People, please send a detailed email explaining our troubles with Atlanta PERM Center to the following people, who seem to be the personnel incharge of PERM
Pasternak, Brian - ETA", "Jean-Pierre, Isabel - ETA" , "Henderson, Mada - ETA":

Be very polite and request them to expedite the processing of our applications. We do not act, no one is going to do it for us. If we wait for them to do it, we will be stuck there for ever and we will HAVE to start all over again under the new point based system. All the time and money you have spent so far would go down the drain. So, people who really don't care for GC can sit and relax and keep waiting rest of their lives. People who really want to get on with their lives, do need to act and put sufficient pressure on DOL and PERM center to do something for us to get out of this mess. I know what it means to wait for dates to become current as I have waited for 4 years now. So listen from a person who has gone through this mess. You can only learn from my experience and but you definitely do not want to repeat and go through the horrible time I have been having waiting all these years and putting up with my employer. So don't simply keep reading this threads. Call/Email/Fax the above personnel and request them to fix the atlanta center. Its my humble request to all of you.

I have sent a email to the email ids above .... the email prepared by our folks earlier & was posted in this forum... Just modified little bit ... with some BOLD & RED markings on the key points ... ...
Guys we have 2 months optimistically speaking (July / August) ... we need to step up outr efforts now to make the 2 coming months count .... if we miss this we are stuck for another 5 or may be more years for our next steps ..never know with new coming provisions we will still be able to continue on our h1s for longer years ....and filing GC statying with a employer for 5 yrs.. it sucks .... hope anybody spent some years can visualize what i say .....
so when we have some life , lets do some quantitaive work and try and do our best ... it cost nothing sending emails ... if it comes good we can all reap better fortune ...so THIS IS OUR LAST BOAT ... WE ALL NEEDD IT BADDDLY .......

Friends,
Even if our labor got approved this week, there are very slim chances to utilize this oppurtunity to file our 485s while it is current. It could take couple of weeks to get the 485 document preparation ... etc
Looks like visas are going to get exhausted soon in july ... and will be unavailabe until 10-01-2007, and as you guessed will be retrogressed to somewhere in early 2000's or late '90s (as happend last year)..
check this out .. http://www.immigration-law.com
Dont get panicked or depressed ... Enjoy u r life as usual .. Hope good times come soon ..
|
Mr. Reddy, please STOP discouraging people from doing the right thing. People have all the time in the world while they waiting for labor approvals to get their documentation ready for I-485. They can just have everything ready and wait until they receive the labor approval from ATL PERM center. Once they know their labor is certified, they can just use the online printout to file their I-485's without having to wait for actual approval notice provided the dates are current. How in the world do you know that the dates will retrogress to early 2000's or late 90's? It makes it all the more important if your statement is true, that we fight to get our labors approved from ATL center quick. For that we need to do whatever it takes to push their staff to start approving the cases. We have a window of opportunity now until the date retrogresses to file our cases if we get the labor approved. Because of our efforts some of us can get lucky and get labors approved before the date retrogresses. WHo knows, you may be one of those too provided you put some efforts to call/email/fax some key DOL personnel.
If everyone sits on their a** and wait for them to approve and send the notices, you can as well not waste time expecting the labor approval as you may have to refile your application under the new points based system and spend a fortune to kick start that process. I suppose you do not understand the gravity of the situation...
If you are not interested in getting your labor approved quick, just stop visiting this thread and enjoy your life as usual. But don't discourage people who are trying their best for something good to happen for all of us who are stuck at this center.

Well said new2perm. Let us try our maximum best, whatever be the end result.
Also, please read this frm the murthy.com rumor control page. This means we have 100% chance if we get our labor approved before July 31, 2007.
http://murthy.com/rumor.html
Rumor : If the USCIS receives too many I-485 Adjustment of Status applications during the month of July 2007, there will be a lottery to decide whose applications will be accepted for processing. This could happen because almost all EB categories became "current" for the month of July 2007. Posted Jun 20, 2007
Clarification : There is no lottery expected for the I-485 cases filed in July 2007. This rumor seems to have originated based on the recent crisis with cap-subject H1B petitions. In that case, the USCIS received more than the annual quota of H1B petitions on the first day of filing for Fiscal Year 2008, which begins October 1, 2007. Therefore, the USCIS accepted cases for processing based on a computer-generated, random selection. The system of H1B cap numbers and the EB visa number limits operate differently.

I guess preparing of I-485 won't take very long. We can actually start now. We will file I-140 and I-485 concurrently. The medical exam sometimes take a few weeks and is costly. That is why we need to get the PERM approved as early as possible and start to deal with these issues. So I think the statement "got approved this week...slim chances" is groundless.
|
Here's what I am doing. Keep all the documents ready, except for the medical. For which, I have scheduled an appointment for sometime after 19th July, by which time, the visa bulletin for August would be out. If the dates still stay current, then postpone the appointment to sometime after 15th August, and wait for the next bulletin, and hope your labor gets approved by that time.
But if the dates retrogress w.e.f 1st August, then I will go for my medical anyways, and send all needed documents to lawyer ahead of time. coz every hour is precious, in that case, and I would like to be prepared if the labor gets approved in end of July. I know, I would waste precious $$$ in the case that my labor does not get approved.
And BTW, the medical report has a validity of 1 year.
|
I also alreayd got every necessary document ready. Just waiting for perm. although losing hope but still keep a little bit hope.

Dear Friends,
Just to get a feel of our forum's intensity , i would like to know on how many of us , have sent out emails successfully to the emailids provided ... what i am trying to see here is , we just represent a very small % of Atlanta total filers . and if we all dont shout and make noises , then we will not be heard much ... so pls send out emails and update your responses if any ... A one liner will do ...but requires many hands for a successful shout to show our presence ....

Here is a copy of the e-mail text I sent...In case someone needs it as a reference.
Dear Sir/Madam,
Subject: Inordinate delay at Atlanta PERM processing center (compared to Chicago processing center)
This e-mail is to bring it to your kind attention the current lag experienced in Atlanta PERM processing center. There are thousands of applications that are pending with some dating as early as 2006 and the pace of processing has been really slow.
On a sharp contrast, Chicago PERM processing center is up to date and has issued approvals to applications filed even a couple of days ago. This disparity is highly frustrating for highly educated, hard working, law abiding, and tax paying legal immigrants whose future looks bleak just because of their geographical location.
The Department of State has announced that the priority dates would be current for July and that a steep retrogression is expected after that. Hence it has become extremely crucial for all of us to submit our I140 and I 485 petitions as soon as possible, for which a labor certification is absolutely necessary.
On behalf of all those stuck in Atlanta PERM processing center, I request you to look into this issue and get it resolved at the earliest.
Thanks a lot for your time and consideration.
|
I think we are all so angry because of the disparity between the two centers- Chicago and Atlanta. I am afraid eventually they will also slow down Chicago center and that will be it. Nobody can complain anymore..:)

http://www.uscis.gov/files/pressrelease/I140PPSTempSusp062706.pdf
Quote:
This suspension will last for 30 days beginning on July 2, 2007 and ending on August 1, 2007. During this timeframe, USCIS will determine whether it is able to process these cases within 15 calendar days of receipt. If so, Premium Processing Service will once again be made available for Form I-140 petitions.
|
Dream - what does this mean to us. How long does it take to get your 140 approved. Where did you get this information?
|
I bet USCIS made a typo in the PDF file - instead of August 31 is July 31.
|
Last time I checked its was taking about 5 months for I-140 to be processed where as if we do pp it'll be processed in 15 days and they'll process I-485.
They will resume pp after Aug 1, 2007 but I feel if they receive hundreds of I-485s in July they'll find it hard to start pp again.
