Friends,

Good job! Thanks to everyone who e-mailed/faxed/called.

There are more than 300 cases in 'pending' status in our tracker, and we are just 20+ people in action now. Others, please join hands.... It just takes 5 minutes of your time to contact the concerned authorities....and we are all going to be benefitted by that..

So, please call/e-mail/fax asap....let us all help each other !

Great Guys !!! Let us make our efforts continuous!!! infact i am seeing 4 approvals for 06/27 in our tracker ... 4 is a number we don't often see a lot and 1 of them from Mar month... ...looks like the Feb month backlogs will be cleared before the end of this month as we see some approvals .... Looks great to me ... may be our efforts are starting to work ... lets keep it rolling and see what we get ... but may be not good enough to see 7 or 8 approvals a day as per our earlier analysis to clear all backlogs

we will try and communicate to DOL daily once atleast through mails and other means ... i hope we will be heard and looks more like it.... and those who have not done so far , pls join hands with your firends ... we are doing this for ourselves and not for anybody else ... let us make the count to 50 sooner from 25 ...

Guys,
I pushed my Employer and Attorney to contact the Atlanta center and when my Attorney emailed them about the case pending for long, she got the below response from them. Not sure what they mean..Did they start looking at the case where I can expect that to turn out soon, or again a long wait? Any clue on this kind of information to understand how long the journey still takes to get the result...Just panic! This is basically a January 2007 filed case.

Applications are processed in the order they are received. Once the Analyst reaches your case in their queue, based on the principles of FIFO (first in first out) it will be reviewed and official correspondence will be issued.

However, because each application is unique, processing times may vary depending on the specific circumstances of the case.

The policy of the U.S. DOL/ETA National Office prohibits the expediting of applications.

I dont belive they are following FICO....today i see an approval for Feb 29th case..but there are lot of cases pending which were filed before that..

Update on Rejection of June “Other Worker” Adjustment Applications and
What This Means for July

USCIS has confirmed to AILA liaison that it will continue to reject all "
Other Worker" (EW) I-485 applications in June, even if they have priority
dates prior to October 1, 2001, the cut-off date in the State Department
Visa Bulletin for June 2007. USCIS has informed AILA that the Visa Office at
DOS advised USCIS that the visa allocation in the "Other Worker" (EW)
category was exhausted on or about June 5, 2007. USCIS is treating that
advisory from DOS as a determination that there is no longer an "immigrant
visa … immediately available" under INA §245(a)(3). The USCIS implemented
the rejection policy shortly after receiving the advisory from DOS, though
no public notice of that policy was ever made.

AILA believes that the rejection policy is contrary to the regulation at 8
CFR §245.1(g)(1), and has urged USCIS to reverse this policy. USCIS
continues to refuse to do so. A copy of the memo by the USCIS Liaison
Committee to USCIS is attached.

If you have attempted to file an EW I-485 based on the June Visa Bulletin
and it has been rejected, please let AILA liaison know by e-mail at reports@
aila.org. Put "EW Rejection" in the subject line.

What Does This Mean for Employment-Based Cases Filed in July?

The impact of the rejection policy on adjustment filings in July, when all
employment-based categories except EW are "current" according to the July
Visa Bulletin, is of concern. Sources in USCIS have told AILA that
approximately 40,000 visas remain in all employment-based categories, other
than EW, for FY2007, and that the USCIS alone has far more than that number
of adjustment applications in the backlog queue that are ready for approval.
The State Department will also be allocating visas to applicants abroad.
Thus, it is possible that limits will be reached within a short period in
July. The exact date has not been predicted.

AILA members should be aware that USCIS has not finalized policy on
accepting and processing of I-485 applications in visa categories in which
allocation is exhausted in a month in which the current Visa Bulletin shows
visa availability. At this time, however, it is possible that, based on the
treatment of EW I-485s in June, USCIS may again reject employment-based
adjustment applications mid-month, even though the Visa Bulletin shows visa
availability. If USCIS does reject these applications in July, AILA will
want sample cases, with information sent to reports@aila.org, subject "EB
cut-off rejections."

Medical Examinations

Because of reports in some locations of lengthy delays in obtaining
appointments with authorized physicians for medical examinations, many
members have asked if USCIS will accept adjustment applications in July and
later without the medical examination report in the initial filing packet.
USCIS has refused to agree to accept the package without the medical
examination report. Members are cautioned that a medical examination report
is considered "initial evidence," and the absence of the report from an
adjustment of status application can result in rejection of the application,
RFE, or denial of the application under the April 17, 2007, USCIS
regulation "Removal of the Standardized Request for Evidence Processing
Timeframe" (72 Fed. Reg. 19100, April 17, 2007) [AILA InfoNet AILA InfoNet
Doc. No. 07041860 (posted Apr. 18, 2007)], and the June 1, 2007, Interoffice
Memorandum from Donald Neufeld, Acting Associate Director of Domestic
Operations, "Removal of the Standardized Request for Evidence Processing
Timeframe Final Rule" (HQ 70/11, 70/12, AFM Update AD 07/05)[AILA InfoNet
Doc. No. 07062171]. While, obviously, RFE would be the desirable result here
, there is risk that the result instead would be rejection or denial.

AILA Liaison will provide updates as more information is obtained.

I did a quick calculation:
In the forum we have:
There are 8 cases approved in March, 2 in April, 16 in May. Now we can see an average of 2-3 cases approved every day. That could be 40-60 every month.

There are 80-90 cases filed in March. 50-60 cases filed in April. So I guess Feb ppl can get out of trouble in a few weeks while March ppl can get out in probably a month.

Chances are slim for April ppl or later ppl unless there is huge change in the # of approvals per day.

Based on the current trend, it seems that 120 days is the average wait time (i know, ATL sucks!). So that's four months unless something worse happens (like they move people to work on H2B or H2A whatever again). So for March people it's about July, for April guys August... you do the math.

I think the immigrant numbers will remain current at least until the end of August. Maybe September as well (before the new fiscal year starts). Highly unlikely after Oct 1st. But you never know.

yeah, I got the same news. It seems to be true. So basically everything will go back to where it was. Retrogression for Chinese and Indian immigrants. Everyone has to wait now.

They estimated 250,000 people will file in July. USCIS only can handle ~11,000-12,000 per month. You do the math and figure out when they would like to put it at a halt. In addition, there are roughly 17,000 PERM cases pending in Atlanta center right now.

Hello,

The DOL's excuse for the delays is that they were processing H-2B cases. But they hit the cap and there is no excuse for such frustrating delays. Actually, PERM was supposed to end DOL's delays. It is obvious that the disparity in processing between Atlanta and Chicago is ridiculous. A few weeks difference is one thing, but several months is not acceptable. For those with pending cases past the processing date, I would recommend a phone call (or two) to DOL. Leave a message about your case, the filing date, your case number, and ask them to check it out. You may get lucky. Number: 404/893 0101

Thank you Alex. We are aware of the situation at the ATL PERM Center and have been trying our best for the past few weeks to do everything we can calling/emailing/faxing the Atlanta PERM center, DOL office in Washington, but have not had much success. We as the beneficiaries are not able to get in touch with the right person incharge of this Center. They are willing to speak only to the attorney or the employer. We members have been getting the standard response that,DOL is aware of the situation and are working to set things right for the last 2 months. But we definitely have not seen any positive results of their actions. In this regard, we seek your assitance through AILA to see if you can have them talk to the right person at DOL and fix this problem. We would indeed be grateful to you, if you and AILA can help us members get out of this black hole.

This July retrogression is indeed a bad news (if the rumor comes true).. But i would say this is blessing in disguise for people stuck in ATlanta . if it can hold enough for couple of months not more ...

Reason being:
1. In case if all stuck in Atlanta cannot file , then the next chance for us will be around after 7 + yrs for sure ...much longer wait (assuming all our current dated peers have already filed and in the system) .. instead if it opens up when the disparity in centers are sorted out , which will give some justice to all the GC appliants in Atlanta & Backlog centers (who were waiting for years & years alltogether) ..
2. even if we get our labors approved a day after the gate closes , its equivalent toa ticket for a show which is over...

so we can utilise the days to push the atlanta center more to process faster and also give Atlanta center some time for them to come out with a strategy to clear out logs ...

We hope this is for some good for the people stuck ..sorry for our earlier friends , if they have to wait for couple of more months to file ...

I too have been phoning both Atlanta and DOL everyday without much success. Get the standard response "we will speak only to attorneys/employers . . . " I am appalled that I don't have the right to inquire about the status of a process that impacts my life so greatly.

I would say both the delay in the Atlanta center and the lack of transparency are unacceptable and UNFAIR - statistics suggest that living in the east coast is a big disadvantage in the immigration process

Besides calling Atlanta & DOL is there anything else we can do?

On a lighter note - may be if we can somehow link Paris Hilton to the issue media - especially CNN will consider it newsworthy! we may even get live coverage of the process at Atlanta center!!
