Hi Leela,

Form I-129 is the Petition for Non-Immigrant Worker. Once the I-129 is approved, the employer receives a Form I-797. and both of these should come from the employer, you require only the approval notice which is I-797 for the visa interview.

Hi Canica/Leelavathi,

This is reg. DS-156. I have made the payment in HDFC on 05-Aug-08. Today I have tried to fill DS-156 form. In the first page, it says 'do not take print out, click on continue then take print'. I have done the same thing. But I didn't get any barcode or print option. After clicking on continue a page where links to DS-156, 157 was displayed. What should happen when we click on continue?

Hi Jagan,

The options displayed were correct, there will be an appointment letter confirming the date and time of the interview as well, you have take a printout of DS-156, Ds-157 and the appointment letter for the interview.

You mean without taking appointment can't we take printout of DS 156, 157?

Reg. Question no. 31 in DS 156 Have You Ever Been Refused a U.S. Visa?, my H1B petition was approved in 2005 by US employer. I was asked additional documents in interview by US consulate. My employer could not provide the documents. Thus, I got '(g)' on my passport. Since I don't have document with me I didn't attend the interview again. My H1B was canceled later by the employer. What should I answer to question 31.

I wanted to say 'Yes' and give the proper reason. But it's not asking reason rather it's asking 'date when refused'.

As they sent them on Friday, my lawyers didn´t receive them yet. Thank you for your worriness. I didn´t apply for premium, for the record.

Hi Jagan,

You have done the most difficult now, don´t give up!! Yes you can print out DS156-157 without appointment, but you need to make sure to have them printed out close to the appointment date.

Regarding question 31, I think you should answer yes and the date, more or less, then in your interview you could explain all those details, it is not your fault that your employer doesn´t have the documents... right? Before they approved your H1B they are supposed to check everything, right? They will know about it.

Don´t give up and take a risk!!

until now, my lawyer have not receive any approval nor rejection letter. my lawyer emailed me that she had spoke to the AILA liason and they told her that thee USCIS is waiting to see how many request for evidence of already filed H1B would get denied. Then if they do then the files on reserve would go on.

how true? and is their anyone here who was denied or do you know someone who was denied for this years H1B

hi all,

I have been a silent viewer of ths forum. my case status shows as RFE and says On June 19, 2008, we mailed a notice requesting additional evidence or information. my employer updated me sayng that thy r preparing for the RFE. I'm worried that, the RFE request was sent app 2months b4. Are there any cases, where the petition gets expierd, if my employers doesnt send the docs @ the rite time?

Hi jerry,

My case is also similar to that of yours. I under stand maximum of 90 days will be given to the employer for replying to RFE. But exact nature and time limit only known to the employer. Many employer doesnot give details to the applicant like us.

Hi Leela,

i received my papers too and my employer has already schdeuled the interview for Tuesday 19th august at 7:30 AM.

following are the set of documents they have asked me to prepare

1. Original H1B (I197 i presume)
2. Original Offer Letter/ Labour condition application / Education evaluation
3. certified copies of I-129 and supporting letter
4. Original Passport
5. Visa application forms duly filled DS-156 & DS-157
6. Original Experience Certificate from the present employer
7.Past 6 months Pay-slips
8. Latest updated Resume
9. Original & Copy of complete set of Education (SSLC, PUC, Degree, PG and any other relevant documents) & Appoinments & Experience letters from all the previous companies
10. Two photographs. the unmounted photo (colour), on a plain white background, taken within the last six months, must be full face (facing the camera directly) . The size must be 50mm*50mm with the head centered in the frame.
11. Original / Photocopy of candidates personal Bank Statement for past 6 months.
12. Original / Photocopies of previous years Form 16 & IT Saral returns or W2 papers
13. Copy of international Credit Card.
14. Marriage Certficate (if Married) / wedding photograph / Date of birth certificate of children (if any)

Usually H!B Visa with small companies will cause problems, if the company is well know, there will not no issues.

Hello everyone,

I hope someone will be able to provide me with some info...my employer is trying to play with me, and I do not know enough to be able to fight back.
I have a Master's degree, and I am on an OPT status right now through June 2009.
If I apply in April 2009 and I get H1, when would I be able to start working?
Also, what can I do myself to help or even file for H1?

I have read everything on uscis.gov and I am very confused...
Do I need an attorney or can the company do it for me? Can I have an attorney and do not bother my employer?

Congradulations and wish you all the best. My case is still in RFE and my employer is not willing to send copy of RFE I tried in USCIS, Chennai today but of no use. They could not provide any details and they said i need to talk to my employer only.

Hi there,
My advice is to hire a lawyer and stay away from consultants. It is more expensive but you need to be sure. The smallest mistake will result in the rejection of your application by the USCIS. Do not do it yourself, chances are you will screw it up. Your employer needs to sign an authorisation form G 27 I believe and the lawyer will do the rest.
There is no certainty though that you will get the visa because each year the number of applicants increases but the quota stays the same so the USCIS conducts a lottery. Make sure you submit before April 1st because the quota fills up on the opening day.
If you are lucky enough to make it, you will be able to work between June 2009 and the earliest day your H-1 B will become effective which is October 1, 2008.

What is G27, is it something that the employer agrees to sponsor me but will let a layer handle the case? Does that mean that the employer will not pay for anything?
How much are the fees I will have to pay to complete the application?

Also, where do I find a layer? Does anyone have anyone they would recommend?
What is the average they charge to complete the process?

The petitioner for the H-1 B visa is your employer and he needs to sign a form if he wishes to be represented by an attorney (the G 28 form below)

Who is going to pay the attorney, you or your employer, will depend on how you negociate it with your employer. If your employer wants to screw you, he most likely will not be willing to pay but you absolutely need to have an immigration attorney. I am a lawyer myself and I hired an immigration attorney because things are complex and USCIS rejects for the smallest mistake. The standard attorney fees are anywhere between 2000 and 2500 USD. I do not know where you are so it is hard to recommend a local counsel but get some names from your university International Students Bureau, they usually know who is good.

The fees for filing an H-1 B (I guess this is what you mean by sponsoring) vary depending on the size of the company and so on. The maximum for this year was 3,320 USD which includes a 1,000 USD fee for premium processing. These fees must be paid by your employer. USCIS does not accept checks issued by the visa beneficiary (your personal checks).

I think I answered all your questions, if you have more I will start billing you per hour :-)

Darn, I will not go to work tomorrow...
Don't know any good lawyers in Pittsburgh. Check with the local University, they may know. All my friends that went there got good advice from the International Students Desk or whatever. If you find nothing I can check with my friends (it will be free :)))))))))))))))))))))))))
And do not forget to apply for the green card lottery(diversity citizenship or whatever) at the end of November. Afterall it is free...

Through Courier the documents will be received? do i need to specify to the employer about my spouse and children (regarding dependent visa)? Will i need any aproval from my employer for dependent visas for my family?

Hi neya,
I have not been asked many questions. VO asked me How long with present company ,What is your basic qualification and whAt is your job profile in US.
I feel my visa has been through because I had direct employment. There was no client and consultant for my H1B process.
In front of me the persons who are client through are rejected for VISA as they were murmuring to give the answers properly.
And the persons who were giving extra answers had been given blue or pink 221 g forms. So It is better to give very precise answers.

All :

I attended the interview with my wife yesterday morning, the interview is scheduled for 7:30 AM, we stood in the line at 5 minutes to 7AM, post secuity clearance we produced the application and passport to a counseller who arranged the documents and checked our finger prints, and were told to sit in Counter 12 and the interview will start at 8AM.

Following are the questions the VO had asked and the answers i have given, it does'nt took more than 5 minutes for us,

VO : Good Morning, How are you doing (I'm the second person in the counter and it is a reissue counter).
Me: Good Morning, i'm doing great, Thanks.

VO: So you have been issued the same type of visa earlier, why didnt you travel ?
Me: The project for which i intend to go was cancelled, so i couldnt travel.

VO: How long you have been working with this company.
Me: I have not joined this company, if i'm granted the visa i will join them in the US directly.

VO: Are you going to work for a specfic client, if yes who was your client
Me: (i forgot the client name and i was tensed) i'm going to work for xxxx client

VO: What is your role
Me: I'm going be a onsite cordinator

VO: Do you have a letter from the client
Me : i produced the letter which has the generic requirements for the position

VO : Do you have a client letter with your name stating that they require you ?
Me : No the client just produced a requriement for the position, if i'm granted a visa, my employer is willing to send me there.

VO : Do you have the client agreement with you
Me: yes i do

VO: Have you brought the client agreeement with you
Me: yes i do ( and i was staring at her)

VO: Sir, i wanted to see the agreement thats why i asked you that question
Me : Then i produced the document to her

VO: What is the project you are going to be working on
ME: i will work on 'yyy' project

VO: What is the project all about.
Me : I explained the project details

VO: is it a web application
Me: yes it is

Questions to my wife
VO : How long have you been married
me : 2 years

VO : Do you have the marriage certificate
Me : we produced the certificate

VO : Was your marriaged fixed by a broker, friend or a relative, is it a arranged marriage
My wife : Love and arranged
Me : Love marriage ( by this time my wife and the VO started laughing and i didnt know we both replied differently, my wife told this outside)

VO : How do you know each other
Me : we studied together

VO : You will get your passport in a weeks time, Have a nice day .
Me : Thanks

Thats it , and we were outside by 8:10 AM. other than the documents which she had asked which i mentioned above and the application(Ds-156 and DS-157) and the Petition documents(I 797 and I129), she didnt asked me for any other documents( but be prepared with all the documents i mentioned in my previous posts).

I have tried to present a real scenario from my experience, becuase you can see the mistakes i made through my conversation with the VO. Even though you prepare a lot and this is my second such appearance, mistakes are bound to happen and everything depends on the interviewers mood and the indivdual. Also since there is a glass window seprating you and the VO, sometimes its not audible and you may not hear some of thier questions, ask them again and pay attention to what He/She is asking . Be intutitive and confident, everything will go fine.

Let me wait for my passport to let you know the result :) All the very best for all of you.

Hi Neya,

Have you travelled on your last H1, if not if the VO asks just give the same reason as "the expected project for your ex-petitioners is cancelled" . Dont you worry about the consulate, the H1 visa denial rate is very low unless the VO finds something unusual. All the Best

I have neither receive any rejection nor approval at this time. I am tired of waiting for the result and i am planning to get my money back from my lawyer. i believe that there is no chance of getting a visa at this time.

Yep Senthil,

I have travelled twice to US on H1-B and in a defined time frame,the Visa Expired as per the Quoted Date.Hence,I think as far as my Prev H1 goes,I have an advantage :)

Hi Senthil Kumar,

I have taken an interview slot on 11th Sep. My wife's passport is not yet come. We will be receiving her passport may be on 10th Sep. How to book a slot for dependants?. What to do if we want to attend together on the same day? Do I need to cancel my slot and book it again?

Yes its not possible to schedule the interview without your wifes passport if you want to attend together, its better you cancel and rebook it at a later date.
