Topic: My perm file on 10/31/2007 and audit response time on 12/28/2007.

Dose any one have the same situation as mine?
The lawyer filed my perm on 10/31/2007 and in the early Dec. received the audit notification.

The audit reason is that my job title is not require a master degree. My job title is "****database developer" and DOL thinks it is not require a master degree.

We send "business necessity" from my employer and some proved documents.

The lawyer sent out the audit files on 12/28/2007.

Question:
1. How long will we receive the response from DOL?
2. Is any website that we can check the status with ETA # start with A?

DOL atlanta is taking enormous amount of time lately. My attorney replied the audit on Nov16 still waiting.
You can check the status on dol site if your employer makes an login id for you. or you can just ask the attorney to know the status. its nothing more than on word on dol site. "In Process" or "Certified" etc..

I agree with input posted by "desireuben". I did check with my Attorney too this morning and the reply I got is pretty similar "desireuben" that "DOL Atlanta is taking enormous amount of time lately" and it may take much longer then we are expecting this whole process to take. My attorney replied back to audit on Nov20th & still waiting. I hope these processing centers knows what they are doing?

appreciate your input guys my audit reply is nov 16 as well, but guys what is your gut feeling as to when we might start to see movement on our applications?

my gut feeling is, not very soon. yea its same like back home when govt employee is enjoying vacation when govt is preparing for next election

Audit Notification for business necessity is a recent trend for Atlanta. They are asking for that to almost everybody. I also went thru that. Once your response is send, you should get result soon if the answers have strong backgorund and evidneces.

Hi, it almost the same situation here. PERM filed on 10/30/07 and responded to Audit on 12/28/07 and I am still waiting. Audit was for the business necessity and requirements exceed for position applied.

How long does it take to get PERM approved if it is a "special handling"? sharing your experience will be highly appreciated.

My PERM is pending since May 8, 2007 and I replied the the audit on Oct 17th so its over 3 months since we replied to the audit. No news yet.

just go to

and sort by Audit Reply Date, you will see no approval yet for cases with reply to audit notification later than 11/1/07.

or sort by Approval/Denial Date, we can see they are still working on those cases replied in oct. the average days needed for recently approved audited cases are something around 170 days. and this is biased because they are average for already approved ones. newly approved cases in the future will generally increase the figure.

so, keep patient.

hmmm...lets see....applied on May 4th, audit responded by oct 19th...still no updates. Other colleagues in the same company had the same audit, responded the same time and PERM has already been approved. Just for my sanity, I would like to think of it as random...

Normal processing time is 120 days to receive a decision after employer (attorney) submits reponse to an audit. If a case exceeds a designated normal processing time, the employer/attorney can submit an email inquiry to the appropriate processing center with case information (filing date, audit response date, # of days since audit response was sent, etc.)

In my case, normal processing time of 120 days have passed since audit response date, its well over 3 months. When ever my attorney contact DOL they reply him with their standard email that every case in unique and they follow FIFO. I don't think theey even know the meaning of FIFO.

So do you get any reply after your lawyer made an inquiry after 3 months passed since audit response date? I appreciate you can share with me more in detail? What email your lawyer sent to? Or does your lawyer send the inquiry through letter? If yes, what is the address? Thanks in advance

I cannot personal login to check my status. The only thing I can do is asking my lawyer to check the status on line every month . I believe he check the status in DOL website.

1. EB2/EB3 category
2. Type of Query

B. Does a person who applied for PERM/Labor in 6 th yr of H1, to get an H1 extension which one of the following statement is correct?
1. Labor need to be approved
2. Labor and 140 both need to be approved

In a very unfortunate way I get some solace seeing these messages. I too am in the same boat.
PERM applied in EB2 on May 6.
Received Audit in Oct 2007 and replied back in 10 days.
Waiting since.
Lawyer says Atlanta is taking over 6-8 months for EB2 cases a little less for EB3.
Rajiv Khanna says the same.

Appreciate if we could constantly update each other and keep company.

I need help please and I am really worried about this.
My lawyer prepared all the documents for my PERM and all adds were done with a salary proposed by the department of Labor. Unfortubately It took time my boss tios ign the papres, and the documents from department the salary had expired at this time. The lawyer requested another evealuation of my salary it end up higher they updated their system and their no way they can extend the pl;d document.
The lawyer filled my case afetr 2 months I got Audit it it has been since November 07 and I am still waiting. My boss sign on the application regarding the new salary that the department of labor suggested by among the adds some of them show an amount less than what is requested by the Department of Labor but it is less in $5000 only.
Do you think I am in a big trouble and for how long I need to wait for an answer, please a suggestion or somebnody that used tio have my case will help.

You should hear something very soon. My case is similar. My labor was filed May 8, 2007 and audit reply was sent Oct 18 and they certified my case Feb 13th 2008. Good luck. Ask your lawyer to send an email. Mine sent an email I think about a week back, I don't know whether it had anything to do with the approval but worth giving it a shot.

my perm was filed on 6/8 and audit reply was sent on 10/18. Then in 2 months received another audit which was replied on 12/28... DOL is just auditing to seek more time so 140 backlog can be pushed a little bit.

I just saw that you went through the audit successfullly. Congrats!
I have a question, my lawyer just received a letter of audit this week requesting for business necessity letter, I am not receiving much support from my lawyer, all he said is that company needs to proof why they need someone with 3 years experience and we are lost, I is hard for my sponsor to proof why 3 years of experience is better than 2 years. I'm lost. I went to other lawyers and a lot od them said that is better to re-file the process. Do you have any tips on he business necessity letter that you could share with me asap?

In my case I has been audited since November 07, and still waiting for Business necessity my lawyer contacted an evaluation comapny who prepared a letter to be honnesy with you I don't know anything about it, and I am really worried...

Guys,
what's going on with Atlanta Processing center.
mine was filed in august 2007 (EB2 Category), got audit request in Sepetember 2007, replied to audit with all the required stuff in first week of October 2007, so far no update. speaking with attorney every month, he saying that no updates and atlanta center dam slow.

Is any body has any updates in recent past..

We should audit this processing center instead of applications.

looks like old process is much better than this perm.

Appreciated if any body has any valuable updates or suggetions in this regards.

Myself and my friend filed PERM(EB2) on the same day in July 07. We have similar background. Both of us got audited for the reason behind the masters requirement. My audit came a week after that of my friend's. He replied in October and the PERM was cleared in a week. I submitted the reply in early November with the same paperwork. Unfortunately the PERM is still pending.
