Topic: H1B Extension while selected for DV2009

Here is a question...

I am on H1B and towards the end of this ear I have to revalidate it (i have 2 more years left). Meanwhile my wife was selected in the DV2009 Green Card Lottery and we filed the DS230 forms and sent them to KCC.

Today it occured to me that DS230 can be viewed as Intent to Immigrate (which is exactly what it is)... so does this mean that I will not be able to extend my H1B (which is a non-immigrant visa)? The problem is that there will be a gap between the day my current visa expires and the day we will (hopefully) get our GCs.

H1B is a "dual intent" visa, meaning that you get this visa with the intention to immigrate. You can have problems on a student visa or visitor's visa, but not on H1. Given the time it requires for a employment based gc to go through, you are exteremely lucky. Enjoy
