Topic: U.S. and Canadian Immigration and Criminal Bases

Hi everybody,
I'm not sure whether I can ask this question here. Actually I'll try : do the U.S. and Canada share the same immigration and (or) criminal base? This information will be very helpful for me. Thank you.

No, Canada and US are two different countries! However, if you have a criminal record in the US it will show as you will have to provide Canadian Immigration with your FBI and State Police records. If you have a criminal record in US or any other country you will have to apply for pardon before you can apply for PR (or any visa)

As long as you have been legally admitted to the US for 1 year, you can apply via Buffalo, NY. It does not matter if you previously have (or are) violation US immigration laws. Canada care less about US imigration, but they do care about your criminal record and they are pretty hard (even a DUI will hinder you from applying without pardon).

What about if I had 3 shopliftngs? I failed to appear at the court all 3 times. Is it possible to apply for a canadian pardon? I can clear up my U.S. records before applying.

You have to clear your records in the US first. Appear in court and take your punishment. After a period of time (I think itis 5 years) after you have served your time, paid your fine or what ever the court orders you to do, you can apply for pardon. The pardon fee is about $1,000 and takes about one year.

Now, if they never took your fingerprints you should still be good to apply diretly for PR. Unless fingerprinted there is no record.

Hi GGKK,
I saw your intelligent contribution to this discussion and I thought I should ask you a question. If one serves his probation for a charge in the U.S. where and how should one apply for a pardon in the U.S before submitting the FSW application?
