I am one of the most un-luckiest and most unfortunate guy on planet earth. My PERM labor has been pending in Chicago for 2 months, since April 24! Expecting to get certified anytime soon.

I called up the 202 number and spoke to Ms Anderson. She was kind enough to speak to me. I explained my situation. She agreed to contact the Atlanta PERM center and have someone get in touch with me. Though she mentioned the same crap about individual attention to each application etc. I told her that, if she can help us out, it would really save us a lot of grief. Lets see who contacts me now from the Atlanta PERM center.

I called and asked to speak to the person incharge of the Atlanta PERM Center. The receptionist transferred me to Ms. Anderson. When I started telling about my situation, she asked me to contact Atlanta PERM center as they will be able to give a better response than she could. But I informed that I have called, emailed and faxed few times for the last few weeks and have not heard anything from them. I also pleaded that I have no clue how to get hold of anyone and who should I be speaking to get my problem resolved. She took my name & phone number and told me that she will get in touch with Atlanta PERM center and have someone get in touch with me.

This is related to labor certification process at the Atlanta PERM Processing Center.
PERM applications from Mid-west and West cost are processed at Chicago center which is having a turnaround time of 8-10 days while Atlanta, which process applications from the East cost, has turnaround time of 130-160 days.Currently there are 1000's of PERM applications pending at Atlanta PERM Processing Center, some dating as far as early part of 2006. There are people waiting for their labor applications (First stage towards attaining permanent residence) to be approved for more than a year. PERM Centers were established to process applications in 90 days, but there are 1000's of cases that have been pending for more than 6 months now. There is no visibility into the process, it is slow and makes life tough people who are here on an H1 or other work visas.
Dept of State has just came out with the new visa bulletin which allowed all the applicants with the PERM approved to move to next stage of their Green Card process. Thus it is very important that Atlanta should process application at the same speed as the Chicago to have parity and fairness. But this is not happening and applicants who are on the East cost are paying heavy price for living in this part of the country.
A person who applied for PERM two weeks ago at the Chicago ( because he lives on the west cost) would get approved in 8-10 days and would be able to move to the next stage of Green Card process. However, if a person apply to the Atlanta center would have to wait for six months to get his application approved. In the present scenario when the visa dates are current, west cost people are moving rapidly ahead in the GC process. It is not because they have done something unusual but because of the pathetic working issues at Atlanta center which is taking 100 times more time in doing the same thing which its counter part (Chicago) is doing so quickly and efficiently.
I hope as a vibrant media outlet you would look into the issue and help all of us by asking Atlanta PERM center why it is failing in providing fair and equitable treatment to the applicants of east cost in adjudicating PERM applications. Are the Govt officials at Atlanta working according to the US constitution which emphasize on equality to all irrespective of cast, creed and REGION?

My employer contacted the Atlanta Senator. Our attorneys advised us that we will have a better chance if we contact the Senator of the State where the problem is. Please try to do the same thing through your employer. It will be a stronger case if they do it. These are Fortune 500 companies.

Common guys, it does not really matter if the GA senators contact or any other senator contacts Atlanta PERM Center. Since DOL belongs to federal government and senators work at federal level, your local senator from your state should be able to help you. Say if you are from NY, senators from NY can contact the PERM center, if you from TN then senators from TN can contact on your behalf. Your local state senators have more obligation as you reside in the state they represent and have an obligation to take care of their constituent members. So contact your local senator from your state. You don;t necessarily have to contact GA senators. But it does not hurt to contact them. You can find the contact info of your senator at this page

According to DOL, any individual should not contact DOL directly. Any queries should come through your attorney or your employer. Then why you guys are sending emails/phone calls to DOL. That could impact DOL decision on your case. Better to escalate the issue through your state senators or news papers. I am sending emails to newspapers/senator

Thats right. People(or your attorney/employers) from these states need to contact their senators and request them to speak to Atlanta PERM center to expedite the processing of our applications. It appears that there were 3 approvals yesterday from this center and hopefully our efforts are bearing some fruits. So please keep up the intensity and call the Washington DC office and the Atlanta PERM center and speak to someone or leave voice messages. Also, continue sending emails too. DOn't let it up and think that you have called once and you are done. Its a long battle for us and we need to keep up the pressure on them. So keep continuing to call/email/fax. Each time explain your situation,problems, issues in an different angle and REQUEST them to quickly clear the backlogs. Please postback on this thread if you get any response from them. That will give us a good idea of their thinking and what are doing to address this issue. So please continue calling today. All it takes is 5-10 minutes of your personal time and is no big deal.

Just did some calculation: Total number of cases filed in Feb and reported with trackitt are 64 cases; 41cases (64%) has been responded; and 23 cases (36%) are pending. If at average 2 cases / day, it will take 11 working days to clear up Feb (to July 11) and continue to March or April, assume independent day has no impact on them. If independent week at 1 case per day, it will takes 14 working days (to July 17) to finish up Feb and move on. Of course there is always a handful of people never update their status on trackitt.
March number is another total of 62 cases, none of them has been touched. If at 2 cases per day, it will take another 31 working day starting July 17, and that is around Aug 29 to clear up March.
During the last couple of months, the actual speed is not even 2 cases per day. It is 1.47 case per day and in a random fashion. I assume that they have realized the issue and had put more stuff working on it. For this reason, I give them a 2 cases per day speed. So we have to push them harder, especially those people who filed recently. There is still some hope but we have to hurry.

I got a return call from the Atlanta center
she said it takes 90 days....but due to high volume of work sometime it tyakes more time
She was not willing to divule any other info
& told me that ask ur atorney to follow up

Good analysis testit. It makes all the more important for people who applied recently to put in additional efforts to make the cut. If not, the priority dates will retrogress and we will be waiting for years together sitting doing nothing. So please call/email the Atlanta PERM center and the Washington DC office to have them assign additional resources to clear the backlogs. Its in our interests if we can have them clear the backlogs before the end of July. Any more delays, will make our situation very dicey and make us hang on to just hope.So please keep up the efforts.

My friend, only MONEY talks in this country especially if its attorney's we are dealing with. I don't think we can directly establish communication with AILA. We need to be member of this association to talk to them. Only our attorney's can persuade them to take up our cause. But, our attorney's are too busy counting the money than doing any deeds for us..but it never hurts to try. So, send emails to AILA, your attorney and seek their assitance.

Yes. june22perm, you are right once July goes. Now most of attorney are busy with current july 485 case filing. I won't say they are stupid. but when time move on, they will realize the so many case pending in ALT after july, which are their business after July. They are willing to hold us and keep busy continuously now. Attorney are always money animal. They are too smart, also too stupid sometimes. Ourselves are the only human beings we could trust now.

well yes attorneys want to make money but what about your employer, they are not going to be happy especially if someone who just got LC can go ahead with I 140/I485....so they are not going ahead to check the status regularly. thats the case with my employer....not for the ones who created sub accounts but there are lot of employers who have not done so and choose to check the LC status when they want to or have asked attorneys to check it once in a blue moon.....SUCKS

Okay, when you guys call ask to speak to the "person responsible for the Atlanta National Processing Center" and then speak to whoever she tranfers the call to. It does not necessarily have to be Ms. Anderson. briefly explain your situation and then request them to have the Atlanta Center process our applications faster.

Sorry for my ignorance friends. I don't able to understand why is it before july end. If priority dates will be current until end of september why july matters? Can any body help me to understand this.

As of now, the dates are current only till July 31. We will come to know the status of August only in the August Bulletin which will be released mid july. September end is just a random guess by people like us.
Here is another news article I found. So Mr. Carlson is not the one to be contacted.

The U.S. Department of Labor (DOL) announced in August 2005 that its current Chief of Foreign Labor Certification, William L. Carlson, will move to the position of Regional Administrator of the Boston region on October 1, 2005. This is one of several moves within the DOL sections, all scheduled for the same date. Mr. Carlson's previous duties will now fall within the purview of John R. Beverly of the Office of National Programs Administrator.

The role of the Chief of Foreign Labor Certification Division impacts many MurthyDotCom and MurthyBulletin readers. The Chief of Foreign Labor Certification Division has the overarching responsibility for the PERM labor certification process, the labor certification backlog reduction centers, and labor condition applications. In some instances, changes in leadership do not bring about any quick alterations of policy or practices, though there is always a possibility that the change in leadership will, in some way, affect how any one of these operations is handled. Your math is correct, but the conclusions are flawed. Last year, a total of more than 130000 perm applications were processed. This did not include pending applications. If you distribute only the applications (not approvals) evenly among ATL and Chicago, you have 65000 applications that were submitted. This year is no different. How many of them are reported on trackitt? About 650 give or take a few. We are half way through the year, which means that we are talking about information avaiable through trackitt for 650 of roughly 35000 applications. This is less than 2%. The indicators cannot be correct purely because of the disproportion in true volumes and volumes avaialable on this forum. Most people who get approvals in a reasonable time dont even report it on this forum. Every one is frustrated and this forum is kind of a vent for our feelings, but we dont need to over-analyze the statistics available out of this forum

Guys, bad bad bad news. The stupid new immigration bill just passed the test vote in Congress. They probably will vote on it on Thursday or Friday. Once it gets passed, the new point system will kick in and the quota for current EB immigrants will be cut down. So we are probably the most unlucky group. We cannot file our I-485 now but once we get our PERM approvals, say, 4-5 months later, the new bill will become effective and the LCs will become meaningless. We will have to face the huge retrogression forever or we will have to give up the LCs and compete with those illegals and people with US citizen relatives.

You are right. But for the bill to become effective, it still need to pass the house and there is still a month or so for the new laws to be implemented. So we have this short window of opportunity for the next month or so, wherein we can file I-140 & I-485 if we can get the labor approved. But for that to happen, damn Atlanta center idiots need to start processing our applications. So we need to put in extra efforts to have them start processing our applications. No one knows for sure, how this immigration bill will screw us and to what extent. So we need to renew our efforts and put a LOT of pressure on Atlanta center to allocate more resources to clear our backlogs. If we do not do anything now, we will regret to few months down the road. So please call the DOL office, Atlanta PERM center, Senators and have your attorney's talk to AILA. Please , Please , Please do not delay and be shy and not worry about it. You need to understand the gravity of the situation we are find ourselves in. Please do whatever you can in your capacity to get something done within in the next month. There are a lot of provisions in the new bill that will HURT us real bad and we have to everything we can to avoid getting into that mess. SO PLEASE CALL/EMAIL/FAX all the concerned people listed on this thread.

I asked my attorney who will she be contacting to solve this problem (my 6th year H1B expires in August with no option of 1 year extension). No, I think Carlson has left the Foreign Labor Certification in 2005. Here is another report by AILA: "Job Change for Chief of Foreign Labor Certification(20 KB - 7/29/2005), Labor Dept. announces that William Carlson, currently Chief of the Foreign Labor Certification Division, will become ETA Regional Administrator for Boston. Current Office of National Programs Adminstrator John Beverly will assume full responsibility for the Foreign Labor Certification Division's programs. AILA Doc. No. 05072965"
So now, the head is John Beverly. This is confirmed by another press release of AILA. "Thursday, February 2, 2006, AILA's DOL Liaison Committee had a telephonic meeting with John Beverly, Acting Chief, Division of Foreign Labor Certification, and several staff members from the labor certification program..."
So I believe John Beverly is the one who is in charge of Labor Cert in ETA. His contact info is as below (collected from the Internet. Haven't tried yet)

From what I understand, Dr. Carlson moved to Boston in 2005, during that time Mr. Beverly was an acting chief (2005-2006). Looks like they closed the Boston office and Dr. Carlson is back again.
Here is a document from January 2007 which mentions Dr.Carlson as Administrator, Office of foreign labor certification. (page number 1650...page 2 of the document. Check the right most column)
