.

There is no point in filing I-140 without hard copy of labor certi, it may rejected since it is mndatory. if 140 is rejected then EAD and all other benefits of AOS will be revoked and may need to start from sqaure 1.

I assume they might ask for the original at some point of time, but would still process it....since I-140 is online anyways.
Rejection is much 'harsh' word.:))

ps, no hard copy is reqd to file 140, as if cases where original is lost, uscis requests it from dol directly. so basically they are used to seeing 140s w/o actual lc attached.
also, because 140s are E-filed, support dox go 7-10 later anyway. if approved timely and we are able to file, we should receive the hard copy in mail before we actually dispatch the ups packet of 140 anyway, right?

what is the point in filing online if it is a concurrent filing(140 and 485) so better with hard copy and all other credentials to avoid any RFE later, one RFE may delay process for many months...

if we don't file, we get delayed for years. Relative pain is much much less.........

You have answered it yourself..."many months"...better than "years" :).Although, I feel you can send the supporting docs in a week or two with your file name and to a right attention!

My lawyer told "we can do it and see if they accept it". If the lawyer said she can do it then I guess she knows how to do it.

My lawyer told me about th potential issue invloved in this later. He said it has to go in same packet ie both I-140 and I-485 together with all supporting docs. what you guys think??

as PS0057 pointed out before, from USCIS FAQ#1, it has to be received at the USCIS center by/on aug 17.

Some attorneys are willing to take more risk, others are not. It really depends. We can say this issue falls within the "grey area" of the law.

At this point, if you have only a online approval and waiting on the paper you have two options...
1. Apply with the what you have and wait for the consequences
2.Wait for the paper and not do a concurrent apply. In this case there is a chance that you'd feel sorry if USCIS accepts the 'online LC status'.
I for one would always go with option '1' than to feel sorry later.

Is there anyother lastminute scenario possible. Like getting the approval by 12 noon. Flying to Nebraska and delivering it ourselves. ( very very remote possibility)
I guess it is going to be very tough for people who get approved next friday. And we know that Friday approvals are more.

they wont accept application by hand, it has to deliver through fedex (probably you can have an ariel view of the office in nebraska,,just kidding)
