Hi Balaji Sai,

Thanks for your cons, Is there any time frame for the employer repond and the USCIS to decide on it. As you said Only Balaji can help and he only can satisfy the USCIS people to accept my application.

LAtest update by USCIS:

The CIS reports having completed data entry on all cases selected in the H1b lottery on May 23, 2008 and all receipts were issued by May 24, 2008. They have also stated that they have sufficient applications accepted so that a 'cushion' will not be needed this year and they have begun to mail out rejections for reserve cases (i.e. wait list) this week. The CIS currently has approximately 500 petitions they believe are duplicates and are in the process of hand reviewing these cases. Any of these cases that are determined to be actual duplicates will be rejected and those that are not will be accepted.

MY L1B is already issued, and H1B is pending. Can there be any kind of problems ? The H1B Status shows more evidence is required. What can happen next ?

Hi, Simi,

I also did not find this post on the official USCIS website, the last official communication being issued on April 14, 2008.

I am sure that the updates that have been posted on unofficial websites (e.g. AILA) carry much weight since they seem to be contradicting each other.

I am not sure either how reliable is the information, USCIS Office of Business Liaison provides over the phone but at least it comes directly from the source as opposed to the hear say that people post on the web.

Make your employer or consultant call the Office to check. You need to be on the line becauese the immigration officer asks for personal data before anwering any questions. Be aware that the Office does not answer questions about individual H1 B filings but provides a general update as to the treatement procedure and deadlines.

i posted an article from AILA last week, and it was almost the same. And yes, I can say that the article doesnt really corespond with what we've seen on this site...i mean people received receipts notices in June from what i know.

I dont know what to say anymore, the only thing i can add is that last year people received receipt notices until mid July(although the date limit was June 2nd,like it was this year). So hopefully there are still chances. The last time i spoke with my lawyers (this was 2 weeks ago) they said that people will get rejections even of they passed the lottery, and when this happens, someone else will be picked instead.

Hopefully this will help. My employer should call me this week to tell me the latest news so i will keep you guys posted.

I too saw the message that ur mentioning about from the www.immigration-law.com, below is excerpt,

"06/12/2008: FY 2009 H-1B Cap Processing Update

The USCIS has kept its origital schedule to mail out receipt notices for selected cases before June 2, 2008. According to the AILA, they indeed completed mailing out of the receipt notices on May 24, 2008. They started returning the loser cases beginning from this week. One bad news is that there will be no "reserve pool" this year as they determined that the initially selected cases meet this year's cap without the reserve."

Last month,my employer told that my cheque has been encashed.But tillnow i didn't get receipt no.
Yesterday i called my employer and he mailed me the cheque image and i can see the receipt no. like EAC..something.
I check my status on behalf of that receipt no.And status is "case received and pending" and processing center is Vermont.


What is this ???
I donot understand if they mailed receipt no then why didn't i get it???

Please anyone can give me some views on this situation??

Hi Leelavathi,

Once you get your petition papers, you can immediately schedule the appointment with US Consulate for the nearest available date, i think your visa will be starting from 30 September, so you can travel from that date onwards.

hello once i received my papers for petition i believe it's valid for 3 years..
can i put it on hold and schedule for US consulate appointment let's say next year..

is there an expiration when i should set an appointment to us consulate
once i get my papers..

I am MS candidate. I havent received any news of my H1B lottery! I havent got any receipt no or anything. Does it mean that I got rejection automatically. I still havent received my petition back from them. Is there any chance?

Hi All,

----------SHOCKING FOR ALL........

I got this HORRIBLE information from one of my friends who is working for these desi consultants.
What he told me is really SHOCKING for everyone.............

These consultants will charge you $2000/$2500 for filing h1b and will promise to refund after deducting so called lawers fees.
Actually, with your paid money they will invest in bringing some really high profiled techies from india, without charging anything to them. They wont even file for your H1 and you can never get to know this because they will just tell you that you didnt make lottery this year.

All this my friend told me that is becoming a common practice among the consultants to fulfil their expenditures at the cost of innocent h1n aspirants who pay money and wait for their approvals. At the end they only get some of it refunded while their h1 was never ever filed also.

So guys......beware of such cheap n wicked consultants.

So guys......BEWARE of these desi consultants.

hello bijoyajjar.... Even I'm sailing on the same boat. I kept on consulting my consultant whether he got any updated news regarding my H1... He is saying nope..... What shd I do????? I don't know whether my application got rejected or not. Do some one respond to this..... How 2 know whether our consultant applied 4 H1 or not.

I dont know Vaish... I am also confused about this thing. Anybody, who is reading this post. If you have any idea about our issue.. Please reply... I am an MS candidate, I haven't received any news about my H1b Lottery. My consultant told me that he didn't receive my petition back yet. So, what does it mean? Am i already rejected candidate? or is there any hope to get H1B this year..?? - Plz respond guys.. What your mind is suggesting you about this?

My employer emailed me today.

She said the lawyers dont know anything yet, and they cant say for sure i got rejected, that the goverment is moving very slow. last year, people got receipt notices even in July, although the last date for that was june 2nd.

So i dont really know what to say. My employer has no reason to lie, cause i didnt pay for my papers

I haven't received any news from my employer ever since they submitted my application to USCIS.
They are not even replying to my emails. Thats Great. Anyway, I do not know if there is still hope in waiting.
I came across this link and may provide some enlightenment.

Hi bijoygajjar..... I heard that applicants who got rejected last year and appiled this year.. Most of them got h1 this time. My application wasn't picked last time. More over after looking at article i.e tricks played by Indian consultants.... Iam very much worried now. I'm not in a position 2 judge whether how far it's reliable.
Do u have any idea on how much a consultant charges 4 lawyer fees or any other expenses. Plz do respond to this bijoygajjar and any other regular viewers. Regards....

they charge $500-800 as lawyer fees. My consultancy charged $700 for lawyer fess.

Frends,

Hi,I'm Neya from Bangalore and I received my EAC # with Approval Notice Sent.Can you please help me know the next steps involved in the same.Should I have to wait for the papers from the Employer or anything else is required.

I can get my queries answered from Employers but U know Employers can be really lazy in replying to the mails and there wud be no responses as such.

Hi Neha,

Yes you have to wait for your papers which should come sometime in mid of July, once you get the petition papers from your consultant / Employer , you or your employer can schedule an appointment with www.vfs-usa.co.in, your visa will be granted from 30 September and you can travel to US from that Date onwards.

Hello bijoygajjar,

I happen 2 hear from one of my friend that Last year some of his friend did't receive any receipt number/ papaers back. It seems directly she got H1 in august. I think u shd get H1 because u are MS candidate. Don't get tensed. But be in touch with your employer. I feel these days discussions in this forum are more among candidates out side US. But anyways.... I know the pain that u are undergoing.....

Well, There is no such data available that most of application rejected last year got selected. Because USCIS did marking for petition on arrival on courier without opening it. So there was no way to identify that candidate had applied last year.

Be hopeful, still people are getting their numbers. Large number of rejected application are being sent back to employers.
There is no fix amount paid to attorneys as diff people charge diff. Do not pay to any desi consultant for h1b processing.
If you do not get your money back you can file case against them .

correction, visa can be granted before 30 Sep also. You can enter in US earliar by 24 Sep 08, but can start working from oct 1 only.

Hi Balaji Sai,

I checked up with my employer/consultant. It seems he is upset by my regular follow up throu mail and telephone. I promised that I will work with him as per the mutual agreement and he is relectunt to oblige. There is no formal contract signed. He says that he will take care to reply for RFE but till today he did not say to who the RFE refers is to me or to the him i.e. employer. He did not ask me any details even after ten days from the date of receipt of RFE mail USCIS.

I also requested that if he is not sure of success of the petition better return my deposit. He took it wrongly and said he may seek attorny.s advise to recover the amount from me. (filing charges) . I understand the pressure they may face but it doesnot mean they cannot be answerable to me.

What is your view on this.

Hi,

We need to wait till july third week atleast. Till then need to keep our nerve. Only a very few might have received their papers from their employers. Those who were through consultant, need to wait. Till they received a beneficial project to place you .

Till then we can just assume and talk and it willbe a unclear picture only.
