Topic: Is there anybody working at the Atlanta Center this year?
Posted by phuana (4) 13 Feb 2008
Looking at the board, it seems very few people got any PERMs accepted between the month of Jan and Feb this year. Or people are not updating the cases. What is going on? My lawyer keeps saying there is no update. But surely there must be a certain time frame where we can contact the center and get more details on the status? Any ideas?

Hi Puana,

I believe that an applicant (through attorney) can query DOL for the status on a PERM audit case that is pending more than 120 days. Thats what I heard from my company attorney.

Attorney - "..I will make an inquiry on the case once the audit has been pending for 120 days as instructed by the DOL..."

That said, it seems like everyone at Atlanta center have gone on a group vacation at the same time.

I would say that they are so busy and desperate to audit all the cases that they haven't had a chance to approve anything :)

my attorney said they are very short on staff and trying to recruit more officers to work on pending cases.

Hi desireuben,

That explains perhaps the 44% rise in Audits at the Atlanta center. Probably they are buying time to recruit some people to work on the glut of pending cases. Well, lets cross our fingers and wait... no other alternative anyway if we are to stick with this process.

A thought just crossed my mind.

If Atlanta Service center is short of staff, will DOL be hiring H1B skilled labor?

If so, I would like to apply for a Software position there to help run some simple queries on their database at DOL. Its probably better to be within the system to understand the system.

Anybody has any more info on this hiring endeavour by DOL Atlanta office? ;)

this really sucks because the immigration officers at the airports are even telling me that I should be getting a green card since I've been here for 11 years and working for 5 years now. A pity they can't do anything with my application though.

I've tried to ask the lawyer to contact the DOL, but they keep insisting the DOL will not respond and it is more reliable to go through the website to check for the status.

When the lawyer sends an email to the DOL after 120 days, what kind of answer would you get? Does it just say its still pending or does it give more details as to why its pending, how long more its going to take? It's driving me insane...

"When the lawyer sends an email to the DOL after 120 days, what kind of answer would you get?"

Hi Phuana,

I am not sure what the response will be. But, it looks like the Atlanta center seems to give a response one way or another (accept or reject) before this 120 day limit seems to reach after Audit received by DOL. Also, I have noticed on IV that there are people who inquired about their PERM after or close to 120 days after Audit response and got an Approval just after the inquiry.

Since your reaching that 120 day mark, I am thinking you should hear something soon. Wishing you best of luck. And keep us informed.

Best Wishes.

Guys lets try and extrapolate this given that over 300,000 applications were receievd during "visagate" last year.
What do you think will be the impact and projected delays on various stages (PERM, I-140, I-485, EAD).

We are clearly seeing PERM extending beyond 180 days, possibly touches a year?
What about the other stages and so an assessment of the total you expect this will take?

We can then validate this and try and see if it is worthwhile to pursue this any more or look at alternatives (Canada, India)
