Topic: Urgent help. Wife H4 to keep or not?
Posted by comeongc (9) 28 Jul 2008
Me and my wife are having EAD and our I-140 is approved. 485 is still pending in EB3 cat. My employer is working on my H1B extension documents. They can also apply for H4 for my wife but I've to pay around $1000 fee(to the law firm). I'm thinking of not continuing her H4 for now and let it go since she already has EAD . In the worst case I can also apply for her AP. Is this a right idea or Is it wrong she not having H4 when i'm continuing on H1B ? pls advice asap. thanks.

If you have EAD for your wife you don't need to do H4 but if you wan't it then why not file her H4 yourself it will cost you $300 and the form is quite simple to fill.
