Topic: Switching employers in 7th year of H-1?
Posted by bharat (2) 28 Nov 2005
I am starting my 7th year H-1 extension now, with my current employer. They have filed for my labor certification.

Is it possible to switch to another employer at this point, and the new employer files my PERM appl. immediately?

Yes It is possible.

But for any company to extend my H-1, isn't it a requirement that my labor app needs to be filed 365 days ago? Why would my company agree to let me use my current labor application PD when I file for H-1 with a new employer?

Another point. I think 7th year H-1 extension can only be used for the company that filed it. I think.

As long as your H-1B is valid, you can switch to another employer, have that employer file your H-1 transfer, and then file PERM at the same time. Should work, depending on for how long your H-1B is still valid. Should be valid for at least couple of months.

Mine is valid till Apr/2008... I assume/think this is plenty of time :-)

Thanks.
