I just called and talked to a real person. She said that they are aware of the situation and working towards resolving, and that we should see progress in the near future.

Oh man, mine is Feb 15, I sure it comes through quick, my head is about to burst each day.

This immigration bill talk (although it could still die in Congress) really upsets me too. Especially with the PERM taking 5 times longer than I expected.

we need to have birth cert to file I-485, if you don't have, get it from Indian Embassy http://www.indianembassy.org/newsite/misc_guide.asp. Be prepare to have all the required below docs to file I-485, atleast save some timing while you file 485

· MEDICAL EXAMINATION RESULTS IN SEALED ENVELOPE for you: http://149.101.23.2/graphics/exec/cs/index.asp
· Six (6) pictures each for you and your spouse (see attached USCIS standard);
· Your 2006 & 2005 1040 US tax returns and W-2 forms;
· Your birth certificates;
· A complete copy of your passports including all blank pages;
· A copy of latest I-94 Arrival Departure Records with admission dates;
· Copy of marriage certificate;
· Copies of all I-797 approval notices from the USCIS;
· Copies of three most recent pay statements.

Looks like they are not following FIFO...and 1 approval in a Day is not really good sign...

from what it looks like the ATL center is taking in a Random fashion a month worth of cases and does the processing .. we are seeing approvals of START / MID / END of Feb month now ... and from the last 2 weeks , we dont have any April months approvals .. so may be they have started the FIFO and considering a Month worth of cases at once ...

but with the speed at which they are processing , i am loosing hope of meeting the end of Aug date too ... 1 case a day ...it sucks ... maximum we have seen is 3 cases a day .... there is something wrong inspite of all our crys ...i am not sure we are heard yet ... with the current speed it would take 50 days to complete March listing posted in trackitt ... Not sure how many have applied and not listed in trackitt... but i can say that this trackitt listing atmost be just 10 % of the entire people applied.... loosing hope ....

is there a way we can get to know on how many totally have applied in Atlanta center alone .. ???

Apologies. I was wrong. John Beverly was only an interim officer of the Foreign Labor Certification. He is not within that division any longer (and actually he is a technology head with ETA now. see the DOL website).

So actually William L. Carlson came BACK to the Division of Foreign Labor Certification of ETA. So he is the right person to contact. This is confirmed by various news reports (including new york times) as most recently as May 17, 2007. So I believe Carlson is definitely the guy running the show now.

Very good find june22perm. Thanks for the research and updating us. You are indeed right. The following three people appear to be the key personnel we need to contact and put pressure.

Of all the three, I think William Carlson is the head of the Foreign Labor certification and Charlene probably just manages the Chicago PERM center(I am not sure). There may be a similar director for the Atlanta PERM center. We need to try and find out. Also, we should contact Melanie too. We need to start calling these three people starting today. We need to renew our efforts. If anyone can find phone numbers/emails for these personnel please post it on this thread.

As far as I searched, it is the same phone number (202) 693-3010 I got, for all the people in that team. Let us call the same number today and ask for a specific person by name. If we are able to reach any of the people on the list, let us explain the situation to them.

Apart from that, please print out a letter with a "To" filed and fill up the name, title etc of those ppl and faxx it to EACH one of them. The more we bug them, the more they'll understand the intesity of the issue.

PLEASE DON'T BE SCARED THAT YOUR APPLICATION WILL BE IN TROUBLE. The maximum they'll say is to ask the employer/attorney to contact. Nothing more will happen. There are people in this forum who got approvals in the last couple of days and they HAD contacted dept of labor.

Please post updates as soon as you call/fax

Yesterday I have called that number and said the processing time differences between atlanta center and chicago center. She said she has no comment on that. And said they know the situation at Atlanta nationla Processing center.

My paralegal replied me that she cannot file a complaint to DOL because i'm within the time line( with in 120 days). My perm is applied on mar19th, which is around 100 days ago. Also she is telling DOL will not accept any complaints regarding this. Any advice friends.

Guys, my employer got another reply from them like below:


Applications are processed in the order they are received. Once the Analyst reaches your case in their queue, based on the principles of FIFO (first in first out) it will be reviewed and official correspondence will be issued.
However, because each application is unique, processing times may vary depending on the specific circumstances of the case.
The policy of the U.S. DOL/ETA National Office prohibits the expediting of applications.

We apologize for the delay.
If the case was mailed in, then the employer and representative must await correspondence from this office.

To check the status of your case filed online: go to the My Applications tab, then the Search Cases tab, you can enter your case number and see the current status. You can also search by a partial number. For more details, see Page 40 of the User Guide by clicking the Online Help link at the top of the PERM web page.

Repost it so everyone can see.

Hi folks, here is some data:

DOL received 204,280 cases from March 28, 2005 - June 1, 2007. Around 95% perhaps are already completed by now. That means they receive 903 cases /week/center on average (assume two center receive equal amont of cases). If you like more recent data, two centers received 48,400 cases during the first two quarters between October 1, 2006 and March 31, 2007. That roughly is 930 cases per week per center.

Based on that, I estimated that Atl PERM center right now should have 17.5 weeks * 930 cases / week = 16,208 pending cases from March 1, 2007 to present. Only about 1.3% (213 cases from 3/1/07-now) folks have registered here at Trackitt (Chicago lower). So even we all cry all together I do not know how much noise we can make. We have to see 2.44 cases responded each day here to make it flow-in and -out even. They should process 186 cases per day to make it even. (apologize my previous calculation error).

Friends, just wanted to get a clarification. I'm working in a client's location in New Jersey and my employer has offices in NJ, CA and many other places. My labour has already been filed with Atlanta center and I'm waiting for the response. Is there any way that I could file in the Chicago center since my employer has a office in CA.

Same Situation
My client and employer office are in Maryland but employer HR office in Missiouri, i haven't filed PERM labor yet, i'll be filing next week, Can i file at chicago center?, i know maryland labor goes to Atlanta, i just wanna aviod Atlanta center.

The US senate has taken up the immigration bill S 1348. The bill reduces the number of green cards for EB1, EB2 and EB3 categories from 140,000 to 90,000 for the first 5 years and introduces a new points based merit system.

testitit - From the Data that you provided, roughly 17,000 cases pending. I don't see them clearing them by end of July. if they receive 950 cases /Day that means they have 11,400 cases Since April 1st. That leave 5000 cases file before April. If we take the month of March (950*4 = 3800)and subtract that from 5000, it leave 1200 cases.From what I read, I think all those people you have filed in Feb should have a good shot at July deadline.

Mine was filed in March 2nd week.

Just my opinion.

this is not intended to offense anyone .. just stop and think for a sec.

Guys, I know we are at our worst times of our GC processing, and atlanta PERM sucks big time ... what can you do?? flood their email servers with inquiries and requests to process your PERM labors ?? or make phone calls ?? or protest infront of atlanta office ??

Dear friends, none of them will work ...Its proven .. we've been fighting for fair rules and faster GC process since the day it got retrogressed in 2004 (we formed the immigrationvoice.org to address that) but its of no use. Suddenly, one day DOL made all the priority dates current. If any one on this forum are in US during 99 or 2000, you will remember they made all the dates current during that time also ..

DOL (ex INS) is a crap and a messed up system ... don't spoil your mental health by thinking too much abt this .. If it has to happen it will happen one day ... GC is not every thing.. our health is more important.. dont get depressed .... You live your life to the fullest with out the GC also.
