Topic: Received notification DV2009- next steps
I received notification that I had been selected for DV2009 on 3/31/2008 and I replied to KCC on 4/7/2008. I have already collected all the documents that were listed on the information packet as being necessary to proceed with the process.
I called KCC today and I was told that they do not acknowledge receipt of the material sent to them- they just forward it to either USCIS (if on the DSP122 you indicated a desire to adjust status in the United States) or the Consulate for your home country.
The agent also told me that interviews will not start before 10/1/2008 BUT to call KCC after 8/20/2008 and they would be able to give more information about the interview dates.
She also said that one can elect to change from consular processing to adjustment of status (or vice versa) later on in the process.
Does anyone know whether it is better to adjust status in the United States or whether it is better to go with the consular processing? I am currently on an H1B (set to expire at the end of 2009) and so I know that I would be eligible to leave the country and come back without having to apply for advanced parole...
any help is much appreciated!

Please if possible go for Consular processing from your home country it is usually very straight forward and the process takes a shorter time if you are scheduled for an Interview. Many people have missed their chances of getting greencards through the adjustment of status in the US.

thanks for the suggestion! If you know, what do you suggest I do to change to consular processing? On my DSP 122 I indicated that I would go with USCIS.... Do I wait until I receive notification about the interview or should I do something else ahead of time?
Also- does it make a difference that my case number is very low- 2009EU000002**? I heard that because it is so low I would almost certainly be called in the first batch of visa numbers released for Europe and that was why I should go with an adjustment of status (so as to not have to travel to my home country in order to go with consular processing)? Is this true?

Since your case number is low, then you dont have to worry, your chances are good, even with aadjustment of status, so just keep your fingers crossed.

I received my packet on March 31, 2008 (it was postmarked 3/27/08) but the letter from KCC was actually dated April 1, 2008.

I did not include my son when I registered for the lottery in November 2007. I have a valid reason for that and have a lawyer's letter for that. I intend to submit this letter to the consular office. Will I be denied the visa from the consular because of that? I appreciate your frank response.

I am Boniface,i applied to dv2009.and i happens to forget which address i used when applying it..so how could one know the address he or she use when applying...i was in my home country when i applied it,and then i was on holiday becuase i am residing in Malaysia ,so i am confused which address i use,weather Malaysia address or Nigeria address,and i don have anybody in Nigeria to check for me

That depends on your current status. Check this form, and if none of the
situations applies to you then you are probably better off applying for AOS.

You will have to wait until your Number becomes available and then send
AOS package to Chicago Lockbox. Fill DSP 123 etc and send to KCC indicating
BCIS if you intend to do AOS. if not when your number becomes available or
close, get a ticket to your country (Good Luck on ticket prices if it
is a trans continental flignt :))

Since both me and my husband are in the US on an H1B, we own a house, etc. - I assume we do not need a sponsor. What do we need to show during the interview - paystubs, savings, tax returns, 401k, house appraisal? What will be consular officer be looking for? There does not seem to be a clear guidance on that, I would appreciate any feedback.

You should be fine, but your son may have lost the eligibility to be your DV derivative. (unless he was born after Nov 2007, or his is US citizen or GC thus no need to be on your DV eligibility) You can file I-130 F2A for him after you have green card.

If you haven't worked and paid FICA for 40 quarters, you may still need some US person for i-864. Also, unless you have a very low number, it's better to do consular processing, which takes one month or so after your visa number is current.

Doesn't matter. You need to get that KCC first package, and your name, birth/native country, birthday must be exactly the same as in the online registration. You current address, or citizenship can be different and doesn't really matter. You can put in the counsulate you want in DSP-122.

I just learned about my name selected, I left my country in May to the US for study, I have F1 visa, my no. is 2009AF00065***, I have to decide whether to go for AOS or CP, It seems that my number is very far and I may loose the chance it if I go for AOS, also I am a graduate student and it may be not possible for me to travel on the interview time also it is a lot of many for the air tickets for me and my family, From the last years experience is it better for me to go for AOS or go CP?

based on your case number you seem to be from Africa, my suggestion would be for you to pursue the CP process otherwise you will be bogged down in the AOS process and you might miss the chance of getting a Green Card. if you really need the Greencard you will find the airticket money.

If you have a very small visa number, which will be current, say, by March 2009, you can do DV AOS by filing I-485 to Chicago lockbox (not local office anymore) when your visa number is current. If you decide to do so, let KCC know this now.

My DV number will current under the January 2009 visa bulletin, and I just received my 2nd letter notifying me of the interview. I have a couple of questions, and was hoping to get an advice here:
The second letter states that I need to provide a proof of marital status in addition to marriage certificate. I got married in the US, and I am not sure whether the states issue such document. Apparently, such document is issued in my home country, but my marriage is not legalized there.
If I am currently employed in the US on an H1B - and do not need a sponsor based on my salary/ savings/ 401K - do I need to fill out form I-864 Affidavit of Support myself?
Any input is appreciated

The normal CP for KCC/NVC is to send out second letter BEFORE your visa number becomes current, so you can return forms and your case can be forwarded to overseas consulate when it is current. For AOS, you hve to wait until the visa number current to start.

1. your jointly filed US taxes, house deed or lease etc.
2. You need I-864 unless you have already paid FICA taxes for 10 years.

This might be a very dump question, but how do I know when my visa number becomes current? Is it from the bulletin?
Are you saying that if my number is 2*** and the cut-off for december is 6850, my visa number is current?
Or the visa number will be a different number that the one I received from the first notification?

Asia #2000 is current in November and you can file I-485 to Chicago lockbox NOW.
