Topic: Landing after expiry of Immigrant visa: Please advise
Posted by indojin (26) 08 Sep 2008
Can I land after the expiry of my immigrant visa, for some reasons I did not complete the landing process. Now my immigration visa has expired, Is there a way I can ask the consulate to issue me a new visa. Is there any specific process or just send a req and see what they reply.
Seniors please advise, is there any one who went through this. Thanks in advance.

No, you have to submit a new application.

NO extension of the immigrant visa UNDER ANY CONDITION.

However, if I am in your place, I will try to wrtie to them and documenting the compelling reasons of being unable to land but I don't think thia will work..you can try it.

This will not work - better just land before expiry (using nearest port of entry to Canada) and then you will get 2 more years (using COPR) to travel to Canada by car. You can also use the travel document later on for travel.

Last month aug 18th my visa has expired, they had issued me only 1 month visa maybe because my medicals was done at early stage and the processing time was almost 1 yr after the medicals, maybe becuse of my lengthy processing they might have issued me 1 month visa. I have written to the consulate, hopefully they do something positive.

No extension as stated in the letter before your passport was stamped. Submit a new application. Thats the ruling of the embassy.

I had sent an email to the Buffalo consulate and here is the reply, does it mean that i can apply for temporary travel permit and once in Canada apply for the PR. In my email I haven't mentioned about traveling and applying for a PR, I think i missed that point, does it matter. I had sent them the Immigrant file number and the immigrant visa number so i anticipated that they will check my file before replying Here is my email and the response that i received. Please advise should I travel. I intend to travel for the PR and not for any other purpose.

Email to the consulate:

Dear Sir/Madam,
I,XXXX intend to immigrate to Canada . I received an immigration visa, Since I had less time on my visa and I was stuck up with my current job so unfortunately I was not able to travel within the specified time. My immigrant visa expired on Aug 18th and I was not able to travel before Aug 18, 2008. Now I intend to travel and hence this request. I would like to request you for a visa/travel document so I can travel, I am willing to provide any or all the information in this regard.
I take this opportunity to thank you for your anticipated co-operation in this matter. If you require any further information, please feel free to contact me, I will readily provide any or all the information.

Response from Buffalo consulate :

Thank you for your interest in Canada. The answers to your questions are in the guide found at

I don’t think the person answering the email understood your question. The link they provided does not answer the question you are asking.

You may want to email them again or if you can get hold of them on the phone, perhaps that might be better.

Failing that, if you are close to the consulate, a visit in person might be better.

Or maybe a letter mailed to them (not an email) might get a better response.

I would also suggest that you explain the situation better in your inquiry letter as well. You haven’t explained to them that they only gave you one month to land, which may make a difference if they are going to consider reissuing you a visa.

I sent another email with all the details and the consulates response is they cant extend, do i need to restart this process. Here is the consulate's response. Does it make sense to visit the consulate in person will this help.

Sir, we can not extend your visas. When you came to our office on 3 July 2008, the office advised you of the landing date, and instructions on landing.

Please refer to the following site, about new procdures about applying for PR inside Canada.

Please return unused CPR forms so we can initiate the RPRF refund..

It's only a waste of your time visiting them in person. They will not extend your visa.

If that’s the letter they sent, I think it probably wont happen. You probably would need to restart the process.

However, I am a bit confused, the link they sent you is for CEC. Are you in Canada? If so, I would think it would have been very easy for you to land by just going across the border and coming back.

I am not in canada, am working in the US on a H1 visa. I could have landed before but since i was not sure about the AVR and I have an expired h1 stamp on my passport so I did not complete the landing. I think I will have to reapply.

Yes you would have to, but how would reapplying make a difference? Have you resolved the AVR/H1 issue? If not, would you be wasting your time and money again? CHC may very well ask you why you wasted their time in the first place? Someone else was delayed because your visa was processed first.

What would you tell CHC when they ask you why you didnt land the first time? You better have an answer they will buy.
