Hi rm78,I have not heard any update from my lawyer if she had receive a rejection letter/returned application nor approval. she is not responding to my email anymore. do you think there is still chance of getting a visa nowadays? especially that the uscis announced that there wold be no waitlist this year.May i know what country are you from?

I also have not heard anything from my employer and they have not been replied to my emails. I have no idea if I was selected in the lottery or not. I do not know what to expect from them, or they have bailed out on me.

My employer mailed me the details to be filled in DS156
and asked me to fix the interview in the end of august.
So i have filled the form and fixed the interview date
in the end of august. In the middle of august i will be
getting the papers from him.
so you can talk to your employer to send the details
to fix the appointment with US consulate.

Does any one know How long it will take to complete the process for those who are in pendings. My case is Vermount Center and Recived Date is May 7th 2008. Amlost all of in my Serious got thier approval notices Except of 2 or 3 %. Would you please share with us if you know anything about this process.

Now it has got deleted. Next week only i am going

No it wont create any problems, all you need to do is to to fill in both the forms once again. Its better you keep checking the schedules, but dont create the forms yet until you receive the petition and other documents in hand from your employer. I thought of telling you last time, but since you were confident you will receive the documents, i didnt mention it at that time.

Hi All,
I need your help on this. One of my friends applied for H1b through some consultant and charged her $2000.
Since she didn't get selected in the lottery she asked for the $1500 refund also through some internal resources she got to know that consultants have befooled her and actually never applied for her H1. Now she wants to know if in this situation what would be the best thing to do. She is not willing to take the $1500 but wants to teach them a lesson.
Will highly appreciate your advise on this.

She does have a copy of the check in which memo states, 'security deposit'.

security deposit doesnt imply anything i guess. where is she located. is she in india and did she give the money to someone in india or in USA. if they r saying that the application was not picked in lottery then they will get a letter form USCIS saying the same , ask the employer for that letter, if he doesnt give the letter then you can make a formal complaint about misleading , saying lies and taking money and cheating.

Although I do still have some questions, my application was filled on May 13th, on Vermont 081557. I have been looking to some numbers and some people had it approved and some other didn´t. By my understanding, it is a lottery and there are no more visas available, right? That sucks!! But then I read if you work in education, my case, you are not under that cap and if you are applying for the second H1B also you are exempt, well I do apply to those circumstances, but yet I do not have any answer. Does it mean I need to wait for the new visas to be available? Is there any chance to have it done? I wish I have studied law... Could someone help me out? Thanks!!

until now I did not receive any update from my lawyer. same as my friend who is a nurse, we have the same lawyer. our files have not been sent back by USCIS as of this time,we have not receive neither approval nor rejection.

Have you applied for H1 as a teacher? If so then it is for sure lottery exempt. I know a lot of people who are on H1 in education stream and none of them ever went through lottery system. Let me know whats your major and which part of education industry you associated with.

I was at my employers place today and asked him about what you had asked in your post. He said if the application is rejected, then the USCIS will send a letter confirming that the application was not accepted and giving the reason for eg; not picked in lottery or incorrect fees or whatever it is and they return all the documents with the complete fees. SO ask your friend to ask her consultant for that particular letter and if doesnt have it then he hasnt filed for her H1 and then she could make a formal complaint against him on the account of cheating and taking money.Take care. All such consultants should be brought to justice only then others will learn a lesson and not play such games with innocent people.

Is in any other doucment we have to mention it for US chennai consultate to show to them.

My friend's employer emailed her a scanned copy of the letter from the lawyer saying that due to unknown reasons they haven't received the documents back from USCIS so they have emailed scanned copies of the cheks made payable to uscis,
an invoice from the lawyer.
Can you please confirm from your friend :
1)if that letter from USCIS mentioned his name saying 'MR. X didn't make it to lottery' or just in general saying " The enclosed application didnt make it to the lottery".
2) Did he get the fedex receipt for sending his application to USCIS with his name mentioned anywhere.
3)Which document is the most authentic proof of his application being sent to USCIS(I mean the stamp from USCIS as recieved).
I am asking all this because i think that her consultant can easily forge someone else's documents and scan and email to her, if she pressurises him too much.
We are planning to go to district attorney's office and it will be really helpful if we have an idea about the above mentioned points.

Its not a botheration at all. Ask her to ask him to give the original copy of USCIS. The letter which, I saw it was mentioned as the application of Mr. X was not picked in the lottery and thats the reason they have rejected the application and hence they are returning all the documents and the fees paid. It was from USCIS. I dont think that USCIS will say that the application is not accepted for unknown reasons. There will always be a reason, like checks returned, not picked in lottery, application not filled properly and so on. And as far as I know all the people who weren't picked in the lottery have been notified by the USCIS already. So the letter from USCIS is a must if the consultant has applied for H1. Stress on giving the original letter from USCIS. You can even threaten him about taking the case to lottery as you are sure that he has not filed your application and then see what he says. Its your friends to get the correct information as to why her application was not accepted whatever the reason is. Take care.

Can you please put some details for the following case.
The consultant claim that application has been selected and thrown in RFE on June 17,2008. The employer/consultant not giving details of RFE such as whether it relates to him or the alien. Even after 45 days no update for RFE in The USCIS website.
When pressurised for return of the deposit he says that since it is pending with USCIC for RFE even if USCIS rejects the application they will not return the check and no refund is possible. But when the offer was made, the offer letter clearly states in the event of the application being rejected for what so ever reasons, the consultant will refund the deposit.
plese put some suggestion.

Are you 100% sure that the letter bears individual's particular name on it because jus now my friend called and said that the consultant showed her the packages for some other and none of them beared anybody's name.so its a common letter for all.
The letter only says ............that the enclosed application got rejected because was not selected in lottery bla blah............
i mean it doesnt have the persons name anywhere(which the consultant says that they cannot type so many letters for so many candidates)
I am sure after some days he will show her some forged letter and fedex receipt but none mentioning her name.
I am personally getting involved because she lost her whole one year and i want to teach her eployer a lesson.

I am sure that the person's name is mentioned. I shall check again and let you know as soon as possible.Or if you have any letter with you send as an attachment and I could verify it with my employer or I will try to get one of those letters and send it over.

Sorry was offline for a week or so, if not for you others can make use of the below information, yes you can have your IT Returns for the past 3 years, and below are the required documents for the principal applicant as per VFS site,
1. Passport, visa fee receipt issued by HDFC Bank and interview appointment letter.
3. The original Notice of Action (Form I-797).
4. Form I-129 (if Form I-797 is a blanket permit, copy of Form I-797 and I-129), and letter from employer that describes your proposed duties.
5. Letters verifying your employment history and specific work skills.
6. Original degree certificates along with mark sheets.
7. Relevant diplomas or certificates, e.g. computer certification.

I think slno 2 and 3 will be sent by the employer from US for interview. Other things
you have mentioned has to be prepared by the individuals.

I have received receipt number on 5th May 2008. It's normal process not premium process. My application was approved and I-797 copy was received by my employer on the same day. I am located in Bangalore. My qualification is B.Tech and my employer is Hyderabad based.
