USCIS Reaches FY 2009 H-1B Cap

WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) announced today that it has received enough H-1B petitions to meet the congressionally mandated cap for fiscal year 2009. USCIS has also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the “advanced degree” exemption. Before running the random selection process, USCIS will complete initial data entry for all filings received during the filing period ending on April 7, 2008. Due to the high number of petitions, USCIS is not yet able to announce the precise day on which it will conduct the random selection process.
USCIS will carry out the computer-generated random selection process for all cap-subject petitions received. USCIS will select the number of petitions needed to meet the caps of 65,000 for the general category and 20,000 under the “advanced degree” exemption limit. USCIS will reject, and return filing fees for all cap-subject petitions not randomly selected, unless found to be a duplicate. USCIS will handle duplicate filings in accordance with the interim final rule published on March 24, 2008 in the Federal Register.
The agency will conduct the selection process for “advanced degree” exemption petitions first. All “advanced degree” petitions not selected will be part of the random selection process for the 65,000 limit.

I am an F1 and I applied for AOS, EAD and AP. But I am afraid that I will not get the AP on time to travel to my country to attned my sister's wedding. So an attorney suggested that I can apply for H1b since I will be working in my husband's university as an adjunct instructor next year.
My questions are:
1. If I appy for H1b now, after filing my I-485, will my I-485 be cancelled?
2. In order to be able to appy for H1b should I withdraw my I-485?
3. Can I travel to my country and come back without any problems on H1b while my I-485 is pending?

The answers to your three quiestions are:
1. No
2. No

The problem though is that the H1B quota for FY2009 is full (and so is FY2008), for both the regular category and the category for persons with a US Masters degree. Unless you are excempt because you have previously held H1B status or if you can use the Singapore/Chile quota (have to be a citizen of one of those two countries), the earliest date your H1-B can be valid from is October 1, 2009. Ask your lawyer how he/she thinks you can get a H1B faster than the AP. To me, it sems your best bet is to request the USCIS to expedite your AP because of your sisters wedding, but I am no lawyer.
Ask your lawyer again about this, and if you don't get good answers, consider changing lawyers. Not all lawyers are good lawyers.

USCIS Runs Random Selection Process For H-1B Petitions
WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) today conducted the computer-generated random selection processes on H-1B petitions, to select which H-1B petitions for fiscal year 2009 (FY 2009) would continue to full adjudication. If approved these H-1B petitions will be eligible to receive an H-1B visa number.
USCIS conducted two random selections, first on petitions qualifying for the 20,000 “master’s or higher degree” (advanced degree) exemption, and second on the remaining advance degree petitions together with the general H-1B pool of petitions, for the 65,000 cap.
The approximately 163,000 petitions received on the first five days of the eligible filing period for FY 2009 (April 1 through April 7, 2008) were labeled with unique numerical identifiers. USCIS has notified the appropriate service centers which numerical identifiers have been randomly selected, so each center may continue with final processing of the petitions associated with those numerical identifiers.
Petitioners whose properly filed petitions have been selected for full adjudication should receive a receipt notice dated no later than June 2, 2008. USCIS will return unselected petitions with the fee(s) to petitioners or their authorized representatives. As previously announced, duplicate filings will be returned without the fee. The total adjudication process is expected to take approximately eight to ten weeks.
For cases selected through the random selection process and initially filed for premium processing, the 15-day premium processing period begins today (April 14), the day of the random selection process.
USCIS has “wait-listed” some H-1B petitions, meaning they may possibly replace petitions chosen to receive an FY-2009 cap number, but that subsequently are denied, withdrawn, or otherwise found ineligible. USCIS will retain these petitions until a decision is made whether they will replace a previously selected petition. USCIS will send a letter to the wait list petitioners to inform them of their status
USCIS expects that for each of these wait-listed petitions, it will either issue a receipt notice or return the petition with fees within six to eight weeks.

USCIS Releases Preliminary Number Of FY 2009 H-1B Cap Filings
WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) today announced a preliminary number of nearly 163,000 H-1B petitions received during the filing period ending on April 7, 2008. More than 31,200 of those petitions were for the advanced degree exemption.
USCIS expects next week it will conduct the computer-generated random selection process, beginning with the selection of the 20,000 petitions under the advanced degree exemption. Those petitions not selected under the advanced degree exemption will join the random selection process for the regular 65,000 cap.
USCIS will reject, and return filing fees for all cap-subject petitions not randomly selected, unless found to be a duplicate. USCIS will handle duplicate filings in accordance with the interim final rule published on March 24, 2008 in the Federal Register.
USCIS will provide regular updates as the processing of FY 2009 H-1B cap cases continues.

I only received one so far and it was under the masters, premium processing.

Only 1 of the 9 people I know has filed under the masters cap and all nine have used premium processing... who doesn't these days? The person with the masters received his notice on Apr 14 from the California processing center and all the other ones received thier notices yesterday from the Vermont center.
What processing center did you file with?

I am working for company A on L2, and have filed for H1b with company B. Company B is my friend's and was all done in good faith. I have paid $2850 for fees, attorney & credential evaluation. I have no proof whether my H1b is even filed or not. I don't want to jeopardise my friendship. Could somebody please tell me what paper should I ask for as proof that my H1b is filed. Even if my H1b is rejected, what paper can I ask for?

If the application was done in good faith, that means they want to hire you so it is in their interest to make sure the application is filed. Also, if you paid for the lawyer it would be malpractice not to file. So I don't think you need to worry about wheter the application was filed or not.
It will take USCIS some time to register all the applications and send out either receipt notices or letters informing you that that you were not picked in the drawing if you are unlucky. Ask your friend if you can get a copy of the receipt notice with the case number once he gets it. That way I am sure you will either of the two letters USCIS will send. Note again though that it might take a while since USCIS has over 100,000 applications to go through and register.
Who cut the check to USCIS for the fees? If it were you, you can see when it gets cached, or if it is returned to you. If the lawyer or the company cut the fee check, and they were paid by you, it would be theft if they don't give the fee money back to you if USCIS returns the checks if you were unlucky in the lottery. I don't think the attorney (or your friend) would dare to do that.

Your reply was useful. I have paid the money to the company, it is they who issued the check. & as per my understanding, IF I am unlucky in the lottery the check will come back in their name & they will issue a check to me. If it was my cheque, I could track it easily.
I am not worried about the time taken, it was more about whether I am being ripped off. Attorney fees & credential evaluation was billed as $ 1250. INS fees as $ 1600. If unlucky I get back 1600, but the 1250 is gone.
Now I know that in either eventuality there should be a letter, I can ask that for peace of mind.

Good morning,
did anybody received a letter saying its application was rejected? I applied for premium process for the amster cap and i have not heard anything yet and i was trying to figure out how much a bad news is. If "rejection"and "approval" are processed at the same time it is not a bad news to have not received anything yet. If they process the "approval" first... it is bad news.

I applied for H1-B in masters quota premium processing and have not received any receipt notice yet. But I have a few friends in the same/different company who filed under regular processing in masters quota and have received their receipt number. Does that mean that they are done with the premium applicants and I am not selected?
Does anyone know how they are going to function the waiting list this year?

I know this is the wrong forum to ask this question, but i thought this the pplace from I can get most accurate information.
I am planning to go for my renewed H1 stamping. I read on some forums that it is advisable to check in PIMS database to see if my information is updated there or not, if not my case go for further check and I might take anywhere from 3 days to couple of months.........can someone throw more light on this and tell me what is PIMS and how can I check on PIMS regarding my case?

2 of my friends got their receipt notices on 04/26/08 says they have chosen from lottery. They have masters degree in US and they did not apply through premium processing. One of them lives in California other one in New York.
I have masters degree too. I applied for premium processing. I live in San Antoino,TX. My lawyer is in Utah. I dont know which processing center he send to my files.
He says that he did not get any receipt notice yet. Is that normal?

With such advance technologies and manpower to clear the rush the USCIS should have completed atleast the receipt of the H1B applications and the numbers they allotted to all the application which will help the aspirants like me to keep patience and confirm the apllication filed by the respective attorney.

It is only the second year in a row they do this lottery and they changed the rules and procedures from last year so no one knows what is normal. I think that the only thing you can safely say is that until you get one of a) receipt notice b) decision c) letter saying your application was not picked, you will not know if you were picked or not.

I see, so I will still get a letter from USCIS if I am not picked from lottery.
1 more thing; 14th of April is the start day of 15 day premium processing.
So, today is the last day for premium processing right. (April 29). If I don't get any letter till April 29 does it means that USCIS will pay back my premium processing fee?
Basically my question is April 14 is start day of premium processing, when is the due date?

By the 29th (today) all selected applications with premium processing will have been either approved/denied. However, if you haven't received a notice as to whether your application was randomly selected, you really have no idea what the status of your application is.

Yes. This means you were selected. Did you get an email or an actual paper in the mail?

my employer got the mail from uscis california service center for acknowledging the receipt number. The same mail my employer has sent across to me. I also checked in uscic website for the status of my case w.r.t receipt no. The status shown is "Case received and pending"..

the notice date on the pdf doc is 24th April, 2008. i got this info yesterday only..n i did not get the same mail from my employer..rather he just sent me the pdf doc that they recvd from WAC centre..

Hi, I have submitted for pp in California and I have not heard anything as well.
I am nervous as you are, hence I started to dig blogs and forums like this one.
No lawyer says anything, probably because the situation is not clear (and it would be wrong for them to say something if they are not sure).
These are the pieces of info I have (please correct me if I am wrong). Please keep in mind that my sources of info are not so trustworthy (blogs), hence take what I say with the due skepticism.
Apparently, this is what I believe happened so far:
* a big amount of pp receipts for accepted applications were received in the first two weeks;
* I heard of one (just one) pp applicant getting the receipt on the third week (this week);
* toward the end of the second week non pp receipts for accepted applications started to be received;
* so far I have not heard of anybody that received a denial (pp or not pp).
If you have more info, please correct me!

I am in Austin as well and I know of at least 2 people here that have filed under advanced degree quotas that received their notices on Apr 22nd (see my post above). As far as to what this means (whether or not your case was selected) I don't know. As ThomasB said, nobody knows exactly what the procedure is like this time around (including whether or not they send notices out alphabetically).

I am not sure how do they send the notice but me and my friend are from San Antonio,TX and we did not get any notice yet. Both of our cases are filed under advanced degree. My friend talked to his lawyer and he said that he got 2 notice of 15 applicants yet.

I had a wierd one, that got approved PP and the email receipt came a few days later. Still have not heard on regular cases.

no definite idea..... feels 15 days is not a true indication..... it's quite a big firm thro' which i applied and they said, they have got receipt for only 1 pp case yet...
do not understand why they say the 15 day wait period... yes or no, they should have let the applicants know the status... uh!!!!

Well...At last I received the receipt # from my lawyer today. May 1st
My lawyer sent me scanned PDF copy of my I-129 receipt notice form I-797 Notice of action. The status is now "Case received and pending"

Please tell your friend to post his case on trackitt so we can get all benefit from the data. To answer your question, yes, the case number is the same as the receipt number (assuming it begins with a WAC- or a EAC-) No, it does not mean your case has been approved yet.

Hi…i files on April 1st with premium processing for h1b (non masters cap). i still have not heard anything - given that the 15 day period started on April 14th, does this mean i did not make it through the lottery since 15 days have already passed?

Today (may 5th) I got forwarded an I-797c Notice of Action. Notice date apr 18th, 2008. I go in the regular quota.
The notice says: "The above petition or application has been received and accepted as a Premium Processing Case. You should receive notice regarding your case within 15 days from the date shown as the received date above [which is apr 14th]. ... This notice does not grant any immigration status or benefit. It is not even evidence that this case is still pending. It only shows that the application or petition was filed on the date shown."
It has an EAC... receipt number.
Again, does anyone know if that means I passed the lottery or simply there is not enough evidence to infer that?

As stated previously in this forum, if you have a Receipt Number you have been selected through the lottery... this does not mean your application has been approved but at least you have a chance.

Hope you are doing well. Please be advised that the USCIS has not issued a receipt notice for your H-1B petition. USCIS has not advised us if you have been selected for the H-1B visa lottery. USCIS has indicated that it will not issue a receipt notice unless you are chosen for the lottery. Additionally, the USCIS has not cashed the check in connection with the filing fees for your H-1B petition. The USCIS does not cash checks unless they have been selected for the lottery. We will promptly notify you if and when we receive a receipt notice in connection with your H-1B visa. I believe it may take another 30-60 days.
