Re-Filing : Identical Applications

The DOL was asked how they interpret the requirement that, for re-filing and maintaining a priority date, the new case must be "identical." If an identical case is re-filed under PERM, the PERM case should be able to retain the earlier priority date of the original labor certification filing. If the cases are not identical, the priority date from the original filing is lost since that case is treated as withdrawn once a re-filing is requested. In such a case, the DOL will use the PERM filing date as the priority date. Therefore, the DOL's answer to the identical case issue is critical. The DOL answered that they are using a literal interpretation of the word "identical." In the example given, if the employer has moved to another address since the original filing - even if it is on the same street - the new case would not be considered identical!

¾ Corrections can not be made to an application after the application is submitted under PERM. Once an application has been electronically submitted or mailed, it is considered final and no changes to the application will be permitted. This applies to typographical errors, as well. If the employer believes changes and/or corrections are necessary to the admissibility and/or appropriateness of the application, the employer should withdraw the application and file a new application with the changes and/or corrections. (For withdrawal information, see the separate FAQ on procedures for withdrawing an application.)
NOTE: All accurate recruitment information from the prior application, if still applicable and current, can be used in support of the new application.

I just contact my employer now and honnest brother I don't know what the hell he's talking about .he talking about their gonna do some substitution if I get approved.they didn't widraw my case . .and I just checked again my perm with the password and it says in process .I don't know what to do .I M LOST . I know its over for me. and I can hane a denial because they being playing with my applicaion.he telling me also that the application can be denied only after 30 to 45 days after its reception by the dol .after that period most of the application are subject of approval.

Guys, I got approved today. My docs were filed in Apr towards the end, I think 24th. I hope all of us on this board get cleared and can meet the deadline of Aug 17th. God Bless

you should consult another lawyer....yours is playing games it seems |
Guys, Can anyone tell me if PERM had to get approved before July31st in order to file before the deadline of Aug 17th?
If this is true, there is no benefit of any followup with DOL Atlanta at this point and we have to wait for October bulletin.

Sorry to hear about your case. Please take all your case details to a supportive attorneys like immigration.com or murthy.com and find out the Ins and Outs of the case. It may cost you around couple of hundred dollars but you will know your right path.
DO NOT RELY ON ANY INFORMATION FROM YOUR EMPLOYER OR ATTORNEY, SINCE THEY HAVE ALREADY SCREWED YOU ONCE. Do NOT LET THEM know that you have taken your case else where. Once, you have clear picture, FIND A NEW LAWYER...and convince your employer. Do not let them know until the last minute and more importantly DON'T GIVE THEM ANOTHER CHANCE...

About attorneys screwing up your information :
Well, in my case, my attorney had sent me screen shots of online forms that he filled for me..
That way, i could review the form and give my GO and then, he pressed the submit button.
I guess, we all should push our attorneys to send us screen shots of information about us... especially when it comes to filling forms online.

we had all late apr apprls yesterday, 4.20-29. both today are May 21,17. What do you guys think? Me being May 29, I am ok ok optimist now.

agreed manoharc, again, as i think it was vdlrao who pointed this out or spd,
they get processed in FIFO by the desk not necessrily on the whole.
its like standing at the train ticket counter, one line moves faster than the other because the clerk is fast. so, again, using the same eg.g if they receive 100 apps per day an they have 10 analysts, they devide 10 each.
after that its just our luck if our a particular app goes to a HOV lane or right lane.
but, yes, is does look like they picked up a little speed (9 days in aug is way cool as compared to 31 days in jul) and all desks are now in late apr or even MAY. if you notice, not many people from before PDs are complaining on this forum anymore, its only us, late Apr, May, June. so i guess they are not coming back to update.
so, bottom line, being may 29 meself, i am a little optimistic, but then again, its too tight a situation to feel very comfortable.
