Topic: tricky question
Posted by hopefully007 (1) 30 Jun 2007
1.

1. What will happen to my application if i get married AFTER getting my PR visa BUT BEFORE ACTUAL LANDING?

2. Can I still add my spouse into my application while living in US or I have to be physically present in Canada. I am talking about the situation where I DO HAVE a visa stamped but HAVE NOT landed.

2. do i have to start over again with my application?

3. How much time will CIC give it to me for landing after I got my passport stamped?

Thanks

Good questions:

1. Any change in your personal circumstances prior to your LANDING (which is the time you actually become a permanent resident) must be communicated to the Visa Office. The reason being is that your PR visa states your marital status, and if states that you are single when you "land" but are actually married, you will not be able to sponsor your spouse for permanent residence later on as she was not disclosed on your initial application. Therefore, it is VERY IMPORTANT to notify the Visa Office if you get married prior to landing, EVEN IF your visa has already been issued. Your spouse will be required to undergo a medical and have her police clearances, but the time spent doing this will save you a world of trouble down the road.

2. YES. You can always add a spouse onto an existing application. You must not notify the visa office who is processing your file.

3. No, you do not have to start over. However, the Visa Office will require your wife's information (i.e. passport, birth certificate, medical, police clearnaces, etc.).

4. Not sure what you mean by this question. Once you are landed your PR status is permanent, so long as you maintain your residency requiement.

Here's a variant of Question 1:

What if one enters into a "common law spouse"-type arrangement with a same-sex partner after getting the PR visa but before actually landing? In particular, if the applicant and the common law spouse have lived together for less than 12 months (or otherwise don't meet the burden of proof to sponsor a common law spouse) at the time of landing, am I correct that such an applicant may land without informing the Visa Office of the "common law" relationship?
