All aplications have to be post marked before Aug 17th and not sent before Aug 17th...
consider a scenario :
Postmarked : Aug 10 but did not reach until Aug 18 th ..will they deny it...? No
so waht all they care should be postmark date and that should be with Aug 17th 11.59 p.m ... thats what my assumption is ... so far with my lawyer , i was discussing the fact i get my approval on Aug 17th 5 pm what to do also ... he never told me anything otherwise ... pls clarify if anybody has any other insight...

Actually 6 approvals today...tzones77 entered the approval date as '04/08' instead of 08/08.

& so, he got his LC in minus 4 days :-) He got LC 4 days before he applied

A36: As previously stated, USCIS will accept properly filed Forms I-140 filed on behalf of aliens with a priority date on or after August 1, 2007; however, pursuant to August Visa Bulletin No. 108, USCIS will reject any concurrently filed adjustment of status applications filed by aliens with a priority date on or after August 1, 2007.

YES .... if your PD is July 31st or before, you can file up to Aug 17...they have to get application on Aug 17, not 18th though....but anyone with PD 31 jul or before qualifies to apply for I485...that is confirmed by uscis already per their FAQ 1.

It means that if you have your LC approval by August 17th and your PD is on or before 07/31/2007 you are eligible to utilize concurrent I-140/485 process.

My employer filled I140 last week, As they denied to file I485 concurenly.
They said will going to fille I485 after I140 is appproved.
My PD is March'07, are USCIS accepting I485 application after Aug' 17 because my PD is Mar'07.
Can you guys confirm this please?.

I think your employer is playing games. You won't be able to file i485 after aug 17 for a LONG time, years. Doesn't matter if your PD is Mar 07 as that won't be current again for a long time. I 140 approval will take a long time it seems, you need to file the I485 before Aug 17.
These seem to be process for filing I 485 if already submitted I140.

Dont let your employer fool you. I 140 approval will come long after aug 17 and you will miss out on aug 17 deadline. You can use the "will help me get longer H1B extensions and help in travel ease" etc to convince them. I485 is simple form, you can fill it out yourself and have everything ready and convince them with all you have to allow.

USCIS will not accept any applications after Aug 17th.
Don't miss out this oppurtunity. We are stuck at the mercy of the analysts working on the case and we have no way to change the outcome. But you have a golden oppurtunity. Pester them enough. talk to your manager, director whom ever possible and file 485. They would definitly understand your situation. Let them know how important it is. If they don't listen and if you miss the oppurtunity then I would say there is no point working for them.

Priority date according to USCIS is the date when I-140 is received by them.
We lost it guys... I confirmed this with my lawyer too... Your Labor must have been approved by 31st July and then E-file 140 same day !!
Can this we confirmed ? I googled it and everywhere I am hearing the same thing... Somebody pls confirm...

It is for NIW (National Interest Waivers) who doesnt need Labour Certification and can apply directly I-140. So for them I-140 filing date is the priority date.

I strongly recommend that you to talk to Murthy.com or Immigration.com lawyers today to see if you can apply I485- by yourself.(It may cost couple of hundred dollars but that's peanuts at the point where you are)
You may need only I140 information from your company.
DO NOT TRUST YOUR EMPLOYER!!!!!!!

GUYS COULDN'T believe the timing. I typed Jai atlanta and immediately got the call from atlanta PERM processing center. They actually replied for the phone message I left them so many times.
They told that it is still in process and they cannot let me know the time frame. I am happy atleast they called me back. She was polite in answering. I am glad they replied to the phone message.
