Anyone tell me What are the documents required to file I-539 for mife? My extesnion has been approved and file my wife's extention by my own.

This is a check list from my atternoy. I cannot gurantee any accuracy on what YOU would need. My atternoy may have filled up rest of the form as required. IMP - I filled I539 anong my I129
- Make sure you fill Pages 8 & 9 only ( I don't know if my atternoy filled in the rest of the pages of I539).
- You need to send 3 copies of page 9. Don’t fill anything in page 9, take 3 copies and spouse (H4 applicant) needs to sign in all the 3 copies and send it along with the filled page 8 (1 copy). Again, I don't know why they needed 3 copies.
- complete photocopies of your spouse's and kid’s passport (if applicable),
- Your Marriage certificate and your kid’s Date of birth certificate (if applicable) along with the 539 forms.

When you file H4 for spouse do the H1 holder need any letters from the employer?

Am not sure of this. I guess, if you are filing H1 along H4 - You don't. Also If you are filing H4 with a copy of your approved H1 - You don't.

what are the documents required for change of status H1B to H4?

Any idea how long does it takes for the H4 application to be approved. I already have a valid H1b and my wife's H4 has expired in June 08. The company lawyer just informed that they never applied for my wife's H4.
Is Premium Processing an option available for the H4 category?
