Topic: Overstay in U.S

Hey,

Please can somebody help me with this problem. l am the principal applicant legally in U.S., but my spouse have overstay in United States, but was legally admitted in U.S on a B1 Visas. Now, the Canadian Immigration office in buffalo want her medical Report, Is it advisable to do it in U.S, since she is not the principal applicant. Please advise from experience.

Hi,

I'm no expert on this, but i believe they do check at the port of entry if you are legal or not, so what i'd advice is you get everything taken care of here (medical and getting the rest of paperwork done), then travel back to your home country and from there fly out to Canada.

medical can be done anywhere. US is best since you and your wife reports can send it at the same time . FBI (police ) clearance also required

Yes, medical can be done any where, but what about if after the medical and they request for her legal status in U.S and they discover that she has overstay, they might refuse the immigrant to canada

one of my friend had the same issue and they never asked about his wfie status as he was the main applicant so don't worry about it at all. Just go for the medicals and once you get your visa go back to your country and land from there.

No, legal status is not grounds of inadmisibility to immigration to Canada, as long as there is no criminal background. Do not worry, lots of people without legal status is the US (or other country) have become PR.

Can someone be of help here, am studying in canada at the moment towards my Msc. Have completed my course work but working on my research paper, without msc i will be on the boarder line-67, a friend adviced if a letter from the school registra is included that am only rounding up research it works. will i be approve marks for Msc or should rather wait till i complete my research before applying. Thank you

I am in the same situation. My wife overstayed her visa and they never asked for her legal status. I, the main applicant, had to show or prove my legal status. They sent medical forms for all family members. Now we are waiting on background check.

Did u undergo your medical and the police report of you and your wife here in United States, because they have ask her to do her medical and police report.

hi

i realy need your help i used to live in uae and i have credit card
problem ( i did not pay my credit card and i think the bank file case
againist me) if the police clearance came with this problem is this
something will affect my immigration to canada i now live in usa in h1b
visa

Hey grag2,

Did you declare the fact that your wife overstayed in the US on your application?

I overstayed in the US as a child- did get refused entry once, but now have a B1/B2 Visa & have never had a problem entering the US since. My husband is the main applicant on our application for PR to Canada & now I'm panicking that because of this overstay years ago, we may not get it. (We have declared everything on our form) What are your thoughts?

Dear friends,

Can you advise with this I need to declare total bankcrupcy in U.S before I leave this coming august because my visa will expire. Do you think this bankcrupcy will effect my canadian application? Thank you pls. reply.

Hi,

The law says that you must be admitted to the country legally for one year. If she was admitted legally and then later becomes illegal, that should be ok with canadian immig.
