this is the email i got from my attorney, "we need the orignal approved labor certification before we can file your I-140 and I-485. We cannot just file with evidence that the labor certification was approved. ". So, looks like even though we get certified status online, we still need hard copy to apply..
for me from tomorrow, it doesn't matter if the labor is approved next week, next month or next year...
|
You are right. Without hard copy we can't apply for I140 and I485.
|
Just got a mail from my lawyer... my case is STILL IN PROCESS.. :-(( uwwain uwwain
|
IT DOSEN'T MATTER ANYMORE........
SHOW IS ALMOST OVER GUYS. LETS HOPE AND WAIT FOR THE SEPTEMBER BULLETIN. NOT FAR AWAY.

My lawyer seems to want hard copy too, so for me it's too late. Plus I'd need stuff from my employer and they are v. difficult and so i needed time for that too. getting it next week won't help me. as is i stretched my hope till today... would be crazy to continue hoping now...
sorry :(

PS,Amal...if you have waited thus far canceling your vacations...you may as well want to hold on for one last week. Just a blind thought of mine...of course you will have your own individual situations...and decisions to make.
Have a nice weekend guys...

|
guys - I got my orginal to our Law office in Chicago.
approval aug 06
original aug 11
also here is an email ot our employer for our inquiry sometime last week. this might help us resolve some questions abt the copy of original LC here.
+++++++++++++++++++++
Case: {A------} was recently certified and the original certified 9089 was mailed to the employer’s representing attorney or agent (if applicable). A copy of the final determination letter was sent to the employer’s contact as well.
If the original certification is not received within 15 days of this mailing date, please use the following instructions from our FAQ website (http://atlas.doleta.gov/foreign/faqs.asp) for requesting a Duplicate Certification:
Requests for a duplicate ETA-9089 can be initiated by the petitioner by contacting the Department of Labor (DOL) or by requesting that CIS assist with obtaining a duplicate labor certificate ETA-9089 from DOL. The following steps are suggested when requesting a duplicate ETA-9089 through USCIS. Please include on the top of the I-140, Petition for Alien Immigrant Worker, a cover sheet (preferably highlighted with colored paper) stating the following:
LOST OR MISPLACED LABOR CERTIFICATION, REQUEST FOR DUPLICATE, DO NOT REJECT
On the same sheet, the following information should also be included:
1. Attorney name;
2. Petitioner's name;
3. Beneficiary's name;
4. ETA case number;
5. Priority Date;
6. Specify whether you want USCIS to initiate the request for duplicate certificate ETA-9089 or you have contacted DOL to initiate the request for duplicate;
7. Proper fee, signature and all required supporting documents;
8. A print screen showing that the case has been certified;
9. Provide the reason(s) for requesting that the Service Center secure a duplicate, approved labor certificate from DOL, e.g. "Case was certified, and original approved labor certificate was never received in the mail."
Once the duplicate certificate ETA-9089 is received by USCIS, the petitioner and/or his representative will be contacted via a Request For Evidence (RFE) notice in order to secure the petitioner's signature on the duplicate certificate. The certificate must be signed by the petitioner before USCIS can accept it for filing purposes.
* Petitioners must send the signed duplicate ETA-9089, along with a copy of the RFE notice requesting the signature. Failure to do so may result in significant delays in processing or denial.
* Petitioners are reminded not to submit concurrent I-140 and I-485, Application for Permanent Residence, when submitting petitions without the labor certificate, and with a request that USCIS secures a duplicate ETA-9089 from DOL or evidence of having requested the duplicate from DOL.
* If Forms I-140 and I-485 are concurrently filed without the ETA-9089, but with a request for duplicate labor certificate, the I-140 may be accepted and the I-485 rejected. However, if the fees for both forms are remitted with a single check, both forms will be rejected.
* Applicants who have submitted a Form I-140 with a request for duplicate labor certificate ETA-9089 are encouraged to wait until approval of the Form I-140 before submitting Form I-485. When submitting the Form I-485 subsequent to approval of the Form I-140, the approval notice of the Form I-140 must be submitted as well, along with appropriate fees and supporting documents.
REMEMBER THAT DOL WILL NOT SEND THE DUPLICATE CERTIFICATE TO YOU. DOL WILL SEND IT TO USCIS.

MAIL FROM JESUS =
Everyone request you to Please email / Fax to Atlanta office, this message from Jesus.
If Jesus would have been present on earth today -
Seeing the Atlanta PERM processing speed- He would have replied
Please forgive them o Lord
cause they do not know what they are doing.
if only they could understand that 1 approval for an immigrant means
less suffering at the hands of consulting company
less exploitation, more freedom
what they are doing are not a normal job
they are in a noble profession
and every time they give a decision more
unknowingly they help a person make his life.
if only they know how much struggle an immigrant goes through
to come to us, to study here, to get his H1B, staying on bench at times
surviving somehow
while his family and parents are far far away.
sometimes a newly wed wife is at home
sometimes a child waiting for his father
the bachelor also travels across the 50 states like a nomad - never settling down, eating fast foods all the time.
building and developing IT for US companies so they grow stronger everyday
all in a little hope of a better tomorrow
the more he suffers, the more Jesus is pained
but I am sure the ones who are deciding are unaware of the pain
cause if they knew.
they will respond. will they.

I would like to send an enquiry to Atlanta DOL as what they are doing is not right and legal.
I dont mind an audit inquiry now.
and i request you all to do something and please send an enquiry fax asap to DOL.
For me if we sit quiet and do nothing, it would be spineless as what DOL- Atlanta is doing is utterly unacceptable.
if you dont understand what i am saying go and see chicago perm cases on this website.
what DOL-Atlant is doing is very unethical and it is clear that it is planned and intentional.
we read on murthy site that PERM people were moved to H1B cases and they were brought back.
bull**** - that is not the truth.
there is someone out there who is against the immigrants even legal hard working intelligent people helping US economy.
but to sit quitly and accept this is spineless and India has seen the result of being spineless for 200 years of slavery.
guys i am going to fight it out.
i just want to know if your mothers did the right thing in giving you birth.
are you really a man or are you born by chance.
doesn't your blood boil seeing this unfairness in this so called US- Land of the free.
the only thing is are you gonna fight it and let it be.
if you let it be, you would be like the fresh prisonor who is sodomised by everyone.
and in life you will die again and again
if you fight this one time right, you will know that atleast you faught for your own independence if not for your country.
It is time to act and it is now.
all of us togather can file a case against Atlanta PERM center.
as per law there are many who are over 90 days limit.
There is a good chance that we will win and in that case they will have to take our applications even after 17th Aug.
Let us do joint litigation.
even 3 people can start the action, the heroes will start, wise men will join. Cowards will benefit too.
Let us JOINTLY LITIGATE against Atlanta PERM
they will be in deep shit.

this is not a reform Bill so good news is its not going to senate/ congress for debating.
These are the orders from white house to Home Land security to improve immigration within the existing Law.
Please Read this care fully, and Links
"Today, Homeland Security Secretary Michael Chertoff And Commerce Secretary Carlos Gutierrez Announced A Series Of Reforms The Administration Will Pursue To Address Border Security And Immigration Challenges. The following reforms represent steps the Administration can take within the boundaries of existing law to secure our borders more effectively improve interior and worksite enforcement, streamline existing guest worker programs, improve the current immigration system"
it s actually orders from white house,
so all wat we need is to wait and see when it will get effected
"20. The Department Of Homeland Security Will Extend The Visa Term For Professional Workers From Canada And Mexico To Attract More Of These Talented Workers To The United States. The United States must compete for foreign professional workers, and those who elect to lend their talents to the U.S. economy should be welcomed with open arms, not given a bureaucratic runaround. Yet the roughly 65,000 workers who enter the United States each year on the TN visa must go to the trouble of renewing their visa every year. This regulation will extend the TN visa duration to three years – the same term as other popular professional visas"
"22. The Administration Will Reform And Expedite Background Checks For Immigration. Current mechanisms for conducting immigration background checks are backed up, slowing processing times and endangering national security. The Administration is investing substantial new funds to address the backlog, and the FBI and USCIS are working together on a variety of projects designed to streamline existing processes so as to reduce waiting times without sacrificing security. U.N. Begins Meeting to Discuss Atlanta Labor Certification, Work Conditions in Cambodia
PSNewswire.com
The International Labor Organization (ILO) of the U.N. kicked off a four-day regional meeting in Stockholm Tuesday aimed at improving working conditions worldwide.
"Atlanta Labor Certification (ALC) and the situation in Cambodia remain the most pressing issues we are facing today," Swedish Labor Minister Nils Freivalds, the meeting's chairman, told participants. The participants are expected to endorse The “Missing Application Statue”, a memorial aims at educating the public worldwide about the Atlanta LC tragedy of August 07, when hundreds of thousands of applicants and their families were practically prohibited from applying to permanent residency and gaining labor portability. Those victims might have to wait for several years to get another chance. Atlanta shelved their LC applications for times ranging from 2 months to 2 years while the LC applicants at Chicago where getting results in 2-8 days.
“This statue is created to remind us of what has happened and what could occur if we forget the past. May the tens of thousands of applicants in Atlanta and their families always have a place in our hearts. And may their suffering not be in vain.” said Freivals.
This is the second time a UN agency interfere in an issue related to Atlanta Labor Certification. The first time was in May 2007 when the General Assembly voted to prevent the usage of the term “Atlanta Processing” referring to extremely slow and inefficient systems. The term was considered very cruel and inconsiderate toward the victims and their families.

At last, just in time.

hey LC tracker, this news felt good as someone is noticing our problems.
Could you please post the link for this news.

CONGRATS DSIKKA!
I'm Happy for you. It was nice sharing our views on the forum

bsnewswire and psnewsire are not "real" news sources, sorry. Wish it were real news. I think all of us that have no hope left cause at this point it doesn't matter. Atlanta DOL might as well stop working and just make sure the hard copy approvals of those certified goes out in time.... I think those of us left hopeless should do emails last time about how this has broken the spirit of all of us...one final word before being silenced I guess. I will do my part. they can approve mine tomorrow and it won't matter now...go atlanta...you have at least achieved one thing...breaking the hopes/hearts/spirit of so many...you get A+ for that at least...may god still bless you cause I don't think you know what you have done for many.
|
Guys,
Please do not use this website and the audience here to promote BS blogs else where. Most people will think that the article provided above is true.
