Topic: Changing Job, while on Work Permit

Hi,
I am on work permit in Canada and I can only work for named employer. Can I change the job while being in Canada, if yes, what is the process. My work permit is valid for another year.
I know same thing can be doen when you are on H1-B visa in USA.

Hi,

According to my knowledge it is possible. the new employer has to file a new work permit for. So it is not as work permit transfer.

your new employer will have to apply for LMO application. once you get approval you can apply for work permit or u can apply for concurrent processing with photo copies of all documents of your employers application for Labour Market Opnion.feel free to ask anything anytimeJAY

Its not so easy to get job in Canada if you are not PR/Citizen there. Why dont you look on web? IT guys should look on web before asking a query ;) I always follow this :)

does it make a difference if the PR application is under process and medicals are completed? Is there any implied status using which changing employers is possible?

Hi JAY,

As you have asked me to ask any doubts regarding change of work permit, i am again asking in this forum. One of the employer is willing to file a new work permit for me. I understand LMO employer has to get, but how about filing the main application in CIC. As i am already in Canada, do i have to apply the work permit in Canada CIC office or outside Canada CIC office. Please if you can send me the correct application form which me or my employer has to fill up, i will have a clear understaning as i am confused totally. My employer does not have proper idea also how to apply for a work permit when somebody is already in canada on work permit. They have got people from outside Canada filinh work permit but they have no idea how it works within canada. Your help will be really appreciated.

I am thinking of accepting a job offer in Toranto. Presently I am on H1B in the US. Any thoughts on how long it takes to get a Work Permit and how expensive it is? Any rules/regulations as who has to bear the cost of work permit?

On a different note, how is it to work in Torando (culturally, at work, people, climate, etc.)?

It take less than 4 weeks to get Work Permit in Canada after you apply. I am currently in US on H1-B which will be expiring very soon and am looking for a job offer in Canada, can you please guide me as to how you landed a job in Canada? Hey TG2181! sorry for late answer I never got any notification for you question on this forum..anyways..

now..
if you are currently on work permit, what kind of work permit is that
1-> Post graduate Open work permit? than you dont need another work permit until the current one expiers...u can work for any employer
2-> Post graduate Employer-specific-work permit? in than case you do not need LMO just apply for Post-graduate-Open-work permit, they will send you new-Open-work permit with same expiration date.

3-> I you got work permit which is not Post graduate work permit and your current employer got it for you by getting positive Labor Market Opinion than your new employer will have to apply for LMO once get positive LMO for the new employer, you can attach the Positive LMO with the application form form http://www.cic.gc.ca/english/information/applications/extend-worker.asp and send it to CPC alberta.

I am on a work permit (Specific to a employer). Same is valid till end of next year (2009). It was issued from India, under the skilled worker category.
Questions:
1) Can I look for a job in other company? If they offer a job, with offer letter. Can it be changed to that employer. If yes, how long it may take. Can it be applied in person?
2) Can it be changed to open work permit.

yes you can look for another company but they will have to apply for Labor Market Opinion to service Canada for you, once approved you can apply for new work permit which will be specific to that new employer.
LMO takes 1 month 10 days to 2 months.
then work permit takes less than 2 months

No you can not get an Open work permit.

I believe if you have work permit under "Skilled worker category" and you get the offer letter from new employer. You can apply for new work permit under "Changing codition.. " form.
No LMO is required for the same.

Hi Jay, I am on WP here in canada , I am in IT so i didn't have to go thru LMO / HRSDC thing.


So my question is: I want to change my job and i have found one employer who is willing to give me the job.

Now, If i apply for new work permit ( LMO / HRSDC Exempt ) and In case if new one got rejected will i have to leave canada ?

What will be status in canada ? My Passport has a stamp of CANADIAN visa until Nov 2009.

In that case your previous work permit expiration date will come into effect. you must apply for new work permit again with a valid and concrete rebuttal to their reason for rejection of you application for new work permit. Now once you apply you can sty and keep working under "applied status condition" until u get the new work permit application decision.

Now if you get rejection again which is very rare and there must be something wrong in your application( you understand where I am heading to..), In this case you can try to find one new genuine employer which can really a new work permit and offer you a job which falls under the one of the IT professionals criteria and your previous work permit must have already expired I guess, so you apply for "restoration of status" with application fees of $ 200.

Now I do not hope such worst case happens with you so just apply and get new work permit and let me know if you need any information let me know I keep coming here and I have my own community " Indian students in Canada" on Orkut where you can reach me.JAY

Few more questions:
Situation is that I am IT skilled worker and have valid WP till Nov 2009 working for one employer say ABC.

Now I get the offer letter from new employer (XYZ), who wants to join within 2-4 weeks. How I can get new WP for employer XYZ.
a) Which form I need to fill
b) which office, I need to send or can I go in person
c) can I continue working for ABC till I get WP for XYZ.

you of course can work until Nov. 2009 for the current employer as your current work permit has the same company's name on it.
Now for new work permit..
Note: It is up to your employer to make sure the job you are being offered falls under one of these descriptions.

1. Senior Animation Effects Editor (NOC 9990.1)
2. Embedded Systems Software Designer (NOC 9990.2)
3. MIS Software Designer (NOC 9990.3)
4. Multimedia Software Developer (NOC 9990.4)
5. Software Developer—Services (NOC 9990.5)
6. Software Products Developer (NOC 9990.6)
7. Telecommunications Software Designer (NOC 9990.7)
and if "YES" than you can apply for new work permit for that employer.

fill the form of change of condition form and send to Case Processing Center jay

My job falls in Software Developer—Services (NOC 9990.5)

I know Case Processing centre may take 2-3 months, can the same be done in person to any office to reduce the processing time.
